The City Council of the City of Azusa met in adjourned session
at the above time and place.
Mayor Memmesheimer called the meeting to order. Call to
Order
Present at Roll Call: Councilmen: Rubio, Cooney, Jackson Roll Call
McLees, Memmesheimer
Also Present: City Administrator Foxworthy, City
Clerk Miller
The City Clerk announced that bids were opened in the office Award Bids
of the City Clerk at 10:00 A.M. on Friday, August 21, 19641 Cerritos
on the construction of roadway pavement and base in Cerritos Ave.,from
Avenue, from First Street to Little Dalton Wash. Present at 1st to Ltle.
bid opening were City Engineer Sandwick, City Administrator Dalton Wash
Foxworthy and City Clerk Miller. The City Clerk presented J.N.Haley
the Affidavit of Proof of Publication of Notice Inviting Bids Contractor
and stated that the following bids were received:

It was recommended by the City Engineer that the low bid of
,Jasper N. Haley Contractor for "Alternate A" be accepted and
a contract be entered into for construction of the project.
Following discussion, it was moved by Councilman McLees,
seconded by Councilman Jackson and unanimously carried that
the recommendation of the City Engineer be accepted for the
"Alternate A" low bid of $29,421.32 submitted by Jasper N.
Haley Contractor and the City enter into a contract with
Jasper N. Haley Contractor for the construction of the road-
way project, and that the bid bonds be returned to the unsuc-
cessful bidders.
A Resolution was presented establishing the amount of money Res -#4721
to be raised by taxes for the fiscal year commencing July 1, Money to

City Clerk Miller read in full the following Resolution 1964-65
entitled:

Moved by Councilman McLees, seconded by Councilman Jackson
that the Resolution be adopted. The Resolution passed and
adopted by the following vote of Council:

A Resolution was presented fixing the tax rate for 1964-65
at $1.45 per $100 of assessed valuation and setting forth
the Tax Districts to be included.
Councilman Jackson offered the following Resolution entitled:

Notice was received from the Department of Alcoholic Beverage ABC Notice
Control of an application for transfer, person to person of B&B Bar
On -Sale Beer License by Barbara J. & William N. Shears (B & B 940 W.
Bar, 940 West Foothill Blvd.). Foothill.
Moved by Councilman Jackson, seconded by Councilman Cooney and
unanimously carried that the notice be filed.
A communication was received from the State of California
Department of Alcoholic Beverage Control with a Certificate
of Decision overruling the protest pursuant to a hearing
held on August 7, 1964 regarding issuance of an off -sale
beer and wine license to Carmen E. and Louis M. Luna and
Anastacio V. and Lucy M. Ureno, 309 Soldano Avenue.
It was noted that application for a variance to do business
at this location has been made, since the business has been
closed for the past eight months.
Moved by Councilman Jackson, seconded by Councilman Cooney
and unanimously carried that the communication be filed.

A communication was received from the Independent Cities of Indpndt.
Los Angeles County inviting Council to attend the Fourth Cities of
Annual Seminar of the Independent Cities at the Riviera Hotel L.A.Cnty.

Moved by Councilman Jackson, seconded by Councilman McLees
and unanimously carried that the communication be filed.
A communication was received from the Automobile'Club of Auth.Back-
Southern California announcing the "Back -to -School" Safety to -School
Campaign during the month of September and inviting the Safety
cooperation of the Azusa Police Department in displaying a Campaign
4 by 15 inch rear bumper strip, with slogan "School's Open -
Be Extra Alert".
Mayor Memmesheimer requested that all City vehicles, including
departments and employees cars, as well as Police cars be.
authorized to display the bumper stickers during the month of
September. He further instructed the City Administrator to
request the various City Departments to use the bumper stickers
and requested a letter written to the City Employees asking
their cooperation on a voluntary basis. Mayor Memmesheimer
stated that 750.stickers have been requested, and that he
will contact the school and PTA's.
Moved by Councilman Rubio, seconded by Councilman Cooney and
unanimously carried that the City participate in the "Back -
to -School" Safety Campaign.

