The ordinance has been drafted to be consistent with a recent federal appeals court decision holding the City of San Diego's curfew ordinance to be unconstitutional. If adopted, this ordinance will not allow a juvenile to remain in any public place or establishment between 10:00 p.m. and sunrise, while making exceptions for juveniles engaged in First Amendment activities. The ordinance also allows somewhat later hours during the summer months and would require a peace officer to attempt to determine whether one of the exceptions applies before citing a juvenile. Furthermore, this ordinance allows the City to impose the following penalties for curfew violations: (1)juvenile -- a fine (not to exceed $1,000) or a requirement to perform City work projects or community service or both; and (2) parent or guardian -- a fine (not to exceed $1,000) or six months imprisonment in the county jail or both.
