The City Council of the City of Azusa met in regular session at the above time and place, Mayor Ortuno called the meeting to order and led in the Call to salute to the flag. Order Invocation was given by Reverend Wo Co Schnute'of Invocation Concordia Lutheran Church, Present at Roll Calla Councilmen. Memmesheimer, Cooney, Jackson, McLees, Ortuno Also Present-, City Attorney Williams, Superintendent of Light and Water Smith, City Engineer Lawrence, Deputy City Clerk Torrey Mayor. Ortuno asked if there were any corrections in the minutes " of March 4;. 1963, meeti.ngo Councilman Cooney requested a Appvle Min. cor.reCtion on page 1, relative to Park and Recreation 3/4/63 recomimendation for construction of off-street parking lot at Pioneer Park., and to insert the name of Councilman McLees as seconding the mct.ion instead of ;councilman Cooney, The City Clerk's Office requested that a correction be made on page 8, regarding Resolution 4453, by the addition of a paragraph at the end of the subject which should reads "Moved by Councilman Memmesheimer, seconded by Councilman Cooney that the Resolution be adopted. AYES. Councilman Memmehe.imer, Cooney, Jackson., McLees, Ortuno; NOES: Councilmen; None, and numbered Resolution 4453," With no .further corrections, the minutes of the meeting of March 4th were approved as corrected. The hour. of 7:30 P.M. was the time set for the continuation of Public Bearings on Substandard Structures Cases No. 92 and No. 94. Case No. 92, Substandard Structure located at 1047 North Dalton Avenue, legal owner being Mr. John Angel. The Building Inspector submitted a report stating that Mr. Angel had set a program of rehabs-litation which had been started, but not completed due to a misunderstanding of remedial procedures. After discussion, it was moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that Substandard Structure Case No. 92 be continued until the Council meeting of May 6th, and that a report be submitted by the Building Inspector by May 3rd, Case No. 94, Substandard Structure .located at 633 North Dalton Avenue, owner of record being Mr, Salvador Contreras, The Building Inspector submitted a report that the building is still standing and no work has been commenced, except that signs have been removed and premises now appear to be reoccupied. Salvador Luevanos, 341 South Enid, appeared before Council on behalf of Mro Contreras and stated he has been unable to have the premises vacated and requested a three -weeks grace Period to comply with requirements of the Building Inspector. Str, Case x}94 5/6/63)to 3r 7" 1 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 151 1963 Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the hearing on Sub- standard Structure Case No. 94 be continued to May 6th meeting, The hour of 7:30 P.M. being the time set for public hearings on appeals by Rodeffer Industries, Inc., to the denial of a Variance to excavate water conservation and spreading basins by rock quarrying methods, and to remove rock, sand and gravel and process same for commercial purposes, on property comprising a triangular shape of approximately 276 acres between the San Gabriel River and west of San Gabriel Canyon Road, approximately north of 13th Street; also to the denial of Zone Change from "W" to "M-2" for approximately 33 acres of property on the east side of'San Gabriel River, north of American Cyanimid plant; and also to the denial of Conditional X Use Permit to allow rock, sand and gravel and related M operations, including crushing, sizing and storage of rock t*- and gravel and related ready -mix cement operations on an area of approximately 33 acres lying on the east side of San Gabriel River and north of American Cyanimid plant, the hearings were declared opened by the Mayor. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the three hearing be combined. The Deputy City Clerk presented the Affidavits of Proof of Publication of Notices of these Public Hearings, and stated that Notices of Appeals from Rodeffer Industries, Inc., addressed to the members of the City Council, were filed in the City Clerk's Office on March 4, 1963. Mr. Glenn R. Watson, whose offices are at 615 South Flower, Los Angeles, addressed Council, and stated that this is an application basically for the excavation and removal of rock and gravel from the spreading grounds for the purpose of creating water conservation basins. The Spreading Corporation has been in existence for 26 years and was formed for the sole purpose of spreading water on this particular property. This proposal is to create four basins. These basins have been designed by the Los Angeles County Flood Control District and meet their requirements and specifications for the spreading of water. The San Gabriel River Spreading Corporation is a non-profit corporation formed to spread water and serve several constituent water companies, as follows: (1) Azusa Agricultural Water Company, who has a 