Mayor Ortuno called -the meeting to order and led in the Call to salute to the flag. Order In%.ocation was given by Rev. James M. Fincher of Calvary Invocation Evangelical, Church. The City Clerk announced. that bids were opened in the City Bid Award Clerk's office at 10:00 A.M. Friday, October 4, 1963, for Signals @ the installation of traffic signals at the intersection of 5th St. Fifth Street and Pasadena Avenue. The City Clerk presented the Affidavit of Publication of Notice Inviting Bids, and stated that bids were opened in the presence'.of City Admini- strator Foxworthy, Acting City Engineer Sandwick, Police' Captain Warren and City Clerk Miller. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the City Attorney be instructed to prepare the necessary amendment as recom- mended by the Planning Commission. The hour of 7:30 P.M. also being the time set for the public hearing on the proposed amendment to the.Circulation Element of Azusa General Plan (Master Plan of Highways), providing for revised realignment of Cerritos Avenue north of Fifth Street, the Mayor declared the hearing opened. The City Clerk presented the Affidavit of Publication of Notice of Public Hearing. A communication was received from Acting City Engineer recommending the adoption of the realignment of Cerritos Avenue from Fifth Street to Sierra Madre Avenue. The Acting City Engineer appeared before Council and explained the r•r purpose of the proposed realignment of Cerritos Avenue and the change required to revise the Master Plan of Streets and Highways to show this realignment. There being no further communications, and no one in the audience wishing to be heard regarding this subject,'it was Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman Memmesheimer, seconded by Councilman ' Cooney and unanimously carried that the realignment of the extension of Cerritos Avenue be approved and included on the Circulation Element of the Azusa General Plan and instructed the City Attorney to prepare the necessary documents. The hour of 7:30 P.M. being the time set for the public hearing for a proposed zone change upon annexation, recom- mended by Planning Commission Resolution No. 348 (Case Z-87), on property located at the northwest corner of Citrus Avenue and Gladstone Street, described as Lots 1, 2 & 3, Tract No. 19809, owned by J. Watts, et al, being a part of pro- posed Annexation District No. 53, the Mayor declared the hearing opened. The City Clerk presented the Affidavit of Publication of Notice of the Public Hearing, and stated that no written communications had been received. Mayor Ortuno stated that the Planning Commissior. has recommended that Lots 1 and 2 be pre -zoned "C-2", and Lot 3 be pre -zoned to "Rlc" Mr. Edward J. Till, 145 North Painter Avenue, Whittier, ,representing Mr. Watts, appeared before Council and stated the request was made for a zone change to C-2 for Lot 3, owned by Mr. and Mrs.James Welsh, in order that the owners would be in a position to take advantage of the zoning at a future time. The next lot to the west,.Lot 4, is at present a rest home, and possibly other property owners to the west may wish to take advantage of a more commercial zone. Mr. Till further stated that a realignment of the service road is contemplated. It will be necessary to vacate the service road in frcnt of Lots 1 and 2, but there will be no physical access from the Iroposed service station to the service road to the west. Mr. James Welsh, 18463 Gladstone Street, appeared before Council and stated that he is owner of the home on Lot 3. Mr. Welsh stated that he is opposed to the zone change and to the proposed use of the other property as a service ' station. Mr. Welsh stated the possibility of increased Fire Insurance rates and the nuisance of fumes and noise from the service station, also property values would conceivab'y be lowered, that a request for zone change before the Los Angeles Regional Planning Commission, about July 26, 19635 was denied. Mrs. James Welsh, 18463 Gladstone Street, appeared before Council and stated that she is opposed to a service station being located adjacent to their property. There is at present a service station directly across the street which does not enhance the view. The rest home to the west is not objectionable. Mrs. Welsh stated that she is a teacher M in the community and plans on living at this address when she retires. m Mrs. Evelyn Coppick, 18473 Gladstone Street, appeared before Council and stated that.she is the original owner of Lot 1 and moved there in 1955, There have been many changes since that time, such as various businesses and increase of traffic, which has charged the area from an exclusively residential area. Mrs. Coppick stated she is in favor of the proposed zone change. Mr. Till