The City Council of the City of Azusa.met in regular session
at the above time and place.'
Mayor Memmesheimer called the meeting to order and led in Call to
the salute to the flag. Order
Invocation was given.by Rev..Stephen F. Ross of the Azusa Invocation
Friends Church.
Present at Roll Call:. Councilmen: Rubio, Cooney, Jackson Roll Call

Also Present: City:Administrator Foxworthy, City
Attorney Williams, City Engineer

With no corrections, the Minutes of the meeting of April 6,

Denied
The Deputy City Clerk presented the Affidavit of Proof of
Publication of Notice of the Public Hearing, and stated
that no written communications were received other than
the written.appeal from Mr. Pearson.
Mr. George A. Pearson, 610 North Pasadena Avenue, appeared
before Council, stating that.he has waited for years for
this zoning and that a fire in the present dwelling has
made it uninhabitable.. The present plans were for twenty (20)
units with two bedrooms and two baths.
Mr. Ken Crist, 592 East 6th Street, appeared before Council
in opposition to the requested zone change, and presented a
petition with approximately 20 names in protest to the pro-
posed zoning. Mr. Krist stated that this was primarily
single-family residential area and pointed out, that the
Eisner plan called for a buffer zone between residential
and apartment development, and recommended a lesser density
of development.
Councilman McLees wished to be disqualified from voting on
the issue by reason of being a co -applicant and owner of
property in proximity of requested zone change.
Mayor Memmesheimer also disqualified himself as being an
owner of property within 300 ft. of requested zoning.
After discussion, it.was moved by Councilman Jackson',
seconded by Councilman Cooney and, with no objections,
'ordered unanimously carried that the hearing be closed.
Moved by Councilman Jackson, seconded by Councilman Rubio
that the request for zone change be denied. Motion carried
by the following vote of Council:

Moved by Councilman Cooney that the property under considera-
tion, except the southerly 75' on 6th Street, be zoned RGA.
Motion died for lack of a second.
The hour of.7:30 P.M..being the time also set for a Public
Hearing on the appeal to the denial by the Planning Commis-
sion, Resolution No. 429, of a Precise Plan of Design for
'remodeling and new structure at an existing Service Station
at the southwest corner of Foothill Blvd. and San Gabriel
Avenue, requested by Socony Mobil Cil Co., the hearing was
declared opened by the Mayor.
The Deputy City Clerk presented the Affidavit of Proof of
Publication of Notice of this Public Hearing, together with
an analysis from the Planning Commission. No written com-
munications were received.
r Robert A. Buchanan, 612 South Flower St., Los Angeles,attorney
GAJ for the applicant, appeared before Council. He stated that
the owner of the service station had purchased additional
property in order to expand the facilities of the station
Ca and construct a garage.. He further stated that the require -
CC ments as established in the Precise Plan No. P-162 by the
Engineering Department and requested by the Planning Com-
mission would cost an excessive amount and.would shorten
the driveway entrance to the service station; also, the
improvements would be of no advantage to the station.
Mr. Merle R. Allison,'1372 Fircroft, Covina, operator of
the Service Station, appeared before Council, stating that
the improvements to the station would be an asset to the
downtown area,.since the station is open 20 out of 24 hours
and the entire area will be well -lighted.
Moved by Councilman Cooney, seconded by Councilman Jackson
and unanimously carried that the hearing be continued, and
the matter be turned over to the City Engineer, City Adminis-
trator and City Attorney to meet with the client to work out
an agreeable solution.and report to Council.. The principals
arranged to meet on Wednesday, May 27th, at 10:00 A.M., in
the City Administrator's office.
A communication was received from the Personnel Board