9% interest (The City now owns 80% of the stock in Azusa Agricultural Water Co.), 2) Glendora Irrigating Company; (3) Azusa Irrigating Co., who also uses the name of the Azusa Valley Water Company ; (4) Covina Irrigating Co.; (5) City of Glendora; and 16) Contract Water Company. The Spreading Corporation has entered into an agreement with Johnny Johnson,. who is a successful investor in the south part of Los Angeles, who in turn entered into contract with Rodeffer Industries for the extraction of the rock necessary to make the basins, This case comes about by the reason of these circumstances. Land is becoming valuable and is being put to other uses. The importation of water into Southern California is going to take Page 2 Pub. Hrgs, re:appeals to denial of Var. Zn.chg. & Cond. The creation of these basins will provide a place :... not only for the excess water that flows in the river, but will provide basins for the storage of imported water. The owners of this land, the Spreading Corporation, some time ago, approached the Los Angeles Flood Control District with the view of designing basins so that the spreading of water could be implemented and could be increased so that a program could be put into effect. Upon the completion of these basins, the property would be deeded in fee to a public agency so that it would be permanently used for the spreading of water and could not be diverted to any other use. We would not be here if it were not necessary to dispose of the excavated material and to handle it commercially, in order to make it economically feasible. The ordinance pro- vides that the "W" zone precludes commercial use of the 00 material, so, a change of zoning is requested in order to permit a commercial use of the material. We are not asking much beyond the present scope of the zoning ordinance. L-. With respect to the removal of the material, of the 20 million yards of material, under the lease or contract entered into with Johnny Johnson and participated with Rodeffer; this 20 million yards would be paid for at a rate of 6¢ per yard for compensation to the Spreading Corporation. In the esti- mated .15 years required for the removal, $1,200,000 will be paid to the Spreading Corporation in royalties. We assume that the Spreading Corporation will go to the constituents; and the City of Azusa, in royalties, will receive between $85,000 and $90,000, Later we will point out the amount of sales tax revenue from the operation. The Flood Control District has committed itself in writing .to do this if the basins are offered to it. It has been discussed to leave the fee with them; it could be changed so that the fee could be dedicated to the City of Azusa. Arthur Bruington, of the Los Angeles County Flood Control District, with offices in Los Angeles, addressed Council reading a letter signed by Walter J. Wood, Chief Deputy Engineer, in which it was stated that the development of the spreading grounds is a vital part of the program for the water supply system, and at the completion of the basins, the lands would be deeded to the district. It is the opinion that after development of the basins, the spreading area will be of substantial benefit to the water users of the entire San Gabriel Valley as well as those in the upper canyon basin. Mr. Watson introduced Mr. Harvey 0, Banks, partner and prin- cipal in the firm of Leeds, Hill & Jewett, 120 Montgomery St., San Francisco, who has been a director of the water resources for the State of California, who has been engaged by our firm as a consulting engineer. Mr. Banks appeared before Council stating that his firm was requested by Rodeffer Industries, not as a conservation mea- sure to advise them if these basins fitted in with the plans for the water supply for this. We realize the extreme value of the upper canyon basin. The capacity of the spreading works is limited. The spreading of water in this area is much more important to Azusa in the future as the City's future needs grow. Water needs will increase 6,000 acre feet to 11,500 feet per year by 1990, with the problem of how the water will be procured„ May I point out that the safe yield 358 fl 1 1 00 CITY HALI, ALUS.A, CALIFORNIA MONDAY, APRIL 15, 1963 Page 4 of your present 811PP1.y is 52 acre feet, or 6300 acre feet per year. The water you will obtain from the State will need treatment. The .State will not furnish terminal or regulation storage for the water, the City will have to find some way to accomplish this, and the cheapest way is by spreading it through basins, and then pump from the basin as needed. Some of the advantages of the deep basins, by the excavation :and removal, will increase the capacity by some 50% or approximately 7,000 acre feet of storage capacity. It will. increase the spreading capacity by at least twice, It is very important to the City of Azusa as well as to the San Gabriel Valley as a whole that the upper canyon basis be developed for use in the best possible manner, for the oasseavation and storage of local run-off, but also for water that: is to be Imported. The spreading capacity should be !r-.rea;aed. Also, if possible, the capacity of the basin, it3e:lf should be .increased to meet the demands that will, be placed upon it. As a result of my analyzation, I have coracludcd th.ts offer Is a .feasible means of accom- plishing the n•::,esaavy results in an effective manner. Then, Azusa can depend upon its well supply and will not have to build a treatment plant; increase water levels and reduce pumxirlg costs. Mr. E. 0. 