JOHNSON, DIRECTOR OF ADMINISTRATIVE SERVICES DATE: JULY 20, 2020 SUBJECT: ADOPTION OF A RESULOTION TO ADD EXHIBIT A TO THE PART-TIME TERMS AND CONDITIONS OF EMPLOYMENT TO CLARIFY SALARY AND BENEFITS FOR POLICE OFFICER RESERVES BACKGROUND: On June 16, 2014, the Terms and Conditions of Employment for Part-time Employees were adopted by City Council via Resolution No. 14-C35. On March 7, 2019 City Council rescinded Resolution No. 14-C35 and the Part-Time Terms and Conditions via Resolution No. 2016-C21. Resolution No. 2016-C21 put into place a Sick Leave plan for Part-time employees in compliance with the Healthy Workplaces, Healthy Families Act of 2014 (AB1522). On November 4, 2019, City Council adopted the updated Terms and Conditions for Part- time employees outlining how the City manages part-time employment and benefits offered. The recommended action requests adoption of a resolution to add an Exhibit A to the Part-Time Employees Terms and Conditions of Employment. RECOMMENDATION: Staff recommends the City Council take the following action: 1) Adopt the attached Resolution No. 2020-C43 approving Exhibit A to be added the Part-time Terms and Conditions of Employment effective July 20, 2020. ANALYSIS: Throughout the years, the terms and conditions of employment for part-time non-classified employees have been amended. On November 4, 2019, City Council approved the most recent terms and conditions which provided an update to the 2014 edition ensuring compliance with Federal and State laws. There are a few items that pertain to our part-time Police Officer Reserve employees that were not included in this update. In order to ensure the handling of these items is continued in a consistent manner the attached Exhibit A to the Part-Time Terms and Conditions of Employment will include the following: APPROVED CITY COUNCIL 7/20/2020 Update Part-time Terms and Conditions July 20, 2020 Page 2 •The Police Officer Reserve Level I salary range 6101R shall be tied to Step 1 of the Police Officer salary range 6101. The Police Officer Reserve Level I performs the same duties as the Police Officer and therefore the hourly rate shall be equivalent. •The Police Officer Reserve Level II salary range 6184R shall be tied to Step 1 of the Police Officer Trainee salary range 6184. The Police Officer Reserve Level II performs the same duties as the Police Officer Trainee and therefore the hourly rate shall be equivalent. •The Police Sergeant Reserve salary range 7175 shall be tied to Step 1 of the Police Sergeant salary range 3416. The Police Sergeant Reserve performs the same duties as the Police Sergeant and therefore the hourly rate shall be equivalent. •Since Police Officer Reserves and Police Sergeant Reserves are required to wear the same uniform as Police Officers the department provides them with a reimbursement of $250 per year uniform allowance. Effective July 20, 2020, the uniform allowance for Police Officer Reserve and Police Sergeant Reserve will be paid the first pay period in November by the City. The uniform allowance shall not be subject to income tax withholding. Formalizing the recommended provisions solidifies what’s been administered with the Part-time Police Officer Reserve workforce over the years, and further demonstrates continued appreciation and goodwill with part-time employees who consistently contribute to key City operations. FISCAL IMPACT: There is no impact to the Fiscal Year 2020/21 budget as Reserves are currently receiving these benefit, and the recommended action is to ensure these provisions are clarified in the terms and conditions of employment. The City Council further resolves that this resolution supersedes any prior resolutions pertaining to Part-time Terms and Conditions of Employment. Police Officer Reserve and Police Sergeant Reserve Retirement Any part-time non-classified employee who works in excess of one thousand (1,000) hours in the fiscal year and who qualifies as defined by the California Public Employees’ Retirement System (CalPERS) shall be enrolled in the CalPERS retirement system. Part-time employees who become members of CalPERS prior to January 1, 2013, shall be considered to be “Classic” members in accordance with CalPERS regulations. Effective July 20, 2020, Classic employees shall individually pay a total of 9%, of “compensation earnable” as defined in Government Code section 20636, representing the member employee’s contribution to the CalPERS. In accordance with the Public Employees’ Pension Reform Act (PEPRA), part-time employees hired on or after January 1, 2013, who have not been a prior CalPERS member or have had a six (6) month break in service from employment with a CalPERS employer, are considered to be new CalPERS members; such part-time employees will contribute one-half of the normal contribution rate, currently 6.75% of base salary to CalPERS.