again appeared before Council and stated that a masonry wall will be constructed approximately 10 feet from ' the Welsh's house. Mr. Till further stated that he had met with Mr. and Mrs. Welsh and urged them to join in the applica- tion for change of zone, feeling that their best interests were concerned. i Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Following discussion, it was Moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that the decision on this matter be continued until the next meeting. A decision on the appeal to the denial in part -f the zone Re: appeal change from "W" to 'R-3", as petitioned by Rodeffer on zone chnge Industries, Inc., public hearing closed on August 19, 1963, (Rodeffer) and matter postponed from September 16, 1963 meeting, was deferred to presented for Council consideration. Adjnd. Mtg. lo/14/63 A communication was read in full from the Clerk of the Board of Education of the Azusa Unified School District stating that the District Board has received several proposals from Mr. Johnson and Mr. Rodeffer regarding the acquisition of ' school sites, one of which arrived too late for the Board's regular meeting. The Board of Education further stated an adjourned meeting would be held October 8th, at which time, it was hoped, a decision would be:made to accept a proposal for a school site. Glenn R. Watson, 615 South Flower Street, Attorney for Rodeffer Industries, Inc., appeared before Council and stated that although his company is anxious to obtain a decision regarding the change of zone, Mr. Johnson has been 131 CITY HALL AZUSA, CALIFORNIA MONDAY, OCTOBER 7, 1963 Page 4 assured by Dr. Bell that the School Board will be in a position to make a final offer at the Board's adjourned meeting. Following discussion, it was Moved by Councilman Cooney, seconded by.Mayor Ortuno that ' the decision on the request for zone change be postponed to the meeting of October 14, 1963. .Motion failed by the following vote of Council:. C�9 C A communication from the Los Angeles County Flood Control District was read in part relative to conditions and restric- CZ tions to be established pertaining to the construction of - apartment houses in an area generally overlying what is known as the Lohman Dike. Following discussion, it was Moved by Councilman Cooney, seconded by Mayor Ortuno that the City Administrator be authorized to contact the Flood Control District to determine the conditions to be imposed if such zoning.was permitted. Motion failed by the following vote of Council: AYES: Councilmen: Cooney, Ortuno NOES: Councilmen: Memmesheimer, Jackson ABSENT: Councilmen: McLees Mr. Robert B. Emery, 638 West 4th Street, appeared before Com. Apptd. Council and stated that with regard to problems of youth on youth activities, which was discussed at the meeting of Septem- problems ber 23, 1963, no meeting has been held to date. Following discussion, Mayor Ortuno recommended the appoint- ment of the following persons to meet to discuss the problems involving the young people of our community: Mr. Robert B. Emery, Mr. William A. Baxley, of the Junior Chamber of Commerce, Councilman McLees, a representative from the Azusa Police Department to be selected by the City Administrator, an available member of the clergy, who- ever can attend, Mr. Bart Ahlf, representative from the schools, and one young man and one young woman to represent the youths of Azusa to be selected by the young people themselves. Miss Donna Prishmont, 574 East 2nd Street, appeared before ' Council on behalf of the young people, recommending that the young people be included on the committee. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the committee as recom- mended by the Mayor be approved. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the recommendation of the Mayor be accepted and that Paul D. Foxworthy be appointed as the alternate. A communication was received from Mr. Claude H: Rickards,• Offer sale 230 West Foothill Blvd., offering to the City the purchase of Lots to of Lots 17 and.18, Block. 29, Map of Azusa.. City .(tabled) Moved by Councilman Memmesheimer, seconded by Councilman Cooney that this matter.be.tabled to the'next'meeting. . A communication was presented regarding action of the LAF & A State Legislature in the.formation of the Local•Agency Comm. Formation and Annexation Commission, whereby two mayors or city councilmen would be elected by the mayors to serve on the Commission.- The City Administrator recom- mended that the City endorse Louis G. Memmesheimer as .nominee to serve on the Commission. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously.carried that the nomination'of Louis G. Memmesheimer for the position be approved, and .that the City Administrator be authorized to send a suggested letter to the mayors of all cities in the County. , L34 I I 1 CITY HALL AZUSA, CALIFORNIA MONDAY# OCTOBER 7, 1963 The City Administrator gave a verbal report on the mailing to residents in areas contacted for possible annexation to the City. There have been approximately 3300 letters mailed, with a 30% return. Following discussion, it was Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the City Administrator be authorized to re -address and forward the 476 envelopes that have been returned A communication was received from the Public. Utilities Com- mission of the State of California giving notice of hearing relative to the safety, maintenance, operation, use and protection of all public grade crossings. The City Admini- strator stated the hearings will be concerned with a determination of the need for protective grade crossing devices and, if so, the cost would be divided between the cl:City and the Commission. The City of Azusa has, at the present time, twelve (12) grade crossings, seven on the ,... Santa Fe mainline and five (5) on the spur tracks. m 00 Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the City Admini- strator be authorized to attend the hearing in order to advise of action taken by the Commission that might affect the City. A memorandum was received from the City Administrator which included a quotation from Assembly Bill #1812, Chapter 1180, amending Sections 146c, 146d, of the Penal Code, regarding Peace Officers --- Psuedo Law Enforce- ment Activities as it affects the Azusa Mounted Police. Mr. Leo Nasser, 1131 North Sunset Avenue,, appeared before Council, and stated the Azusa Mounted Police was formed as a public relations group to represent the City, that the group has participated in parades for the past eight years, and woule! appreciate if it were possible for the City to sponsor the group in some manner. Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that the City Attorney prepare a resolution deleting the word "police" in the name, expressing the appreciation for the past services to the City, and releasing the City from'any beneficial connection between the group and the City. A communication was received recommending the appointment City Engineer, probationary, 1963. from the City Administrator of Mr. Robert K. Sandwick as at Step 3, effective October 9, Moved by Councilman Memmesheimer, seconded by Councilman Jackson and unanimously carried that the request of the City Administrator be granted to appoint Robert K. The City Administrator presented a verbal request from Barry Eaton, Planning Director, to attend a Seminar re- garding the Planning for Industrial Development and Related Factors, to be conducted on one day in four consecutive weeks, on Tuesday, October 8, 15, 22, and 29, from 3:00 P.M. to 7:30 P.M., total cost. of $35. A communication was received from the Superintendent of Light and Water requesting the waiver of the sealed bid requirement to permit the purchase by quotation of three. 333 KVA transformers and three 1672 KVA transformers, required by the Light and Water Department to serve elec- trical energy to the Gilfillan Corporation. Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried that .the request be approved to waive the requirements for sealed bids, since a finding has been made determining that it is to the City's advantage.to waive the requirement. Mr. W. T. O'Neil, of Gilfillan Corporation, appeared before Council thanking them for the action taken on the waiver, which will make it possible for their concern to proceed. with the work on government contracts and much more expeditiously. Moved by Councilman Cooney, seconded by Councilman Memmesheimer and unanimously carried authorizing the urchase of the three transformers in the amount of 7,583.o4. A communication was received from the Superintendent of Light and Water regarding consideration of adoption of a policy covering water line extensions. Moved by Councilman Memmesheimer, seconded by Councilman Cooney and unanimously carried that the matter be referred to a committee composed of the Superintendent of Light and Water, City Engineer, City Attorney and City Administrator for a report to Council at a later meeting. Moved by Councilman Cooney, seconded by Councilman. Memmesheimer and unanimously carried accepting the completed project and authorizing the Mayor to sign the Notice of Completion and the City Clerk to have the Notice recorded. A communication was received from the Engineering Department Res. re: regarding Dalton Avenue, from Thirteenth Street to Sierra Dalton Ave. Madre Avenue and recommending the adoption of two resolutions. (failed) A Resolution was presented 'adopting Dalton Avenue between Sierra Madre Avenue and Eleventh Street as a Major City