Invocation was given by Pastor T. A. Nickum of Azusa Invocation Seventh Day Adventist Church. Present at Roll Call: Councilmen: Rubio, Cooney, Jackson, Roll Call McLees, Memmesheimer Absent: Councilmen: None Also Present: City Administrator Foxworthy, Supt. of Light & Water Smith, Assistant City Engineer Lindsey, City Clerk Miller There being no corrections, the minutes of the Regular Apprve. Meeting of ,July 6, 1964 and the Adjourned Meeting of Minutes of August 25, 1964 were approved as written. 7/6/64 & 8/25/64 The hour of 7:30 p.m. being the time set for a Public Pub.Hrg. Hearing on an amendment to the Zoning Chapter of the change of Municipal Code recommended by Planning Commission Reso- zone to lution No. 467 (Case Z-113) rezoning certain parks, C -F zone schools and governmental facilities from such zones parks, :twit "Rla", Rlb" "Rlclt� "R—.2n� "R30" "Pit,, "L.-2", Schools, 3" 1C-, "M-1" and AM -2" to the "C -F'.' (Community Facili- govtt. ties) zone, the Mayor declared the hearing opened. facilities The Affidavit of Proof of Publication of Notice of Public Hearing was presented, and Council was advised that no written communications,were received. There being no one in the audience wishing to speak either in favor or in opposition to.the zone change, It was Moved by Councilman Jackson, seconded by Councilman McLees and unanimously carried that the hearing be closed. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried to approve the recom- mendation of the Planning Commission for the change of zone and instruct the City Attorney to prepare the necessary ordinance. The City Attorney entered and was seated at 7:40 p.m. City Atty. seated The City Clerk informed Council that he had received the "Back to "Back to School Safety Stickers" and also read a letter School" received from the Azusa Unified School P.T.A. Council Safety Stickel indicating their desire to cooperate in the safety cam- paign and requesting 50 of the stickers for their use. Mayor Memmesheimer asked the City Administrator to provide the City vehicles with the bumper stickers. The City Clerk stated that the bumper stickers would be provided to the Azusa City Employees Association and to organizations and other individuals wishing them. A communication was received from the Guadalupe Society Req, for requestingg permission to hold a "Jamaica" at the Parish "Jamaica" Hall, at 4th.St. and Dalton Avenue, from 6 p.m, to Parish Hall 10 p.m. on Sunday, September 13, 1964. 9/13/64 Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried to grant permission as requested. A petition signed by ten (10) residents adjacent to the Petition Gladstone Park area was received, requesting that the re: fence or City provide a fence or wall to protect their properties, wall - Gladstone The City Administrator advised Council that he replied Park to a letter addressed to Councilman McLees; dated August 20, 1964, from a Mr, and Mrs. Sheridan Collins, requesting the erection of a fence, and that his reply .. ..was dated.August 28, 1964, the.same date the petition was received. Following discussion, it was Moved by Councilman Jackson, seconded by Councilman Rubio and unanimously carried to refer the problem to the com- mittee, suggested by the Mayor, composed of the City Administrator, Superintendent of Public Works, City Engineer, and Park and Recreation Director, for investi- gation and report at the next meeting. A request for a business license was received from Mae Req. Bus. Harris, 1375 North Caraline Avenue, Pasadena, Por.per- Lic. - mission to operate a spiritual consulting practice in Spiritual the City. United representing the Azusa United Way regarding the annual Way - fund raising drive during the month of October and re- permission questing permission to hang a banner near the intersec- for banner, tion of Azusa Avenue on Foothill Boulevard. October Mr. Allan Johnson, representative for Mr. Price, appeared before Council and stated they would appreciate if the City could install the banner. Moved by Councilman Cooney, seconded by Councilman Jackson and unanimously carried that permission be granted to hang the banner, and that installation and removal be done by City forces, A request was received from Wilshire 011 Company to Req.Rainbow have the Rainbow Angling Club sign removed from the Angling Club northwest corner of Foothill Boulevard and Pasadena Sign removed Avenue. Following discussion, it was Moved by Councilman McLees, seconded by Councilmam,Cooney. and unanimously carried to notify the referee or receiver in Bankruptcy to remove the sign within five (5) days from date of letter, and, It not complied with, that City forces remove the sign and bill the charges to the receiver in Bankruptcy. Moved by Councilman Cooney, seconded by Councilman Jackson and unanimously carried to authorize the Light Department to remove the sign in the event this has not been done within the time allowed. 