The Treasurer's Financial Statement.for the month ending
April 30, 1964, was presented to Council, showing Total
Bank Balances as of that date, $773,199.50.
Moved by Councilman Cooney, seconded by Councilman Jackson
and unanimously carried that the financial statement be
filed.
' Requests for exception from Ordinance No. 790, regarding
the moratorium on issuance of building permits on deep
lots, were received from the following:
Richard and Iola Harrell, re: 366•West,3rd St.
Virgil Hayes, re: 902 West First St. .
Rimer Realty for George Luther, re: 325 West 2nd St.
Although Council believed that the previously 5 cases which
had been brought to their attention at the meeting of
May 4th were the only ones pending, it was'the general
t*" opinion that Council should determine if there is a
reasonable doubt as to the urgency.
Councilman Cooney moved that the letters be filed. Motion
Cn died for lack of a second.
Councilman McLees stated that, as there are persons in the
audience concerned with these cases, Council should give
them an opportunity'to be heard.
Councilman Rubio inquired as to when the Committee appointed
to study the 'deep lot" Ordinance would take action regarding
this matter.
Planning Director Eaton stated that the Committee should be
formed by Wednesday, May 20th.
Mrs. Harrell appeared before Council and stated that it was
her understanding that the plans were submitted to the
Planning Department before the Ordinance was passed.

Following further discussion, it was moved by Councilman
Cooney, seconded by Councilman Rubio and unanimously carried
that these three cases, and any others forthcoming, be
referred to the Deep Lot Ordinance Committee,with a report
submitted to Council at the next meeting on June 1st.
An invitation was received from the Planning Commission to S.G.V.P.C.
attend the East San Gabriel Valley Planning Committee Dinner mtg. on
Meeting on May 28th at 6:30 P.M., at the Azusa Lanes, with 5/28
Azusa as the host city. Azusa Lanes
Mayor Memmesheimer reminded Council Members to make -their
reservations for this meeting.

Notice was given that the Planning Commission by Resolution
No. 455 (Case Z-107) recommended a zone change from R -lb to
C-2 on property owned by Florence Hamilton and located at
the northeast corner of Rockvale and Alosta Avenues, which
is part of Annexation District No. 54 and now annexed to
the City; public hearing before Council to be set for
Jure 1, 1964.
' Notice was also given that the Planning Commission, by
Resolution No. 446 (Case C-39) granted a conditional Use
Permit to permit the construction of A new church auditorium
seating approximately 400 -persons for religious services,
at the northwest corner of First Street and Pasadena Avenue,
as petitioned by the Azusa Church of Christ.
Notice was further given that the Planning Commission, by
Resolution No. 447, recommended a proposed amendment to the
Zoning Chapter of the Municipal Code to provide for a 20 -ft.
rear yard requirement in the "R -GA" (Garden Apartment) Zone;
hearing before Council to be set for the meeting of June 1,

Notice was further given that the Planning Commission, by Res.#448
Resolution No. 448, approved the Tentative Map of Subdivision apprvg.
Tract No. 29022, subject to 19 conditions, regarding -170 -unit Tent.Map

A communication was received from the Board of Trustees of
the Azusa Public Library advising Council that the terms
of office for Mr. E. -C. Snyder, Chairman of the Board, and
for Mrs. Lydia Wheelehan, will expire June 30th, and recom-
mending the reappointment of both members for another term
of three years.
Mayor Memmesheimer stated that, in addition to the Library
appointments, that there would be two appointments to be
made to the Personnel Board and one appointment to the
Planning Commission.
Moved by Councilman Jackson, seconded by Councilman McLees
and unanimously carried that the appointments to the Library
Board be tabled to the June 1st meeting.

Following further discussion, it was moved by Councilman Pers.Bd.&
Cooney, seconded by Councilman Rubio and unanimously carried P.C.appts.
that any appointments to the Personnel Board and Planning withheld
Commission be withheld until the June 15th meeting. until 6/15
The Mayor requested the City Administrator to present a
report at the June 1st meeting regarding the attendance
of members of the various Boards and Commissions, and
requested Councilmen to submit suggestions for new appointees
prior to dates.set for making any appointments.
Mr. Salvador Luevanos, 341 South Enid Avenue, appeared before
Council to request the City Attorney to make a finding on
the procedure relative to.an appeal by a member of the
Planning Commission.
City Attorney Williams stated that in order to appeal, a
person who is adversely affected or has an interest in the
proceedings should disqualify himself from any participation
in the Planning Commission action.

