HomeMy WebLinkAboutE-17 Staff Report - Crossing Guards Extension 2020CONSENT ITEM E-17 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: MIKE BERTELSEN, CHIEF OF POLICE VIA: SERGIO GONZALEZ, CITY MANAGER DATE: JULY 20, 2020 SUBJECT: APPROVE EXECUTION OF AGREEMENT FOR THE CITY OF AZUSA TO EXTEND CONTRACT SERVICES FOR CROSSING GUARDS WITH ALL CITY MANAGEMENT SERVICES (ACMS) BACKGROUND: The City of Azusa and All City Management Services (ACMS) entered into a Professional Services Agreement on July 1, 2017 whereby ACMS agreed to continue to provide Crossing Guard Services to the City. The term of the Agreement expired on June 30, 2020 with an option for the City to renew the agreement for two (2) successive one (1) year terms. The City and ACMS had a mutual understanding that the City would present the renewal of the Agreement for continued services to the City Council. The City and ACMS now desire to renew the Agreement for a one (1) ye ar term from July 1, 2020 to June 30, 2021. RECOMMENDATION: Staff recommends the City Council take the following actions: 1.Authorize the extension of the Professional Services Agreement for a one (1) year term from July 1, 2020 to June 30, 2021. ANALYSIS: This is a proposal for the extension of the contract outsourcing crossing guards for the City of Azusa. Azusa staffs 15 crossing guard posts at different intersections throughout the City. Most of the posts safeguard crossing of school-aged children in the mornings and afternoons. One post is dedicated to ensuring the safety of senior citizens as they walk to and from the Azusa Senior Center. APPROVED CITY COUNCIL 7/20/2020 Crossing Guards with All City Management Services July 20, 2020 Page 2 2 The company providing this service is All City Management Services (ACMS), a private company that contracts crossing guard service for numerous municipalities and school districts throughout California, including Covina, Baldwin Park and La Puente. They currently employ over 3,500 school crossing guards and supervisors. ACMS is the only company in the Los Angeles area whose sole function is crossing guard service. AZPD staff has interacted with ACMS personnel and management over a decade and have been impressed with their professionalism and commitment to community safety. ACMS crossing guards receive four hours of initial training and ongoing training as needed. They wear provided uniforms and carry stop signs. They are required to provide the utmost in customer service and safety in their crossing guard roles. AZPD's Traffic Unit monitors pedestrian and vehicle traffic flow in areas where crossing guards are assigned and ensure that Azusa's pedestrian safety needs are met. Prior to 2008 the Police Department formally managed and funded the school crossing guard program. Funding the program included salary, workers compensation and Medicare payments for 12 budgeted positions. Managing a crossing guard program is a costly endeavor. In addition to the budgeted costs, there are unseen costs such as the time needed to recruit, supervise, schedule and staff vacancies. ACMS provides all of the functions of managing the crossing guard program and also maintains a $1,000,000.00 liability insurance policy and Worker’s Compensation insurance. The City’s adopted budget for 2020/2021 includes funds to contract school crossing guard services. ACMS provided Azusa a bid for services which includes the hourly rate responsibility for all contract functions including screening, recruitment, staffing, training, equipment, Workers Compensation, payroll and supervision. ACMS maintains alternate guards and a system to ensure adequate response and immediate back-up for any Crossing Guard absent from duty for any reason. Section 3.3 of the Agreement with ACMS (Fees and Payments), states in part that in the event that the enactment of any local, state or Federal ordinance, statute, law, code, order, decree, judgment, rule or regulation causes an increase of more than 15% in the minimum wage that ACMS must pay its non-exempt employees during the term of the agreement, the City does agree to negotiate in good faith with ACMS an increase in the amount of compensation payable to ACMS under this Agreement during the remainder of the term. The Agreement has been approved as to form by the City Attorney. FISCAL IMPACT In the approved budget for F/Y 20/21, staff has budgeted $210,000 for ACMS services under Crossing Guard Services Account #10203330006497.