City Adminstrator Foxworthy presented a memorandum regarding Re:rate
the rate reduction with reduced rates requested from Southern redctn.
California Edison Company and pertaining to the agreement So.Cal.
resolved by Edison Co. and the City of Colton. I Edison Co.
In answer to a question by Mayor Memmesheimer, City Admini-
strator Foxworthy stated the matter had not been discussed
with the City Attorney as the City Attorney has been on
vacation.
Mayor Memmesheimer stated that the report should be reviewed
by the City Attorney.
Councilman McLees stated that, although he does not disagree
with the Mayor's statement, certain unsavory publicity was
given to the newspapers and requested permission to read into
the Council Minutes the following prepared statement:
"This matter of theEdison rate discussion has now reachedthe
point where I consider it advisable for this Council to com-
pletely remove any responsibility or thought of affecting a
decision as to action from the hands of our Administrator.
"My records, and facts gained in support of them, indicate
that this Council, after being involved in the matter of rate
adjustments for quite some time without our knowledge, gave
Mr. Foxworthy authority to attend subsequent discussion
meetings believing that he would bring back to our Council
all of the facts and in an unprejudiced manner.
"The few reports which have come to us now appear to be some-
what slanted and, from personal discussions which I have had
with representatives of Riverside and Anaheim, it would appear
that we have been asked to follow the 'politically inspired'
wishes of two or possibly three city administrators. It
seems very, very strange to me that about three weeks ago
Mr. Foxworthy told me if the decision were his to make, that
he would recommend acceptance of the 2% adjustment - - yet
today he indicates that he feels most bitter because we have
been forced to enter into what he refers to as long, drawn out,
and needless negotiations. He also refers to his own 'lengthy
negotiations' with Mr. Drury as being the sole reason for
Azusa's participation in this rate reduction. Better informed
sources tell me that, as a resale city, any gains made by
Riverside and Anaheim in this matter of rate adjustments would
have automatically been awarded to all of the Resale Cities
involved - and therefore to Azusa.
"I'm very curious to know how Mr. Foxworthy and his associates
in this matter, after confessing no knowledge of rate matters
at our last meeting, how then can he justify such bold state-
ments with regard to what he calls proper rebates, such as
have just appeared in one of the local papers. Such unauthorized
releases to the news media seems to me to be placing this
Council in a rather embarassing position with old friends, and
I repeat, that it appears to be the selfish thinking of a very
few people at the Administrative level of each city and without
the sanction of any of the governing bodies.
"I believe that the Edison officials have tried to be fair in
this matter of rate adjustments, that they have acted in good
faith with all of the Cities involved, commensurate only with
good business practices and the accepted principles of free
enterprise.

"Let us assume, if we may, that'the electdd officials of
Riverside and Anaheim may have had very good reason for their
votes (5 to 2 in one ease and unanimous in the other) to
accept the Edison proposal. Our responsibility as Councilmen
for Azusa is to do what we think is best for the people of
Azusa. We did not pledge ourselves to giving our city adverse
publicity, nor did we pledge ourselves to write nasty letters
to Edison upon accepting their terms.
"If this Council feels that we should accept the new Edison
rate proposal, then I suggest that we do so graciously, with
a smile, and as continuing friends, rather than with an
abusive letter of acceptance, the subsequent bad public
relations, and as ingrates."
Upon request, City Administrator Foxworthy read the article
under discussion which appeared in the San Gabriel Valley
Tribune on Monday, August 24, 1964.
City Administrator Foxworthy stated that a summary of the
data was given at -the last Council meeting, and that the
interview was given and the statements as given were
reported by the press.
Mr. William C. Drury, Vice President of Southern California
Edison Company, 601 West 5th St., Los Angeles, was granted
permission to address Council on the subject.
Mr. Drury stated that there had been a problem as to how to
determine rates for Azusa, and the mechanics of the problem
were to be worked out. However, Edison is now ready to
offer a discount of 2% on purchases of electricity by the
'City.
Moved by Councilman Cooney, seconded by Councilman McLees and
unanimously carried that the City Attorney be requested to
review the matter and submit his thinking on the subject.

Mayor Memmesheimer stated that he had been contacted by Re: street
Mr. Rupert and Mr. McCutcheon regarding the partial barricade barricade
on Calera Avenue at Hollyvale and the hazard of the narrow (Calera Ave)
intersection.
City Administrator Foxworthy stated the Regional Planning
Commission would take action within a week on the proposed
dedication of the street.
Mayor Memmesheimer requested the City Administrator and City
Engineer to contact the Rupert's and the McCutcheon's to
endeavor to work out a solution to the existing problem.
Councilman Rubio stated that he had been contacted regarding
a hazardous intersection at Third Street and Pasadena Avenue
and the need for a stop sign regulating north and south
bound traffic.
Councilman Cooney requested that the intersection of Pasadena
'at Eleventh Street be checked for necessity of a stop sign
regulating north and south bound traffic.
Moved by Councilman Cooney, seconded by Councilman Jackson and
unanimously carried that the request for a stop sign regulating
traffic north and south at the intersections of 3rd Street at
Pasadena, and 11th Street at Pasadena be referred to the Chief
of Police and the City Engineer for survey check.