31;;;.rf.°fer, president of Rodeffer Industries, Inc., 5435 North :Peck :cid., Arcadia, appeared before Council stating that .it is not new for their company to build a plant and to operate it In the construction of basins for the control of water. The. century Rock in Arcadia is presently being uti- lized in this manner. Mr. Rodeffer further stated that there are certain oblecti.ons that residents have to their operations, namely, not e, dust, and traffic. The crusher is planned to be placed below surface level, thus the noise is contained within the area. The silhouette of our plant is kept close to the ground, only the belt or conveyor extending, and no more than 201 or 30° above ground, with huge stock piles between the plant and the residences which eliminates.,the F'ae i transmission of noise. Great care is taken regarding dust. The Air Pollution Control .Board is constantly checking. Road- ways and areas are watered down. The traffic flow will be toward Loren, with intention to request a permit from the Corps of Engineers to remove the material down the San Gabriel River exiting at Arrow Highway at Santa Fe Dam. Mr. Watson again appeared before Council stating in conclusion that sales tax revenue would amount to $940,000, together with $85,000 royalty revenues, bringing returns to the City of Azusa of over $1,000,000 for excavation and removal of thio.material. Mr, E. H. Walters, 146 East College, Covina, Vice President of the San Gabriel River Spreading Corporation, appeared before Council representing the Covina Irrigating Company's member- ship in the Corporation, and stated that we, as a Spreading Corporation, have joined with Johnny Johnson and Rodeffer Industries in the three applications, and desire the,,Council to give the matter careful consideration.and favorable,gapproval. !-jt 1011 Albert J. Downard, 1142 North Sunset Avenue, appeared before Council in favor of the development as proposed by Rodeffer,; Industries providing certain provisions, such as the:,gglf::, course and a buffer zone for.the,Crystal;Tract ho�es,,,,wrill be included. .t . :136® 0 1 1 CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 15, 1963 Mr. Otis Gordon, 234 Opal Canyon Drive, Duarte, Vice Mayor of the city of Duarte, appeared before Council and stated that the City of Duarte is opposed to this appeal and has adopted a minute Resolution by Council action in which we have pre- sented the fact that the proposed quarry is too close to high-priced homes in the City of Duarte. Mr. Gordon then stated he had a letter signed by William A. Markey, Admini- strative Director of the City of Hope Medical Center, which he wished to be read into the record. The Honorable William Lancaster City of Duarte Box 218 1684 East Third Street Duarte, California Myo dear Mayor Lancaster: 00 With respect to the proposed rock quarry to be located in the City of Azusa, near the Fish Canyon area of Duarte, the City of Hope Medical Center hereby expresses its sup- port of the position taken by the Duarte City Council in pQ opposing the quarry, Although we recognize that the site is at some distance from City of Hope Medical Center, the Medical Center is in the path of frequent winds from the area, and we feel that the additional source of dust in this area, com- bined with the more important source of dust from the trucks hauling materials from the quarry site, and passing closer to the Medical Center, could be undesirable to many of our patients. ' Throughout the country, increasing emphasis is being placed on medical conditions in the general category of chronic respiratory disease. Air contamination from a myriad of sources, from air and dust -borne bacteria to smoking are frequently implicated in these cases. As we have indicated in earlier letters, coccidioidomy- cosis, or valley fever is known to result from exposure to dust from certain layers of earth, and there has been no established determination that the organism causing this disease is absent from earth layers below the sur- face in this vicinity. In short, our view is that any increase in atmospheric dust in the area of our Medical Center Is potentially harmful to our patients, many of whom are debilitated and may be suffering from respiratory illnesses. In- creased quarrying or rock mining is conducive to increased dust, both from the mining operation itself and the