MORROW,DIRECTOR OF UTILITIES DATE: MAY 27, 2014 SUBJECT: RESOLUTION APPROVING PARTICIPATION IN THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY USED OIL PAYMENT PROGRAM RECOMMENDATION It is recommended that the Utility Board adopt Resolution No. UB-4-14 approving the City's continued participation in the California Department of Resources Recycling and Recovery (CalRecycle) Used Oil Payment Program (OPP) and designation of the Utilities Administrative and Financial Services Manager as the signature authority for the program. BACKGROUND In compliance with the California Oil Recycling Enhancement Act since its inception in 1991, the City of Azusa continues to maintain a year-round used oil recycling program, which is administered by a consultant, Huls Environmental, and funded by a used oil recycling block grant from CalRecyle (formerly California Integrated Waste Management Board). The program being carried out in Azusa consists of the City supplying used oil drain pans to participating used oil collection centers, which currently includes Dick's Auto Supply, Jiffy Lube, 0' Reilly Auto Parts,Valero Gas Station,and Y Tires, and advertising to promote drop off of used oil and filters at these centers. In October 2009, former Governor Arnold Schwarzenegger signed SB 546 into law which made significant changes to the program effective January 1, 2010 and it was renamed Oil Payment Program (OPP). The Utility Board adopted Resolution No. 10-C38 at its June 28, 2010 meeting to continue its participation in the program. Due to a change in the job title of signature authority from Assistant to the Director of Utilities to Utilities Administrative and Financial Services Manager, CalRecycle requires updating the resolution to reflect the change. The signature authority is authorized and empowered to execute UB-23 Used Oil Payment Program May 27,2014 Page 2 in the name of the City of Azusa all documents, including but not limited to, application, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support the used oil collection program. The City receives funding over $13,000 annually and a report is submitted every August to itemize expenditures for funds received. In 2013, the City collected a total of 11,822 gallons of used oil, 4,083 used filters and distributed 433 oil drainer containers to Azusa residents through the certified collection centers. FISCAL IMPACT The City of Azusa will be eligible to receive approximately $13,400 in revenue to fund the program for FY 2014-2015. UB-4-14 A RESOLUTION OF THE AZUSA CITY COUNCIL AND UTILITY BOARD OF THE CITY OF AZUSA, CALIFORNIA, APPROVING PARTICIPATION IN USED OIL PAYMENT PROGRAM ADMINISTERED BY THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY. WHEREAS, Public Resources Code sections 48690 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, to make payments to qualifying jurisdictions for implementation of their used oil programs as required by PRC § 48690 et seq.; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the Used Oil Payment Program; and WHEREAS, CalRecycle's procedures for administering the Used Oil Payment Program require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program. NOW, THEREFORE, BE IT RESOLVED that the City of Azusa authorizes the submittal of a Used Oil Payment Program application to CalRecycle; and BE IT FURTHER RESOLVED that the Utilities Administrative and Financial Services Manager or his/her designee, is hereby authorized and empowered to execute in the name of the City of Azusa all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support our Used Oil Collection Program; and BE IT FURTHER RESOLVED that this authorization is effective upon adoption and shall extend until rescinded by the City of Azusa.