0 CITY HALL AZUSA, CALIFORNIA TUESDAY, SEPTEMBER 8, 1964 Page.3 A communication was received from Henry,Van Ginkel, 280 Drainage West Cypress St., Covina, regarding a drainage problem Problem on property owned by him which borders on Azusa & San H.Van Ginkel Gabriel Canyon Road, north of Sierra Madre Avenue. Moved by Councilman Cooney, seconded by Councilman Jackson and unanimously carried to refer the problem to the City Engineer for study and report. A report was received from the committee, composed of Report of Councilmen Rubio and Jackson and City Clerk Miller, Com. re: appointed to investigate and recommend the request for SERS membr. ntembership into the State Retirement System for Fire for Fire Chief Chief Marlowe Madison, to be effective as of January 1, Madison 1949. It is the recommendation of the committee that the City Clerk be authorized to instruct the State Employees Retirement System to proceed with the adjust- ment of Chief Madison's account, establishing the January 1, 1949 effective membership date, and requesting •a billing.of the exact amount due the System. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried to accept the recommendation of the committee and the City Clerk be instructed to con- tact the State Employees Retirement System to proceed with the settlement. City Administrator Foxworthy, chairman of the committee Ltr. of including Councilman Jackson and Police Chief Kendrick, Commendation advised Council that the committee has recommended a G. Trujillo letter of commendation from the City Council, to be signed by the Mayor, be written to Detective Trujillo in recognition of his act of bravery during a recent robbery, and that the letter be included in the per- sonnel files, of the Police Department. -and the Personnel Department. Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried that the recommendation of the committee be accepted. Konst, to be located at 636 N. req. con - Azusa Avenue.. sideration Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Jackson and unanimously carried that a letter be written by the Chief of Police to the Department of Alcoholic Beverage Control advising them that a for- mal protest is not being made. However, it is the hope that in their investigation they will take into consideration that there are more than enough establish- ments of this type in this locality, and such a business is not in the best interests of other businesses in the area and should be rejected by reason that it is not in the public welfare; further, that merchants be advised of action taken by Council. The.City Clerk presented a. petition,.containi sixteen (16) signatures, from approximately eleven (l1ij property :owners in the vicinity of the Lee & Daniel Steel Fabri- eating Plant, protesting the noise from the operation not only during the daylight.hours but also at night, and requesting the erection of a suitable wall or some type of'baffle. Following discussion, it was Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried to referthe matter to the City Administrator and City Engineer to contact Lee & Daniel Moved by, Councilman Jackson, seconded by Councilman McLees and unanimously carried to ask Lee & Daniel to make every effort to minimize the noise level and attempt to bring bbout better 'relations with the people living in the area. A communication was received from the San Gabriel and Pomona Valley Youth for Christ., Inc. requesting a con- tinuation of the use of the Civic Auditorium on the first and third Saturday nights of each month, from MO p.m. to 9:00 p.m. Moved by.Councilman Cooney, seconded by Councilman Rubio and unanimously carried directing the City Clerk to write a letter to the Youth for Christ organization advising.them that.the policy 'will continue, permitting the use of the auditorium on a week to week basis, and requesting they keep -in contact with the City Clerk's office advising the name of person to contact In .case of conflicting dates. A Proclamation declaring the. week of Se?tember 13 to 19, 1964,•for the annual observance of 'Constitution Week" was received -with a request for the Mayor to sign. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the.Mayor be authorized to sign the Proclamation; The City Clerk Informed'Councilthat a request had been made by Creative Display Advertising for a re -opening of the hearing from the denial of the appeal for a Variance, the hearing before Council having been held on August 3,, 1964. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried to notify the Creative Display Advertising Company that the hearing has been 'closed and a Resolution adopted accepting the recom- mendation of the Planning Commission, and if they wish to present additional information, they must make application under their name. Notice was made by the Planning Commission for a ' relocation permit, to relocate a 1900 square foot triplex arid.triple garage from 1227 South Bedford St., Los Angeles,,to.820 North San Gabriel Avenue, requested by Keith Porchia, and recommended for approval by the Planning Commission. ..Mr, Keith Porchia, 711 North Soldano Avenue, appeared before Council and stated tkat'inspection by the Los Angeles Building,inspector had' -indicated the house was -.in condition to be moved, and answered further question from Council pertaining to open area and garage space. Councilman Cooney and unanimously carried that the relocation permit be approved subject to the conditions imposed by the Building Inspector and the Planning Commission. Notice was given that the Planning Commission, by P.C.Res.#468 Resolution No. 468 (Case Z-114) has disapproved and Deny zone denied the proposed change of zone from 'R -lc" to "R-30" Change (1200) on property located at 847 West First St., as (E.Meloy) petitioned by Evelyn Meloy. The City Clerk advised Council that an appeal had been received,.but, due to the time element involved requiring publication of the notice, the hearing before Council would be set for the regular meeting of October 5, 1964. Notice was given that the Planning Commission, by P.C.Res.#469 Resolution No. 469 (Case V-100), has granted a Variance Variance grtd, to permit a reduced rear yard of 10 ft. on property (E.D:Hooper) located at 530 North Dalton Avenue, requested by E. D. Hooper. No action was taken by Council on the above notice. A communication was received from the San Gabriel Valley Municipal Water District regarding the construc- tion of reclamation plants at Eaton Wash and at Azusa, and requesting information as to the quantity of water the City will require. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the communication be referred to the City Attorney and City Administrator and that a letter be written prior to September 15, 1964s notifying them that the City at present time has no need to purchase additional water. SGVMun. Water, Dist. re: water needs %lie Agreement between the Southern California Edison Agrmnt. Company and the City of Azusa, titled Contract for Edison Co. Reduction in Electric Rates and .for Settlement of Claims, re: rates having been referred for study to the City Attorney from the meeting of August 25, 1964, was presented for consideration. The City Attorney stated that he had reviewed the agreement, that Edison Company had accepted all changes recommended,by Azusa, Anaheim and Riverside with exception of one,.that Anaheim is accepting the agreement, and recommends .the acceptance of the agreement in its present form as submitted, and authorize the Mayor and City Clerk to execute same. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried to approve the agreement and authorize the execution on behalf of the City by the Mayor and City Clerk. A Resolution was presented amending Exhibit A of ' Resolution No. 4693 pertaining to salary paid to personnel in the Police Department not above the rank of sergeant while assigned to detective duty or to motorcycle duty, and also amending Exhibit C of the same resolution pertaining to the job classification schedule for Civil Engineering Associate, and changing job classifications in the Police and Fire Departments. A communication was presented from City Attorney Williams Settlement regarding the Settlement Documents for the .proposed of Water judgment in the action brought by the City of Long Beach Suit - City and others against the City of Azusa and others with of Long respect to the waters of San Gabriel River. A written Beach, et al report, from Leeds, Hill and Jewett, Inc., consulting engineers, giving a summary of findings with respect to the judgment was presented and discussed by the City Attorney, Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to decline to execute the settlement until these matters raised in the communica- tion by Mr. Raymond A. Hill are either changed or adequately explained. Communications were received from the Chief of Police Appt. to requesting confirmation of the appointment of Arthur P.D. Seymour, Jr, and Berriman Thomas Wiley as Probationary A.Seymour,Jr. Police Officers,, effective September 16, 1964, and B.T.Wiley Dean L. Shomber as Police Reserve Officer, effective as officers. A communication was received from the Police Chief Req, to requesting authorization for Police Officer James Clark attend and Sergeant Larry Trujillo to attend the Weaponless Weaponless Defense'Inatitute, at Los Angeles State College on Defense October 3, 10, 17 and 24, 1964, with reimbursement of Inst. tuition in the amount of $25.00 upon completion of the 10/3,10,17 course. & 2 Moved by Councilman Jackson, seconded by Councilman Rubio and unanimously carried authorizing Sergeant Trujillo and Police