accompanying exposure to wind currents, and from the trucking of the mined material past the area of the Medical Center. We hope this may be helpful to you and to the City of Duarte in presenting its position on this issue. IVery truly yours, and signed by William A. Markey, Administrative Director. At this time, Mayor Ortuno called for those who wished to speak in protest to the request. Page 5 o�� 36,-2 1 go C: LL^ L CITY HALL AZUSA, CALIFORNIA MONDAY, APRIL 15, 1963 Page 6 Mr. Carleton Peterson, an attorney with offices at 621 South Spring Street, Los Angeles, appeared before Council as representing the Azusa Home Owners Association, and requested to speak for the citizens in protest to the proposed quarry operations, pointing out the cost of construction of the access road on Loren Avenue; the possible pollution of water and cost of the purification of the water; noise from the truck traffic; and health hazard, especially to children. Mr, James Scalo, 321 West Ashby Street, president of the Azusa Home Owners Association, appeared before Council in protest to the quarry and presented petitions of 1500 names for the record and requesting Council make a decision at this time denying the request. Others appearing in protest to the request for quarry operations were: Mr. James Price, 847 North San Gabriel Avenue Dr. J. W. Hankins, 520 West Foothill Blvd. Mr. Darrell Wright, a representative of Development Engineers, Inc, developers of Royal Oaks Village, in Duarte Mr. Maurice Jones, Jr., of Stephens, Jones, LaFever & Smith, attorneys, 621 S. Spring St., Los Angeles Mr. Martin Offenbacker, 325 West Channing Mr. Ray Boyer, 1143 North Dalton Mr. Dean Griffin, 407 Ellsworth Street The Deputy City Clerk read letters from the City of Duarte, the Azusa Woman's Club, and the American Legion Auxiliary. Glenn R. Watson again appeared before Council and spoke in rebuttal to the statements made in protest. Upon questioning by Mayor Ortuno whether anyone had visited the Rodeffer plant, Mr. V. R. McLeod, 1127 North Angeleno Avenue and Mr. Martin Offenbacker stated they had visited the Rodeffer plant in Arcadia. Moved by Councilman McLees, seconded by Councilman Memmesheimer and unanimously carried that the hearing be closed. Moved by Councilman Jackson, seconded by Councilman Memmesheimer that the appeal for the Variance be denied. Motion failed by the following vote of Council: AYES: Councilmen: Memmesheimer, Jackson NOES: Councilmen: Cooney, McLees, Ortuno ABSENT: Councilmen: None Moved by Councilman Cooney, seconded by Councilman McLees that the decision regarding the appeals by Rodeffer Indus- tries, Inc., be postponed to the May 20th meeting, and that a committee be appointed by the Mayor to study this matter with a member from the Azusa Home Owners group, City Engineer, City Planner, plus two members of the Council, or whomever the Mayor feels should be on the committee. Moved by Councilman Cooney, seconded by Councilman McLees that the appointments by the Mayor of the Committee be accepted. The Planning Commission submitted a request for a declaration Req.by and support of the Planning Commission's function, as required P1.Comm. under State Law, as a Capital Improvement Committee, instruc- ting the Department Heads of the City to respond to the request to submit a list of proposed major capital improvements. Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the City Administrator be requested to write the Department Heads that a list of proposed major capital improvements be handed in to the City Planner by April 26th. Notice was given that the Planning Commission, by Resolution No. 320, initiated an amendment of Article IX, Chapter 2 Zoning Chapter) of the Municipal Code, to add thereto an 'R -GA" (Garden Apartment) Zone. The monthly report of the Planning Commission for March was submitted to Council, Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the report be filed. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the recommendation be accepted, A communication was received from the Azusa National Little League requesting a Y to be installed in the new sewer .line to be constructed on Rockvale Street to facilitate connec- tion to the sewer line for their new snack bar and lavatory facilities to be erected on school property. The Park and Recreation Commission also submitted a recommendation of approval for City assistance with costs of lavatory plumbing and sewer facilities for National Little League snack bar to be erected. Also, a letter directed to the National Little League advising that the City regrets it is not possible to assist with costs of lavatory plumbing and sewer facilities for the snack bar. The Treasurer's Financial Statement for the month ending Tr•eas.Finan March 31, 1963, was presented to Council, showing Bank Stmt. Balances of all funds as of that date to be $470,922.37. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the Treasurer's Statement be filed.
