HomeMy WebLinkAboutD-2 Staff Report - 2020 Public Hearing Refuse Rate AdjustmentPUBLIC HEARING D-2 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MANNY ROBLEDO, DIRECTOR OF UTILITIES DATE: JULY 20, 2020 SUBJECT: REFUSE AND ORGANICS RATE ADJUSTMENT PUBLIC HEARING BACKGROUND: The City has an Exclusive Franchise Agreement with Arakelian Enterprises Inc. DBA Athens Services (Franchised Hauler) for refuse collection and recycling services. Each year refuse rates are adjusted to reflect changes in the cost of doing business and pass through changes in disposal costs. In addition, the Franchised Hauler may request a rate adjustment due to extraordinary increases in operating costs arising out of new laws, mandates or other conditions affecting costs (e.g., landfill cost, insurance). On July 16, 2018, the City Council approved organics rate structure for commercial customers to recycle food waste in compliance with AB 1826 (Mandatory Commercial Organics Recycling), and this organics rate structure will also be adjusted pursuant to the proposed action. Additionally, pursuant to Proposition 218 fee approval rules, all refuse and organics rate adjustments must be approved at a public hearing with a notice to the public 45 days in advance of the hearing. The recommended actions consist of opening the Public Hearing, receiving public testimony, closing the Public Hearing, and adopting Resolution No. 2020-C40 approving the annual refuse and organics rate effective July 1, 2020 and approving an automatic adjustment without further public hearing subject to a maximum of 5% annually beginning July 1, 2020 to July 1, 2024. If approved, the refuse rates for residential customers would increase $0.71 per month (2.57%) for residential customers, which would still be 5% lower than the average of Azusa’s neighboring cities; and commercial rates would increase $0.53 per month (0.38%) for small commercial customers. The Public Hearing Notice was mailed on May 27, 2020 and advertised in the local newspaper on July 13, 2020. RECOMMENDATION: Staff recommends the City Council take the following actions: 1) Open the Public Hearing, receive public testimony, and close the Public Hearing; 2)Adopt Resolution No. 2020-C40 approving the annual refuse collection and organic waste recycling rate adjustment for Arakelian Enterprises Inc. DBA Athens Services effective retroactive to July 1, 2020; and APPROVED CITY COUNCIL 7/20/2020 2020 Public Hearing Refuse and Organics Rate Adjustment July 20, 2020 Page 2 3) Approve future automatic adjustment subject to a maximum of 5% annually beginning July 1, 2020, and each July 1 thereafter, for a five-year period through and including adjustments effective July 1, 2024. ANALYSIS: Refuse from residential and commercial properties in the City is collected by Athens Services and taken to Athens’ Material Recovery Facility (MRF) where most recyclable materials are separated and recycled. The residual non-recyclable waste is then transported by Athens to Mid-Valley Landfill in the City of Rialto. The green organic materials are delivered directly to Recycled Wood Products in the City of Pomona for composting and mulching. Refuse rates are comprised of four components: (1) processing/disposal fees; (2) service fees; (3) franchise fees; and (4) AB 939 fees. Residential rates include a fifth component: customer service charges (since the City bills residential customers directly). Each year refuse rates are adjusted to reflect changes in the cost of doing business, as measured by fluctuations in the Consumer Price Index (CPI), published by the U.S. Department of Labor, Bureau of Labor Statistics, for the Los Angeles/Riverside/Orange County and to account for increases in disposal costs. The CPI from January 2019 to January 2020 is 3.08%. Pursuant to the City’s franchise agreement with Athens, disposal costs are passed through to the ratepayers automatically. The cost of disposal at the Mid-Valley Landfill where the City’s waste is disposed of is anticipated to increase from $32.49 to $33.46 per ton. There was also a significant increase in green waste processing and diversion services fee beginning November 2019 from $47.00 to $48.41 per ton due to the implementation of AB 1594 (Green Waste Diversion Bill). Per AB 1594, green materials used as Alternative Daily Cover (ADC) will no longer be considered as diversion as of January 1, 2020. Jurisdictions must have plans/programs to divert green materials from landfill or risk not being able to meet its AB 939 diversion goal. Due to new business developments requiring more refuse capacity and service level, 4 and 6 cubic yard commercial bin services have been added to the rate schedule. These rates will be approved upon request by the business requiring additional capacity. Three businesses are currently subscribed to this service. Athens Services also offers additional optional services to its customers upon request. These rates were added to the regular rates in Table 1 to ensure transparency to customers utilizing these services. The proposed FY 2020/2021 rates are summarized below in Table 1. Organic waste includes food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food waste. Effective January 1, 2019, all commercial customers that generate 4 cubic yards or more of commercial solid waste per week shall arrange for organic waste recycling services. In addition, effective January 1, 2020, all commercial customers that generate 2 or more cubic yards of solid waste per week will be required to arrange