RE: ORDINANCE AMENDING THE AZUSA MUNICIPAL CODE CONCERNING
JUVENILE CURFEW AND DAY TIME LOITERING REGULATIONS
Attached for your consideration is an ordinance amending the Azusa Municipal Code
regarding juvenile curfew and truancy regulations. The ordinance has been drafted to be consistent
with a recent federal appeals court decision holding the City of San Diego's curfew ordinance to be
unconstitutional.
If adopted,this ordinance will not allow a juvenile to remain in any public place or
establishment between 10:00 p.m. and sunrise, while making exceptions for juveniles engaged in
First Amendment activities. The ordinance also allows somewhat later hours during the summer
months and would require a peace officer to attempt to determine whether one of the exceptions
applies before citing a juvenile.
Furthermore, this ordinance allows the City to impose the following penalties for
curfew violations: (1)juvenile -- a fine (not to exceed $1,000) or a requirement to perform City
work projects or community service or both; and (2) parent or guardian -- a fine (not to exceed
$1,000) or six months imprisonment in the county jail or both.
