HomeMy WebLinkAboutE-11 Staff Report - Historic Resource Group PSA CONSENT ITEM E-11 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MATT MARQUEZ, ECONOMIC AND COMMUNITY DEVELOPMENT DIRECTOR DATE: AUGUST 17, 2020 SUBJECT: REQUEST TO AMEND PROFESSIONAL SERVICES AGREEMENT WITH HISTORIC RESOURCE GROUP TO CONDUCT THE CITY'S HISTORIC CONTEXT STATEMENT AND CITYWIDE HISTORIC SURVEY UPDATE AS IT RELATES TO THE CITY'S HISTORIC PRESERVATION PROGRAM BACKGROUND: The City of Azusa has a rich history that evolved from its founding date in 1887 and incorporated on December 29, 1898. The City has approximately 120 years of history which has been memorialized and celebrated. The City’s Historic Preservation Program started with the adoption of the Historic Property Survey List and Chapter 55 of the Azusa Municipal Code. On November 16, 2000, the City Council adopted Ordinance No. 00-012. This Ordinance established Chapter 55 – Historic Preservation Code Section of the Azusa Municipal Code. This Chapter and the corresponding Cultural and Historic Preservation Commission it created was done so to protect, appreciate, and preserve the cultural and historic resources of the City. By doing so, a partnership would be established between the Commission, other governmental agencies, property owners/residents, the business sector, and the community at large to retain and protect those cultural and historic resources which will preserve and enhance the community. On October 7, 2019, the City Council approved Professional Service Agreement with Historic Resources Group to conduct the City’s Historic Context Statement and Citywide Historic Survey Update. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1)Approve the Professional Services Agreement First Amendment with Historic Resources Group to conduct the Historic Context Statement and Historic Survey Update to extend the contract term date to December 2021; and APPROVED CITY COUNCIL 8/17/2020 PSA First Amendment Historic Resource Group – Historic Context Statement & Historic Survey Update August 17, 2020 Page 2 of 2 2) Authorize the City Manager to prepare and execute the agreements, in a form acceptable to the City Attorney, on behalf of the City. ANALYSIS: Due to the state and local State of Emergency resulting from the threat of Novel Coronavirus (COVID- 19), Governor Newsom issued several Executive Orders that impacted the project’s timeline. The project is currently back on track and is moving forward. Therefore, the contract needs to be extended in order to complete the project. FISCAL IMPACT: The Historical Resources Group contract amount of $89,900 was approved by Council on October 7, 2019, and it was included in the FY2019-20 approved budgeted in under the Professional Services Account 1035611000-6399. $14,927 of services was paid in FY2019-20, and the balance of $74,975 will be included as a budget carryforward item in FY2021. Therefore, the contract extension has no fiscal impact. This Agreement is made and entered into this 17th day of August, 2020 by and between the City of Azusa, a municipal corporation organized under the laws of the State of California with its principal place of business at 213 East Foothill Boulevard, Azusa, California 91702 (“City”) and Historic Resources Group, a California Limited Liability Company with its principal place of business at 12 S. Fair Oaks Avenue, Suite 200, Pasadena, CA 91105 (“Consultant”). City and Consultant are sometimes individually referred to herein as “Party” and collectively as “Parties.” 2.RECITALS. 2.1 Agreement. The Parties entered into that certain Agreement for the Historic Context Statement and Citywide Survey Update dated October 7, 2019 3.AMENDMENT. Section 3.1.2 is hereby amended to read as follows: 3.1.2 Scope of Services and Term. “3.1.2 Term. The term of this Agreement shall be from November 2019 to December 2021, unless earlier terminated as provided herein. Consultant shall complete the Services within the term of this Agreement, and shall meet any other established schedules and deadlines. The Parties may, by mutual written consent, extend the term of this Agreement if necessary to complete the Services.” 4.REMAINING PROVISIONS OF AGREEMENT. Except as otherwise specifically set forth in this First Amendment, the remaning provisions of the Agreement shall remain in full force and effect.