for organic waste recycling services if CalRecycle determines that statewide disposal of organic waste in 2020 has not been reduced by 50% of 2014 levels. In order to comply with AB 1826, the City Council authorized Athens Services to charge a monthly rate in implementing a commercial organic recycling program for businesses that are required to implement an organic recycling program and are adjusted by CPI percentage change. The proposed FY 2020/2021 rates are summarized below in Table 2. If approved, beginning July 1, 2020, and each July 1 thereafter for a five-year period, through and including adjustments effective on or after July 1, 2024, the trash rates may be adjusted annually, without a further public hearing subject to a maximum of 5% annually. Trash service customers will be notified 30 days before the effective date of an automatic rate adjustment. When refuse and organic recycling rate adjustment exceed 5% in any single year, another public hearing will be held to consider that proposed rate adjustment. In no event may an automatic adjustment exceed the City’s cost of providing trash services. FISCAL IMPACT: The fiscal impact of the proposed rate adjustment will vary by customer class: single family residential rates will increase 2.57% or $0.71 per month; multi-family bin rates will increase 0.73% or $0.17 per month; and commercial rates will decrease/increase -0.12% to 3.15% depending on the service level. Prepared by: Reviewed and Approved: Liza Sagun Sergio Gonzalez Environmental Programs Specialist City Manager Reviewed and Approved: Manny Robledo Director of Utilities Attachments: 1) Resolution No. 2020-C40 2) Public Hearing Notice 3) Draft Refuse & Organics Rate Adjustment Fiscal Year 2020-21 4) Refuse Rate Survey 1 RESOLUTION NO. 2020-C40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING THE TWENTY-FOURTH AMENDMENT TO THE EXCLUSIVE FRANCHISE AGREEMENT WITH ARAKELIAN ENTERPRISES TO AMEND THE REFUSE RATES AND THE MONTHLY ORGANIC RECYCLING FEES EFFECTIVE RETROCATIVE TO JULY 1, 2020 THROUGH JUNE 30, 2021 WHEREAS, on October 2, 2000, the City Council of the City of Azusa, approved an Exclusive Franchise Agreement with Arakelian Enterprises, Incorporated DBA Athens Services (Contractor), for refuse collection and recycling services ("Original Agreement"); and WHEREAS, Section 5 of the Original Agreement requires that the refuse rates be modified annually to account for the cost of living changes, disposal costs, and other adjustments due to extraordinary increases in operating costs ("Adjustments") on July 1 of each year; and WHEREAS, refuse rate adjustments have been calculated pursuant to the terms and conditions of the Original Agreement; WHEREAS, Assembly Bill 1826 (Chesbro, 2014) was signed into law and requires businesses to recycle their organic waste on and after April 1, 2016, depending on the amount they generate each week; WHEREAS, AB 1826 defines “organic waste” as food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food waste; and WHEREAS, the City is required by state law to implement an organic waste recycling program for businesses that are required by AB 1826 to implement organic waste recycling; WHEREAS, in order to implement the Organics Recycling Program in the City, Athens Services, the City’s franchised trash hauler, is offering organic recycling services to businesses that are required to implement an organic recycling program under AB 1826, and may charge businesses that utilize such services for the cost of those services; WHEREAS, without the adoption of rates, Athens is unable to charge for and provide this service as it’s not currently included in the Original Agreement between Athens and the City; WHEREAS, per AB 1826, effective January 1, 2019, all commercial customers that generate 4 or more cubic yards of solid waste per week will be required to arrange for organic waste recycling services; WHEREAS, per AB 1826, effective January 1, 2020, all commercial customers that generate 2 or more cubic yards of solid waste per week will be required to arrange for organic waste recycling services if CalRecycle determines that statewide disposal of organic waste in 2020 has not been reduced by 50% of 2014 levels; ATTACHMENT 1 2 WHEREAS, the Monthly Organic Waste Recycling Rates attached herewith will be adopted and applicable only to businesses required to comply with AB 1826 effective January 1, 2019 and 2020; WHEREAS, the City is proposing automatic rate adjustment beginning July 1, 2021, and each July 1 thereafter for a five-year period, through and including adjustments effective on or after July 1, 2024, the trash rates may be adjusted annually, without a further public hearing, by an amount not to exceed the total of a CPI increase for inflation plus any increase in Tipping Fees, subject to a maximum of 5% annually. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Azusa, California, does find and declare that: SECTION 1: Adoption of 24th Amendment. The attached 24th Amendment to the Exclusive Franchise Agreement between the City of Azusa and Arakelian Enterprises, Inc. for Refuse Collection, Recycling and Disposal Services (Exhibit A) is hereby approved. The rate schedule adopted as part of the twenty-fourth Amendment shall supersede any rate schedule previously adopted. SECTION 2: Adoption of the Monthly Organic Waste Recycling Rates. The Monthly Organic Waste Recycling Rate Schedule (Exhibit B) is approved and applicable to businesses required under AB 1826 threshold. SECTION 3: Effective Date. This Resolution shall become effective upon its adoption. SECTION 4: Adoption of Automatic Rate Adjustment. If approved, beginning July 1, 2021, and each July 1 thereafter for a five-year period, through and including adjustments effective on or after July 1, 2024, the trash rates may be adjusted annually, without a further public hearing, by an amount not to exceed the total of a CPI increase for inflation plus any increase in Tipping Fees, subject to a maximum of 5% annually. Effective January 1, 2019, all commercial customers (businesses and multi-family dwellings with 5 units or more) that generate 4 cubic yards or more of commercial solid waste per week shall arrange for organic waste recycling services. In order to implement the Organics Recycling Program in the City, Athens Services, the City’s franchised trash hauler, is offering organic recycling services to businesses that are required to implement an organic recycling program under AB 1826, and may charge businesses that utilize such services for the cost of those services. Foothill Boulevard in Azusa which may be reviewed by any interested person.The request for the proposed rate adjustment is based upon the City’s existing trash franchise agreement with Athens Services, the City’s franchised trash hauler.Proceeds from this rate adjustment will be used to pay Athens Services for trash collection,recycling and disposal services. Recycling services include processing all waste collected in Azusa through a material recovery facility where all glass, plastics, metal and paper products are removed and recycled. Other portions of the trash rate include City fees, such as 10% franchise fee,AB 939 or Recycling fee and billing/administration fee.These fees are used by the City to administer the trash hauling contract, comply with the California Integrated Waste Management Act of 1989, and cover customer service and billing costs. Mandatory Organic Waste Recycling Program for Commercial Customers In October 2014, Governor Brown signed AB 1826, requiring businesses to recycle their organic waste on and after April 1, 2016, depending on the amount they generate each week. Organic waste includes food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food waste. Effective January 1, 2019, all commercial customers (businesses and multi-family dwellings with 5 units or more)that generate 4 cubic yards or more of commercial solid waste per week shall arrange for organic waste recycling services. In order to implement the Organics Recycling Program in the City, Athens Services, the City’s franchised trash hauler, is offering organic recycling services to businesses that are required to implement an organic recycling program under AB 1826, and may charge businesses that utilize such services for the cost of those services. Upon conclusion of the hearing, the City Council will consider, and may adopt, the proposed trash and organic waste recycling rates, if written protests against the proposed rates and fee schedule are not presented by a majority of owners of the identified parcels upon which the rates and fee schedule are proposed to be imposed. If adopted, the rates shall become effective July 1, 2020. As noted in more detail below, the rates may also be automatically adjusted annually beginning July 1, 2021 and each July 1 thereafter, for a five-year period through and including adjustments effective July 1, 2024. Because the City anticipates future rate adjustments in the cost of providing trash services that Athens Services will charge pursuant to the franchise agreement, the City is also proposing to annually pass through to trash service customers automatic adjustments based upon two factors: (i)for inflation, based upon the annual percentage increase in the Consumer Price Index, all Urban Consumers,for Los Angeles/Riverside/Orange County, as determined by the United States Department of Labor Statistics, or its successor ("CPI") and (ii) increases in solid waste disposal/recycling rates to comply with statutory solid waste diversion mandates (“Tipping Fees”). These adjustments will impact the trash rates.If approved, beginning July 1, 2021, and each July 1 thereafter for a five-year period, through and including adjustments effective on or after July 1, 2024, the trash rates may be adjusted annually, without a further public hearing,by an amount not to exceed the total of a CPI increase for inflation plus any increase in Tipping Fees, subject to a maximum of 5% annually.If a rate adjustment should exceed this amount in any single year, another public hearing will be held to consider that proposed rate adjustment.In no event may an automatic adjustment exceed the City’s cost of providing trash services. Any record owner of a parcel upon which the trash rates are proposed may submit a written protest to the proposed rate adjustments. To oppose the proposed rate adjustments,you must submit a written protest, even if you plan to attend the public hearing.Your written protest to the proposed trash and organic waste recycling rates must be received (not postmarked) by the City Clerk, City of Azusa, 213 East Foothill Boulevard, Azusa, CA 91702, prior to the close of the public hearing on June 15, 2020. Written protests may also be submitted at the public hearing so long as they are received prior to the conclusion of the public hearing.Oral, telephonic and e-mail protests will not be accepted. You must sign the protest and include: 1) your name, 2) your street address,and 3) your trash service account number.