Street. M Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DESIGNATTNG CERTAIN STREET AS A MAJOR STREET IN THE CIT` OF AZUS.. (Dalton Avenue from Eleventh Street to Sierra Madre Avenue) Moved by Councilman Cooney, seconded by Mayor Ortuno and unanimously carried that further reading be waived. The City Attorney stated that in line with the recommenda- tion of the City Engineer, an emergency orlimance has been prepared, which will be effective immediately, if you wish to adopt it, which would do these things. The present ordinance provides this: 'If there is no public sewer abutting the property or, if there is no sewer available within 300 feet of the structure, the structure can be connected to the cess- pool. It should read "and" instead of "or". Thus,..."If there is no sewer in the abutting street'"and" a sewer is at least 300 feet removed from the structure" ... As to what structures can be connected to the cesspool - the sSngle family dwelling, thus omitting large number of multiple dwellings, and, secondly, if the.structure is a non-residential structure and if the Superintendent of Sewers makes a finding that the effluent and soil condi- tions are such that adequate drainage would be accomplished, but it does require a "finding", the structure may be con- nected to a cesspool or septic tank. Councilman Memmesheimer offered the following Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE TO REQUIRE CERTAIN STRUCTURES TO BE CONNECTED TO A PUBLIC SEWER AND DE- .CLARING THE SAME TO BE AN URGENCY MEASURE:TO TAKE EFFECT IMMEDIATELY. The Ordinance was read in full. Moved by Councilman Memmesheimer, seconded -by Councilman Cooney that the Ordinance be adopted. Mr. Richard Schiering, 5010 North Citrus Avenue,;Covina, M appeared before Council and stated that he is the owner of 2� acres of property located at 655 Donna ,Beth'Avenue. �..� This is in the area in which there will be a'considerable C4 number of multiple units. Mr. Schiering stated that his .problem is economics, in that his loan is closed, that he has submitted a precise plan.and-is ready for a plan check. The property is'located on.the west side of Donna Beth north of the Department of Water & Power Easement. Mr. Schiering further stilted, "We would like to know if there is any way of devising some way for us to go ahead and ' complete the development. The sewer system is a con- siderable distance away. Some people are interested in '. bringing it in., but, at the earliest, it would be sometime 'next summer, and we would anticipate having our structures completed within the next four months. We can install some type of facility that would be acceptable until such time as sewers are made accessible." City Engineer Sdndwick stated that a meeting is planned for October 25th to re-organize,the Sanitation District and plans-, are being formulated to extend the line in°order to bring it up to this area. Following discussion, the City Attorney suggested that an amendment to the.,proposed urgency ordinance.could be made, deleting "a non-residential" structure and putting the burden of connecting to other than a sewer line upon the Superintendent of Sewers who would determine by findings submitted in writing that.conditions would be satisfactory to connect to a cesspool or septic tank for such time and subject to such conditions'as the Superintendent,of Sewers might impose. The Superintendent of Sewers could impose among the conditions a bond as security of the.fact that within a certain length of time the connection would be made to the sewer. The City Attorney drafted the amendment ofLLthe proposed ordinance concerning Section l (2), to read'as follows: "If the structure is any other type of structure and the ' `Superintendent of Sewers finds in writing that the ex- pected effluent and soil conditions are such that adequate drainage would be accomplished and no pollution or harm would result, the structure may be connected to a'cesspool or septic tank for such length of time and.subject to such conditions as the Superintendent of Sewers may impose." 1-44 1 1 CITY HALL AZUSA.CALIFORNIA MONDAY, OCTOBER 7, 1963 Page 11 Councilman Cooney offered the following Ardinance as Ord amended. Since Council policy has been to grant permission only to local organizations orthoseorganizations with local mem- bers, it was the consensus of Council that tf,e Club submit a list of local members in Azusa by next meeting. An Agreement for.th.e purchase by the City of. tax delinquent property was presented to Council requesting approval of. the agreement and its execution in order to proceed with the purchase of, the following.parcels: one parcel for street purposes (Lot 84,'Tract 20971), and one parcel for public building purposes (Lot 4, Block 33, Map of Azusa, known as 424 E.
