Ramon Garcia. Council examined photographs and Building
Inspector's report of this property. The City Administra-
tor Dresented t::e Affidavit of Publication. cf Notice of
Hearing and reported that service by certified mail had
not been made as the Notice of Public Hearing mailed to
the owner had been returned. Council agreed that abate-
ment must be completed within sixty (60) days from date
of tine receipt of this notice by the legal owner.

The City Council of the City of Azusa does resolve
as follows:
WHEREAS, a special election was held and conducted
within the following described territory designated as
"Southerly Annexation District No. 52" on the 28th day of
April, 1964, for the purpose of submitting to the voters
within said territory a proposition for the annexation of
said territory to the City of Azusa, and
WHEREAS, notice cf said election was duly given and
said election was duly held and conducted in all respects,as
required by law, and

WHEREAS, notice of said election was duly and legally
given, voting precincts were properly established, election
officers were appointed and election supplies furnished, and
in all respects.said election was Yield and conducted and the
votes cast thereat received and canvassed, and the returns
thereof made, determined and declared in the time, form and
manner as required by the Elections Code and the Government
Code of the State of California providing for and regulating
such elections, and
WHEREAS, the City Council of said City met at the
Council Chamber thereof on Monday, May 4, 1964, to canvass the
returns of said election; and whereas the said City Council
finds, as a.result of said canvass, that the number of votes
cast, and other.matters'required by law, to be as hereinafter
stated;
NOW, THEREFORE, BE IT RESOLVED,
DECLARED as follows:
AND
That said special election was held and conducted
on April 28, 1964, as aforesaid, and that the votes cast
thereat were duly and regularly canvassed in the time, man-
ner and form provided by law.
That the total number of votes bast at said special
election was 19.
That at said special election there was submitted
to the voters of said territory a proposition reading as
follows:
"Shall 'Southerly Annexation District No. 52°
be annexed to the City of Azusa2"
That for the purpose of said special election there
was only one voting precinct; that the number of votes given
at such precinct arid, consequently, in the entire territory,
for and against said measure wasas follows:

That said proposition is hereby declared to have

record to be entered upon the minutes of this meeting of the
City Council stating the proposition submitted at said special
election, the number of votes cast, and the number of votes
cast for and against annexation in said special election, as
required by Section 35133 of the Government Code of the State
of California

INHABITED TERRITORY, DESIGNATED AS "SOUTHERLY ANNEXATION
DISTRICT NO. 52".
Moved by Councilman McLees, seconded by Councilman Jackson

The hour of 7:30 P.M. being the time set for a public
hearing on a recommended zone change from C=2 to R -3a (2000)
on property between Azusa and Donna Beth Avenues and from
Gladstone Street approximately 935 feet southerly with -the
exception of two corner parcels, petitioned by Volk -McLain
Communities, Inc., the hearing was declared opened by
the Mayor.
The Deputy City Clerk presented the Affidavit of Proof of
Publication of Notice of Public Hearing, together with an
analysis and recommendation for said zone change by the
Planning Commission, and further stated that no written
communications were received.
Kenneth Volk, 2208 West Beverly Blvd.,.Los Angeles 57,
appeared before Council explaining the type of units pro-
posed for construction and stating that such a development
offers good use of the property.
John H. Ott,.5740 North Oak Avenue, Temple City, owner of
the property, appeared before Council, stating that at the
time of annexation the zone ,C-2 permitted development of
'apartment construction; however, this has since been.changed
by the City, and the owners at this time are very much in

Council and spoke in favor of the recommended zone change
to R -3a.
Moved by Councilman Jackson, seconded by Councilman Rubio
that the recommendation of the Planning Commission be denied
and the property remain as an R-1 zone. Motion failed'to
carry by the following vote of Council:

The hour of 8:00 P.M. being the time set for the Protest
Hearing on Northerly Annexation District No. 60, as re-
vised, being that area north of Sierra Madre Avenue and
east of San Gabriel Canyon Road, petitioned by Messrs.
Calvert, Conforti,.Oki, Blair, Running and Hudson, the
hearing was declared opened by..the Mayor.
The Deputy City Clerk presented the Affidavits of Proof
' of Publication of the notice of the Protest Hearing and
stated that a notice of protest had been received from
Fred Running, 729 West 2nd Street, Azusa.
Mr. Running appeared before Council, stating his protest
to the splitting of his property and requesting Council
consideration for -extending a water line to his property

until the next meeting for further study. Motion died for
lack of a'second.

Tom Oki, 633 North Alameda Avenue, appeared before Council,
as spokesman for Mr. Calvert and Mr. Conforti. He stated
that they have requested this annexation in order to
con-struct a convalescent home and desire Council consideration
regarding the 30 -foot strip by 240 feet of land to be
dedicated along Sierra Madre Avenue.
After further discussion, -it was moved by Councilman Cooney,
seconded by Councilman Rubio and unanimously carried that
the City install the water line up to the property line and
waive the sewer connection fee of $3.00 per front foot; the
owners to be responsible for the water meter charge, and
construction of curb and gutter on Sierra Madre Avenue and
along San Gabriel Canyon Road; also, the owners to dedicate
a 92 -foot strip of property for Hilltop Drive; and dedicate
30 feet on Sierra Madre Avenue, and also pay cost of
annexing to County Sanitation District No. 22.

specifications, authorizing execution of the Reimbursement
Agreement,, and recommending that the project be advertised
by the City Clerk and bids accepted.
