PRELIMINARY BUSINESS • Call to Order • Pledge to the Flag • Invocation - Reverend Richard Wilson of Jerusalem Christian Worship Center. • Roll Call • Ceremonial - A. Presentation to City Council from Azusa Dolfin Swim Team. II. PUBLIC PARTICIPATION (Person/Group shall be allowed to speak without interruption up to five (5) minutes maximum time, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker’s questions or comments, shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes time.) No scheduled persons or groups. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM STAFF/COUNCIL No scheduled speakers. III. SCHEDULED ITEMS: “If you challenge the City’s proposed actions in court, you may be limited to raising those issues that you or someone else raised at the public hearing described in this Agenda or in any written correspondence delivered to the City on or prior to the public hearing.” A PUBLIC HEARING - to adopt a Resolution approving appropriation Amendments for fiscal year 1998-99. Recommendation: Open the Public Hearing; receive testimony, close the Hearing. Waive further reading and adopt Resolution No. 98-C140. B. PUBLIC HEARING - on adoption of a Resolution finding the City to be in conformance with the Congestion Management Program (CMP) and adopting the CMP Local Implementation Report in accordance with the California Government Code Section 65089. Recommendation: Open the Public Hearing; receive testimony, close the Hearing. Waive further reading and adopt Resolution No. 98-C141. IV. CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. A. Approval of Minutes. Recommendation: Approve minutes as written. B. Resolution approving Appropriation Amendments for Fiscal Year 1997-98. Recommendation: Adopt Resolution No. 98-C142. C. Resolution requesting continued assistance from the Department of Interior, National Park Service, Rivers and Trails Program, to complete the San Gabriel Riverfront Planning Effort. Recommendation: Adopt Resolution No. 98-C143. D. Resolution approving Agency-State Agreement to receive Federal Funding for Foothill Boulevard Rehabilitation Project. Recommendation: Adopt Resolution No. 98-C144, approving Program Supplement. E. Letter Agreement for Waste Collection Rates. Recommendation: Approve the Letter Agreement and authorize Mayor to execute same. 08/17/98 PAGE TWO F. Agreement between the City and Azusa Unified School District for Adult School Classes at the Senior Center. Recommendation: Approve the Agreement. G. Human Resources Action Items - Recommendation: Approve Merit Increases and/or regular appointments: O. Bruno, and L. Wofford. New Appointments: L. North, Police Dispatcher, Pending Physical Exam. H. Payment for the Gladstone High, School Resource Officer, 1997-98, school year. Recommendation: Waive formal bidding and approve the expenditure of $12,000 for School Resource Officer services from Covina Police Department. I. Change Order #31 for Police Facility and Alteration Project. Due to high levels of lead contamination discovered in the basement of the south police building, there is a need for new duct work in the entire basement. Recommendation: Approve Change Order #31 in the amount of $119,690. J. Change Order #33 for Police Facility Addition and Alteration Project. This change order is to remove contaminated soil from existing gasoline dispenser area. Recommendation: Approve Change Order #33 in the amount not to exceed $17,881, pending the approval of LaSalle National Bank (LNB). K. Use of City Hall front lawn for 7th Annual Holiday Boutique and request to waive one day $15.00 Business License Fee for vendors. Recommendation: Authorize the use of City Hall front lawn and waive the one day business license fee for craft vendors. L. Two separate resolutions authorizing payment of warrants by the City. Recommendation: Adopt Resolution Nos. 98-C145, and 98-C146. M. Purchase of Ammunition for Police Department Training and Field Duty. Recommendation: Approve the purchase in the budgeted amount of $7,369.66. N. Contract with the Azusa Chamber of Commerce. Recommendation: Approve the Contract and authorize its execution. 08/17/98 PAGE THREE V. CONVENE JOINTLY AS THE CITY COUNCIL AND THE REDEVELOPMENT AGENCY CONSENT CALENDAR (Council/Agency) The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. A. Educational Service Contract w/ROP and AUSD and Purchase and Sale Agreement between City and Agency. The Azusa Unified School District and Regional Occupation Program are ready to proceed with a third new house project with the Redevelopment Agency. The site is located at 616 West 11th Street. The Agency will be purchasing the site from the City of Azusa. Recommendation: Adopt Resolution No. 98-C147, (Council), and 98-R53, (Agency), approving the Purchase and Sale Agreement between the Agency and City, and Adopt Resolution No. 98-R54 (Agency), approving the Educational Services Contract with the East San Gabriel Valley Regional Occupational Program (ROP) and the Azusa Unified School District (AUSD). CITY COUNCIL TO RECESS AND REDEVELOPMENT AGENCY TO CONTINUE. CONVENE AS THE REDEVELOPMENT AGENCY VI. Recommendation: Approve minutes as written. B. Two separate Resolutions authorizing payment of warrants by the Agency. Recommendation: Adopt Resolution Nos. 98-R55 and 98-R56. VII. ORDINANCES/SPECIAL RESOLUTIONS A. Proposed Ordinance amending the West End Specific Plan, modifying the Service Commercial Auto (SC-A) District. Recommendation: Waive further reading and adopt Ordinance No. 98-O12. B. Proposed Urgency Ordinance establishing a moratorium on the standard limiting the maximum height of wall Signs. Recommendation: Waive further reading and adopt Ordinance No. 98-O13. 08/17/98 PAGE FOUR VIII. OTHER BUSINESS/CITY COUNCIL A. MAYOR MADRID Discussion regarding resolutions adopted by the County Board of Supervisors regarding prohibition of outdoor advertising of alcoholic beverages, cigarettes and other tobacco products and adult telephone messages in residential areas. IX. CLOSED SESSION A. REAL PROPERTY NEGOTIATIONS (Gov. Code Sec. 54956.8). Owner: Monrovia Nursery Company Negotiators: Rick Cole, City Manager and Roy Bruckner, Community Development Director Property: Monrovia Nursery Property Site, and, in particular, potential acquisition of (a) public curbs, gutters, sidewalks and streets, (b) public parks, ( c ) public sewers and storm drains, and certain other property interests described more particularly in the Rosedale Development Project Draft EIR, Draft Fiscal Impact Report and Draft Specific Plan documents which are available for review free of charge, in the City’s Community Development Department at City Hall or at the Azusa Library; as well as covenants, conditions and restrictions, recorded against the Monrovia Nursery Property Site for the benefit of the City. Under Negotiation: Consideration of related terms. B. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Gov. Code Sec. 54956.9 (a)): Lim v. City of Long Beach. Request for Amicus Support from the City of Azusa. C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Gov. Code Sec. 54956.9 (a)): Johnson v. City of Azusa, Case No. Los Angeles Superior Court #BC 1924900. D. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (Gov. Code Sec. 54957). City Manager. X. ADJOURNMENT A. Adjourn to Wednesday, August 19, 1998, 6:30 P.M., Civic Auditorium to conduct a Joint meeting with the Planning Commission regarding the Rosedale Project. “In compliance with the Americans with Disabilities Act, if you need special assistance to participate in a city meeting, please contact the City Clerk at 626-812-5229.