Officer Clark to attend the Institute As requested. A communication from the Regional.Planning Commission, L.A.County County of Los Angeles, pertaining to Amendment No. 575, Master Plan Master Plan of Highways, was presented to Council with of Highways a recommendation from the City Administrator and City re:Amendment Engineer.to approve, having been referred for study No. 575 and recommendation from the meeting of August 17, 1964.. Following discussion of the possible location of the Huntington Beach Freeway and of the proposed widening of Vernon Avenue, it was Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to adopt Amendment No. 575, Master Plan of Highways, submitted by the County of Los Angeles, with reservations regarding the location of the proposed Huntington Beach Freeway as shown on the City of Azusa Master Plan of Streets and Highways, and that there is, at this time, under consideration the changing of Vernon Avenue classification from a secondary highway to a local street, and, further advising the Los Angeles County Regional Planning Commission of the exceptions. A communication from the League of California Cities 9th Calif. regarding the co-sponsorship with the State Compensation Cities Insurance Fund of the Ninth California Cities Employee Employees Safety Contest, which began on.July 1, 1964 and will Safety end June 30, 1965, was received by Council requesting Contest that the City enter the contest. 1964-65 Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried to concur with the program and forward the entry postcard. A communication was received from the.Superintendent Removal of ' of Light and Water regarding the request by Rodeffer pumping Industries, Inc, for removal of the abandoned pumping station near plant building located south of Sierra Madre Avenue Sierra Madre and west of San Gabriel Avenue. (Rodeffer) Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to.authorize a title search. Notification was made by the Light and Water Depart- St.Lighting ment that the installation of the street lighting completed on has been completed on San Gabriel Avenue from 12th San Gabriel Street to Sierra Madre Avenue. Req: re: Rupert, 6262 Calera.Avenue, requesting that the City Calera Ave. perform certain work on their property in connection (Rupert) with the opening of Calera Avenue. Mr. Kenneth McCutcheon, 6256 Calera Avenue, appeared before Council and stated that he had planned to attend the meeting of the Board of Supervisors on this day to protest action of the County to dedicate a portion of Calera Avenue, but had arrived too late for the hearing.` 2'he City Administrator advised Council that the Board of Supervisors had taken action to start proceedings for the dedication and recording of the east portion of Calera Avenue. Moved by Councilman'Jackson, seconded by Councilman McLees and unanimously carried that the communication be filed.. A communication was received from R. C. Mendelson, Req.change Manager of Edgewood Shopping Center, requesting per- 'in wall mission to construct an offset in the wall for storage Edgewood of trash bins on property.facing.•the Russell Street Shopping side, from Azusa Avenue to Pasadena Avenue. Center Mr. Howard Mendelson appeared before Council with a sketch of the proposed wall change and explained the need for the additional clearance along the alley. Moved by Councilman Jackson, seconded by Councilman McLees,and unanimously carried to table the mattes until the meeting of October 5, 1964, in order that ' completed plans be submitted indicating the design and proposed construction, together with a request for an encroachment permit. The City Administrator requested authorization for Agrmt. & the City Engineer, or City Clerk, to enter into an Purch.Order agreement with United Appraisal Company, Santa Ana United and Norwalk, for fair market appraisals on eight (8) Appraisal Co. parcels of property on Vernon Avenue, north of re:property Foothill. Boulevard, and authority to issue a purchase Vernon Ave. order in the amount of $900. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the request be granted. Notice was given that the Southern Counties Gas So.Co.Gas Company was planning an inspection trip to their Co. visit pumping station in Blythe about October 22 and 23, 1964, to Blythe 10/22-23 The City Administrator requested permission for a City Adm. vacation during the week ending October 10, 19640 and vacation. suggested that the City Engineer be appointed to act Appt. during his absence. R.Sandwick Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to grant the request and appoint Robert Sandwick, City Engineer, to take the place of the City Administrator at the meeting of October 5, 1964. Night 9/11 Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that officials who wish to attend -would be reimbursed for expenses.