A Resolution was prepared authorizing the renewal of the
General Services Agreement with the County of Los Angeles,

' A Communication was received from City Engineer Sandwick
regarding a progress report of the attempts to arrange a
meeting with Mr. Fred Heyden and U. S. Corps of Engineers
with reference to.a.road easement, as requested at the
meeting of May 4th.
The City Engineer'stated that on May 13; 1964, he met with
Mr. Fred Heyden to discuss the construction of the road
along the west side of the San Gabriel River. Due to the
current "Operation Desert Strike", it will not be possible
h to arrange a meeting with the Corps of Engineers for at
least four to six weeks. The City Engineer further stated
that a meeting with the'Corps of Engineers would be arranged
.., as soon as possible.

Works Brusnahan requesting Council to set a public hearing
for 7:30 P.M. on June 1, 1964 for the abatement of weeds and
fire hazards on.lots within the City of Azusa.

A communication was received from the City Engineer requesting Chas.Landers
approval to employ the Charles Landers Co., 248 Foothill Blvd., to estab.

unanimously carried that the firm of Charles Landers Company,
248 Foothill Blvd., Azusa, be employed to establish a basic
bench mark level circuit for 120 bench marks; the fee not to
exceed $1200.00, as recommended by the City Engineer.
A request was received from the City Engineer for Ralph Fitz-
simmons and George Jenkins to attend a course in the
"Fundamentals of Traffic Engineering" at U.C.L.A., from
June 15 to June 19, 1964, with a total cost of approximately
$110, other than salaries; with an advance of $70 for
registration fees; the cost to be reimbursed with Gas Tax
Engineering Funds.
Moved by Councilman McLees, seconded by Councilman Cooney
and unanimously carried that the request be approved.
A communication was received from the City of Duarte,
requesting that a Resolution be adopted urging the Board
of Supervisors to reinstate funds in 1964-65 County Budget
for development of the Santa Fe Dam Regional Park.
Following discussion, it was moved by Councilman Rubio,
seconded by Councilman McLees that a Resolution be prepared_
similar to one adopted by the City of Duarte urging the
Los Angeles County Board of Supervisors to reinstate funds
in the Park and Recreation Budget to continue the develop-
ment of the Santa Fe Dam Regional Park. Motion carried by
the following vote of Council:

requesting.that Council proclaim the week of May 24th through
May 30th, 1964 as "Burglary Prevention Week". 1.
A request was received from Mrs. I. Leo Ashkenas, 112 Sunset
Avenue, of the Veterans of Foreign Wars of the Unites States,
that Council proclaim the days, May 22nd and May 23rd, 1964,
as "Buddy Poppy Days".

and unanimously carried that the Mayor be authorized to
sign the above listed proclamations.
A communication was received from Mrs. Evelyn L. Davey,
Chairman for the American Little League of Azusa, requesting
an exempt fee permit to hold a dance on June 6, 1964, at
the V.F.W. Hall, 250 East First Street, and the proceeds
to be used for equipment for Little League baseball.

A communication was.received from Howard Breece for alleged
damage to automobile registered in his name -from a tree
falling on the automobile when parked in front of his home,
518 Dalton Avenue, on March 22, 1964; with approximate
damage amounting to $139.

A communication was received from the United Pacific Insurance
Group, San Bernardino, California, California, requesting the
Mayor and City Clerk to execute a general release of all
Claims in the amount of $714.10 for damages to street light
standard at 730 West Foothill Blvd., as a result.of an
automobile accident on January 1, 1964, by their insured
David Ray Casey, File No. 47-47219.

A communication was received from Fred C. Jones, Chairman Re:"Bed-
of the Revenue and Taxation Committee, League of California Tax"' Ord.
Cities, Los Angeles.County Division, requesting Council
position regarding a suggested "bed -tax" ordinance.

unanimously carried that we advise the League that since the
City of Azusa has so few hotels and motels, it would not be
financially advantageous to adoptthistax ordinance at
this time.

Mayor Memmesheimer stated that a number of people were
interested in the various actions taken by'Council regarding
the proposed quarry site and adjoining areas with Rodeffer
Industries, Inc.
Discussion was held on the possible changing of zones, the
revoking or altering of variances and use permits, and the
status of contracts.
Councilman Jackson moved -that the Planning'Commission start
hearings on rescinding.the variances. Motion died for lack
of a second.
After discussion, it was moved by Councilman Cooney, seconded
by Councilman McLees and unanimously carried that the City .
Attorney study all phases entered into by the City and
Rodeffer Industries, Ine.,.and submit a report to Council_
