Mayor Ortuno called the meeting to order and led in the salute Call to to the flag. Order ,vocation was ,given by Rev. R. W. Durnal of the Foothill Park, Invocation ptist Church. The Treasurer's Financial Statement for the month ending April 30, 1963, was presented to Council showing Total Bank Balances as of that date, $446,259.07. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the report be filed. The first Public Hearing was the continued hearing of Edsal, Edsal hrg. Incorporated, relative to a Precise Plan of Design for the 'construction of a 302 unit apartment development on the south side of Alosta Avenue between Citrus and Ben Lomond Avenues, as approved by the Planning Commission. After hearing further discussion on this subject, it was Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Councilman Cooney moved, seconded by Councilman Memmesheimer, that the Precise Plan of Design be approved, subject to the issuance of a Variance. Motion carried unanimously. Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING Res, 4485 PRECISE PLAN OF DESIGN. (Edsal Corporation).. 'appvg. Prec.Pla Moved by Councilman Cooney, seconded by Councilman McLees and (Ed sal) unanimouslycarried that further reading be waived. The second Public Hearing was held on the proposed change of West hrg. zone from "R-3" to "C-2" for the.property located on the south- Zn. chg. west corner of Azusa Avenue and Paramount Street (Squire West applicant). The Deputy City Clerk presented the Affidavit of Publication, list of property owners notified, and stated that two communications had been received, one in favor of the pro- posed zone change and one in opposition. There being no verbal protests, it was Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman McLees, seconded by Councilman Cooney that-___ 'the recommendation of the Planning Commission relative to the zone change be approved. Go C,j-The-next Public Hearing was on the proposed zone change from Eichhorn U� "R -lc" to "P" as approved by the Planning Commission, for the hrg.)(zn. —property located on the north side of Gladstone Street, from chg. 105 feet to 185 feet west of Louise Avenue. This property is m owned by Elmer Eichhorn. The Deputy City Clerk presented the Affidavit of Publication, list of property owners notified, and stated that no written communications had been received in re- gard to this hearing. Mr. Elmer Eichhorn, the applicant, of 14334 E. Amar Road, La Puente, appeared before Council to state that his plans called for six apartment units. Also present was Mr. Barr, 837 E. Valley Boulevard, San Gabriel, who is the builder of the units. There being no persons in the audience wishing to protest, it was Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman Memmesheimer, seconded by Councilman Cooney that the zone change be approved and the City Attorney be authorized to draw the necessary Ordinance. Motion carried unanimously. ' The Deputy City Clerk presented the Affidavit of Publication Hrg. re: relative to the proposed amendment to the Zoning Chapter of the multi - Azusa Municipal Code re: multi -story (or high-rise) buildings, story and stated that no communications had been received relative to bldgs, this hearing. It was reported by the City Attorney that there would be two sections: No. 1, which would cover the downtown area; and No. 2, which would include the balance of the City -- this section requiring a Conditional Use Permit for the con- struction of such a building. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the hearing be closed. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the City Attorney be authorized to prepare the necessary Ordinance, deleting Section 9230.93 of the proposed amendment. Also scheduled for Public Hearing was the proposed amendment Hrg, re: to the Zoning Chapter of the Azusa Municipal Code relative to "R -Ga" zng. an "R -Ga" (Garden Apartment) Zone. The Deputy City Clerk pre- sented the Affidavit of Publication and stated that no com- munications had been received relative.to the hearing. There were no persons in the audience.wishing to be heard. City Attorney Williams questions the Section (9217.10) relative to the use of existing structures. The next Public Hearing was the continued hearing on Sub- Hrg. re: standard Structure Case #94, for the property located at 633 Subst.St. 'N. Dalton Avenue, which is owned by Salvador Contreras. As Case 94 . the Deputy City Clerk stated she had received a verbal report (Contreras) from Mr. Whisler, Building Inspector, that the structure had been demolished, it -was -- Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the case be dismissed. 00 -- M With regard to a report from the Committee appointed to study Rodeffer U- the appeal of Rodeffer, Industries, Incorporated,.on denials of Industries a Variance, Zone Change, and Conditlonal,Use Permit for the X purpose of mining in the spreading grounds, it was reported that no committee meeting had been held due to the understand- ing that Rodeffer Industries might lose their property lease. Moved by Councilman Jackson, seconded by Councilman Memmesheimer that the variance be denied. Sunset Avenue, Azusa, appeared before Council to protest the continuation of the hearing and con- sequent decision. — Gordon Peterson, Attorney, 621 S, Spring Street, Los Angeles; appeared before Council as representative of the Azusa Home- owners Association, and suggested that the land could be condemned and put to other use. Moved.by Councilmen Cooney, seconded by Councilman McLees that the City Attorney and Assistant City Engineer be added to the -- Committee previously named to study the situation. Motion carried by the following vote: --AYES:- Councilmen: Cooney, McLees, Ortuno T OES: Councilmen: Memmesheimer, Jackson ABSENT: Councilmen: None The next item scheduled was the decision relative to the revocation of the business license for Baker's Tacos No. 1, located at 353 E. Foothill Boulevard, which was issued to Mr. H. E. Comstock, Jr. Mayor Ortuno stated that he had listened to the -tape-recording of the hearing which took place -at the previousmeeting when he had been absent, so that he was familiar with the proceedings which had taken place, and he felt this matter should be continued before a definite decision is reached. After reporting on the various aspects of this subject, it was recommended by the City Engineer that authorization be given for the expenditure of $12,000 to install full signalization at this intersection, and that the crossing guard now at this corner be re -assigned to Fifth and Cerritos. A statement was received from the Chamber of Commerce C. of C. requesting reimbursement in the amount of $300.00 for funds fnd. req. advanced -to -the --Azusa Band Boosters Club for the trip to the National City Band Review. It was recommended by Councilman Cooney that in the future this expenditure be included in the Chamber of Commerce budget, and that a specific request be brought before Council prior to the date of the Band Review each year in order to have the expense paid by the City. A communication was received from the Azusa City Employees ACEFCU Federal Credit Union requesting use of the office at the ltr, re: 'rear of the auditorium, which is occupied by the Council of Aud. Off. Social Agencies, for a short time each day. Moved by Councilman McLees, seconded by Councilman Cooney that the use of this office, after City office hours each day, be granted to the Credit Union, subject to revocation at any time. May 30, 1963, be declared as Highway 66 Flag Dedication Day. Day-Procl. Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the Mayor be authorized to sign 'the Proclamation. The resignation of City Engineer Robert R. Lawrence as of May 28, 1963, was presented to members of Council. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the resignation of Mr. Lawrence be accepted with regrets.
