Mayor Memmesheimer called the meeting to order and led in the salute to the flag. Invocation was given by Mr. Robert T. Nutting of the First 'Baptist Church. Present at Roll Call: Councilmen: Rubio, Cooney, McLees, Memmesheimer Absent: Councilmen: Jackson Also Present: City J,ngineer Sandwick, City Adminis- trator Foxworthy, Superintendent of Light & Water Smith,.City Clerk Miller With no corrections, the Minutes of the meeting of June 15, 1964 were approved as submitted. W It was announced that bids were opened in the office of the City Clerk, at 10:00 a.m. on Monday, July 201 1964 on the purchase of asphaltic surfacing. The City 'Clerk presented the Affidavit of Proof.of Publication of Notice Inviting Bids and stated that bids were received from Associated Asphalts Industrial Asphalt and Warren South West. A communication from the Superintendent of Public Works requested that the award of the bid be delayed in order to provide time for a more careful evaluation of all factors involved, since there was a difference between the cost of furnXshing equipment and ,the charges for pick up of material. : Moved_by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that action to award the bid for asphaltic material be delayed to the next meeting, at which time a copy of the bid break down be made available to Council. City -Attorney Williams entered the meeting at 7:40 p.m. .The hour of 7:30 p.m. being the time set for a second public hearing on the recommendation by the Planning Commission, by Resolution No. 435 (Case Z-105), for a change of zone from "R -3c" to °C-2", on DrM fB+'fy at the northwest corner of Paramount Street and Azusa Avenue, with a frontage of 165 feet cn ?aramount Street and 174 feet -on Azusa Avenue, as petitioned by Warren C. Lefebvre, Operation Manager, Harker-Degelopment Corp., the hearing was opened by the Mayor.• The City Clerk presented.the Affidavit of Proof of Publica- tion of the Notice of this Public Hearing, and.stated that no communications were received in connection therewith. A Public Hearing on the recommendation from the Planning Commission was held before the City Council on'Monday, June 11 '1964; at which time a motion to approve the recommendation failed to carry, Those appearing in favor of.the.zcne change were:. Mr. Warren C. Lefebvre, 10600 Katella, Anaheim, representing the Harker Development Corp., who submitted a petition with seventeen signatures of.surrounding property owners in favor of the zone change; also appearing in favor were Albert J. Downard, 1142 North Sunset Avenue; Vern Bullock, 1017 Palm Drive; and W. B. Schumacker, 229 South Azusa Avenue.. Moved by Councilman Cooney,'seconded by Councilman McLees and unanimously carried that -the recommendation of the Personnel Board and the heads of the Police and Fire Depart- ments be accepted and that the transfer of Alvin 0. Wilson from the Police Department to the•Fire Department with Fireman classification, at Step 30 be approved. A communication was•received from the Personnel Board regarding Re:Police a proposed amendment to the Civil Service Rules and.Regulations Officer pertaining to the scheduling•of Police Officer vacations. Vacations Following discussion, it was Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried that the matter be referred to the Mayor's special committee on policy for a report. A communication was received froathe Personnel Board recom- mending the adoption of a proposed resolution amending the Rules and Regulations pertaining to disability for class- ified full-time employees injured while on duty. Following discussion, it was Moved by Councilman Cooney;. seconded by Councilman McLees and unanimously carried that the suggested..amendment be. 'referred to the Committee on Council Policy, and that the City Attorney furnish the Committee an opinion regarding the proposed resolution and the suggested, Statement of Physical Condition form. The Treasurer's Financial�$tatement for the month ending June 30, 1964, was presented to Council, showing Total Bank Balances as of that date,•$1,082,4o4,27 Moved by Councilman McLee4, seconded by Councilman Cooney and unanimously carried that'the financial statement be filed. Re:Disabili Classified employees Treas,Stmt. n 1 CITY HALL AZUSA, CALIFORNIA r MONDAY, JULY 203, 1964 Notice was received that the Planning Commission, by Resolution No. 462 (Case V-99), granted a Variance to Joe S. Rivera to permit a side yard of 4' 7' and a rear yard of 15' in connection with a second house to be relocated at rear of 162 North Dalton Avenue. Notice was also received that the Planning Commission, by Resolution No. 463 (Case C-42) granted a Conditional Use Permit to William 0. Keefer to allow an increase from 14 to 28 children to'be cared for at an existing Home for Children at 706 East Foothill Blvd. Page 3 P.C.Res. # 462. Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried approving the recbmmendation of the Planning Commission to appoint Ralph Fitziaimmons to fill the position as temporary secretary to the Planning Commission at $75 per month. ' Communications concerning Rodeffer Industries Inc., tabled from the June 15, 1964 meeting, were submitted for consider- ation. Moved by Mayor Memmesheimer, seconded by Councilman Rubio that the items remain tabled until the next Council meeting. Motion failed to carry by -the following vote of Council: AYES: Councilmen: Rubiot Memmesheimer NOES: Councilmen: Cooney, McLees ABSENT: Councilmen: Jackson The item remained tabled. A communication was presented from the Azusa City Employees Federal Credit Union requesting consideration and approval of a repayment agreement for employee loans to assist in clearing a terminating employee's debt by deducting from . the paycheck. Moved by Councilman Cooney, seconded by Councilman Rubio. and unanimously carried that the request Eby the Azusa City Employees Federal Credit Union to use the repayment agree- ment be approved and that the Accounting Department be authorized to honor this repayment agreement. An Ordinance was presented amending the Municipal Code, Section 9208.70 relating to residential development on .deep lots. Councilman McLees offered for second reading the following Ordinance entitled: Rodeffer Inc Inc . , retrain tabled ACEFCU req. for repaymnt. Agrmnt. Ord 4813 amend MC 9208.70 Notice was further received that the Planning Commission,by P.C.Res. Resolution No. 465 (Case Z-113) has initiated a public hearing # 465 on an amendment to the Zoning Chapter of the Municipal Code hrg.on m to rezone various parks, schools, and other governmental C -F zone W facilities and properties, to "C -F" (Community Facilities) Zone. AYES: Councilmen: Rubio, Cooney, McLees; Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: Jackson and numbered Resolution No. 4694. 194 1 CITY HALL AZUSAs CALIFORNIA MONDAY,;JULY 20, 1964 The City Attorney presented a letter which he had prepared addressed to the Azusa Unified, School District offering the sum of $7,525. in exchange for a grant of easement for street purposes, free of any liens or encumbrances, in connection with the realignment of the intersection at Fifth Street and Cerritos Avenue and if Council would -approve, the letter would be forwarded to the school district. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the Mayor be authorized to sign such a letter and the letter be forwarded to the Azusa Unified School District. (The letter was signed -by Mayor Memmesheimer and handed to Dr. Nelson Price, who was in the audience, who stated that the school board would 'be meeting on the following evening, June 21, 1964.) The monthly reports for the month of June, 1964.. from Departments, Boards and Commissions were submitted to Council. Moved by Councilman McLees,.seconded by Councilman Cooney and unanimously carried that the reports be filed. A communication was received from the Chief of Police requesting authorization to attend the 716t.Annual Conference of the International Association of Chiefs of Police at Louisville, Kentucky, on October 24th to 29th, 1964. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that request be gran+.ed and that reimbursement be made for mileage and registration, plus actual expenses at the conference. 'A request was presented from the City Administrator for permission to attend the 50th Annual Conference of the Inter- national City Managers Association, in Chicago, Illinois, September 27 to October l,. 1964. The City Administrator presented a communication and report from the State Division of Highways regarding an investi- gation of traffic conditions at the intersection of Foothill Blvd. and Alosta Ave.s indicating a proposed change in .traffic signals with the installation of an overhead sign, with completion date by December, 1964. The City Administrator reported on a request, from the July 6, 1964 meeting, regarding a permit for the Azusa Church of the Nazarene for the relocation of a building from Church property in Monrovia to Church property in Azusa. Following discussion of requirements set forth by the Building Inspector and agreed upon by Mr. George Goode, a trustee of the Church, it was Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried to approve the request for the relocation of the building subject to compliance with all �.: conditions of the Building Department, with submission of CSD a Faithful Performance Bond in the amount of $3,542.00 07 prior to obtaining the permit. r� The City Administrator informed Council that the problem, reported by Mr. Rodger A. Schwind, 1326 Soldano Drive, regarding a hazardous condition adjacent to his property in the vicinity of the Irrigating Canal and Gum Grove at the meeting of July 6, 1964, has been solved to the satisfaction of Mr. Schwind. The City Administrator reported on the complaint signed by nineteen people regarding the speeding cars coming oLt of a parking lot at Azusa Manor into Azusa Lane; that the City Administrator, Superintendent of Puhlic Works and Chief of Police had inspected the property, that the management of the apartments had agreed to take care of removing part of the block wall and install a bumper, and that a stop sign would be erected. A request was received -from David C. Watters, 158 North Pasadena Avenue, for permission to retain a carport which was erected without a Building Permit. Mr. Watters was advised that a permit was not required for the type of structure he planned to erect; that after it was com- pleted, the Building Inspector informed him that a permit could not be issued and that the structure must be removed.
