Mayor Memmesheimer called the meeting to order and led Call to in the salute to the flag. Order ' Invocation was given by Rev. Carroll Parker of the Invocation Edgewood Methodist Church. Present at Roll Call: Councilmen: Rubio, Cooney, Jack- son, Mc Lees, Memme- sheimer Also Present: Assistant City Attorney Terzian, City Administrator Foxworthy, City Engineer Sandwick, Superintendent of Light and Water Smith, City Clerk Miller It was suggested by Richard R. Terzian, attorney in the R.R.Terzian law office of Burke, Williams and Sorensen, that he be apptd.as an appointed as Assistant City Attorney as a substitute for Asst.City City Attorney Williams, in order that he may advise Atty. Council until the return of Mr. Williams. Moved by Councilman Mc Lees, seconded by Councilman Jackson and unanimously carried that Mr. Richard R. Terzian be appointed as an Assistant City Attorney to serve in the place of City Attorney Harry Williams, until further action of Council. ' The City Clerk stated that bids were publicly opened Bid Award in the office of the City Clerk .at 10:00 a.m, on Friday, for const. October 30, 1964, for the construction of a concrete vault to vault in the basement of the City Hall. The City Clerk A.J.Pacal presented the Affidavit of Proof of Publication of Notice Inviting Bids, and stated that bids were opened in the presence of the City Administrator, City Engineer and City Clerk. Bids were received from the following: TOTAL BID PRICE A. J. Pacal $45105.50 Continental Contracting, Inc. 65298.50 Harold 0. Pratt, General Contractor 53390.10 Hunter Construction Co. 6,086.10 Richard F. Puck, General Contractor 45317.08 A memo was received from the City Engineer recommending that the City enter into a contract with A. J. Pacal for the construction of the vault in the basement of the City Hall. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the recommendation of the City Engineer be approved and the City enter into a con- tract with A. J. Pacal, low bidder, for the construction of a vault, and that the bid bonds be returned to the unsuccessful bidders. The City Clerk also stated that bids were publicly opened Bid Award in the office of the City Clerk at 10:00 a.m, on Friday, steel pipe October 30, 1964, for the purchase of a supply of steel to Gordon pipe. The City Clerk presented the Affidavit of Proof Supply Co. of Publication of Notice Inviting Bids, and stated that bids were opened in the presence of the City Administra- tor, City Engineer and City Clerk. CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 Bids were received from the following: TOTAL BID PRICE Gordon Supply Company $3,937.76 Grinnel Company 3,956.00 Valley Cities Supply Co. 31994.00 E.S.A. 3,994.16 Howard Supply 4,163.00 A memo was received from the Superintendent of Public Works recommending that the bid be awarded to Gordon Supply Company as lowest responsible bidder. Moved by Councilman Mc Lees, seconded by Councilman Jackson and unanimously carried the recommendation of the Superintendent of Public Works be accepted and the contract be awarded to Gordon Supply Compnay to supply the steel pipe, and that the bid bonds be returned to the unsuccessful bidders. Page 2 The communication from the Azusa Public Library regard- Appt. ing the resignation of Mrs. Esther Martin having been G.Smith to tabled from the meeting of October 5, 1964, was presented Library Bd. to Council. of Trustees Moved by Councilman Jackson, seconded by Councilman Rubio and unanimously carried that the item be raised from the table. Mayor Memmesheimer submitted a recommendation that Mr. Grant Smith be appointed to fill the vacancy. Moved by Councilman Mc Lees, seconded by Councilman Rubio and unanimously carried that the Mayor's recommendation of the appointment of Mr. Grant Smith to fill the vacancy on the Library Board of Trustees, for the unexpired term of Mrs. Esther Martin, and that the City Attorney be instructed to prepare a resolution. A communication was received from the University of Req.for California, Los Angeles, School of Law Library, requesting copy of M.C. a complimentary copy of the Municipal Code. Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the request be approved and the City Clerk authorized to forward a complimentary copy of the Municipal Code. A request was presented from the Seventh-Day Adventist Req.for Church for permission to use Caroling Equipment on the caroling street during the holiday season, commencing November 21st 7th Day and continuing through the evening of December 24th, from Adv.Church 7:00 o'clock to 9:00 o'clock in the evening. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the request be granted. A report was presented from Councilman Jackson regarding Report on the Sister City Program outlining methods of approach to Sister City participate in a people -to -people cultural exchange. The Program Azusa Chamber of Commerce submitted a communication offer- ing assistance and cooperation to stimulate community interest in such a program. CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 Page 3 It was the suggestion of the Mayor that fraternal and service organizations be contacted requesting an answer as to their interest and possible participation, and recommended that Councilmen Jackson and Rubio be appointed as a Committee to study this matter and report to Council with their recommendations. Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried that the Mayor's recommendation be accepted and the Committee be appointed. Notice was received from Reliance Insurance Companies Notice re: concerning receipt of Summons and Complaint, regarding Ins.Claim Superior Court Case No. EAC 2168, claimant Geraldine Denied Kinsey. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the communication be filed. Council was apprised of the verified claim of Arizona Forgays and Shirley W. Harper on behalf of their children, for alleged injuries at the Slauson Plunge on July 16, 1964. Moved by Councilman Mc Lees, seconded by Councilman Jackson and unanimously carried that the claim be denied and re- ferred to the insurance carrier. A communication from Mr. Royal M. Sorensen, of Burke, Cert.of Williams & Sorensen recommending acknowledgement of the Membership receipt of Certificate of Membership in the San Gabriel in S.G.River ' River Spreading Corporation. Spreading Corp Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that receipt of the Certi- ficate of Membership be acknowledged as requested, and that it be filed with the City Treasurer. The City Clerk advised Council of a telephone communi- L.A.Co. cation from Mr. Rothrock, of Regional Planning Commission, Master Plan requesting approval of Amendment No. 575 of the Los Angeles of Sts. & County Master Plan of Streets and Highways, without the Hwys.referred reservations which the City had imposed concerning Vernon for report Avenue and the location of the proposed Huntington Beach Freeway. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the request be referred to the City Engineer and City Administrator for study and report. A communication was received from Mr. Adolph A. Solis Req.for requesting payment of $281.15, which was deducted from reimb.for his share of proceeds from the sale of the house at 582 deduction on East 5th Street, as a service charge for prepayment of pyt. to VA ' contract within two years imposed by the Department of on hse @582 Veterans Affairs. E. 5th St. Following discussion, it was Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that payment in the amount of $281.15 be authorized and that a letter be drafted by the City Attorney in connection with this payment to the effect that this payment is final and that the property be vacated by November 15, 1964, or sooner. Notice was received of the League of California Cities Notice of meeting on Thursday, November 19, 1964, including a tour LCC Mtg of MGM Studios, requiring advance registration prior to 11/19/64 November 16, 1964. Notice was received from Mayor Harry A. Faull, of Pomona, inviting attendance at the Western Air Facilities Confer- ence at the Pomona Fairgrounds on November 14, 1964. The above item was information only. Notice was received from the Alcoholic Beverage Control of an original application for On -Sale Beer by Israel Chavez, with premises at 940 West Foothill Blvd. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to refer to the City Administrator and City Attorney for protest if legal grounds are present regarding the non-conformance of zoning requirements. Foothill Blvd. Notice was also received from the Alcoholic Beverage ABC Notice Control of an original application for On -Sale Beer by On -Sale Beer LeRoy J. Luna and Melborne L. Newland, with premises at @ 200 S. 200 South Irwindale Avenue,for the Yellow Jacket, with Irwindale Ave. approximate completion date of December 15, 1964. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the ABC be informed that, ' as of this date, this would not meet the City Code and, therefore, cannot be granted a business license, that there should be a public hearing on the question of the Variance, and requesting delay of action on this appli- cation.by the ABC until a decision is made following the public hearing. Azusa Ave. The above notice was information. The Quarterly Report of the Azusa Chamber of Commerce was presented. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the report be filed. The matter of the resignation of Police Officer Raymond L. Guardado, effective October 30, 1964, was presented to Council having been deferred from the meeting of October 19, 1964. The City Administrator reported that he had contacted Mr. Guardado regarding his reason for leaving the depart- ment and possible intentions for reinstatement. Following discussion, it was Moved by Councilman Jackson, seconded by Councilman Rubio to accept the resignation of Mr. Raymond Guardado with a letter to him from the Council. Councilman Mc Lees questioned whether there may be some other vacancies in this department and wished to go on record to ascertain why Officer Guardado was quitting. Councilman Rubio stated that he was assured that the resignation was due to illness, but would like to have Mr. Guardado's name be placed on the eligibility list. The Assistant City Attorney was requested to advise on the Rules and Regulations pertaining to placing a name on an eligibility list when it is not so requested. Moved by Councilman Cooney, seconded by Councilman Jack- son and unanimously carried to table this matteruntil later in the evening. The City Administrator advised Council that in the current operating budget an appropriation was set aside for which the City was to engage a qualified person to make a study of the present Police building and the Light and Water Office facilities building to determine if it were feasi- ble to make the quarters adequate, and to make a recom- mendation on this study. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that a committee, composed of ' the City Administrator, City Engineer and Chief of Police, be authorized to select a qualified person to make a study on the best place for a Police building and the procedure recommended. The Assistant City Attorney stated that, in accordance with the Rules and Regulations, a person can be rein- stated upon recommendation of the Department Head. Guardado 1 1 1 CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 Moved by Councilman Jackson, seconded by Councilman Rubio and unanimously carried that the resignation of Police Officer Raymond Guardado be accepted, that a letter of commendation be sent to him from the Council, and that his name be placed on the eligibility list for one year as the Rules and Regulations allow. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried to authorize the Police Chief to fill this vacancy from an eligibility list when established. A communication was received from the Police Chief sub- Resig.of mitting the resignation of Miss Ann Rosario, Steno -Clerk, A.Rosario effective November 8, 1964, and recommending that her Police Dept. name be placed on the eligibility list. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the Police Chief be authorized to fill the vacancy of Stenographer -Clerk. A Resolution was presented approving an Agreement for electrical distribution facilities and energy between the City and Colonial Designs, Inc., 701 West Foothill Blvd. Councilman Rubio offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AGREEMENT FOR ELECTRICAL DISTRIBUTION FACILITIES AND ENERGY BETWEEN THE CITY OF AZUSA AND COLONIAL DESIGNS, INC. Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that further reading be waived. Res.#4745 Agmt.for elec.service @701 W. Councilman McLees offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CERTIFYING THE FACTUAL INFORMATION CONTAINED IN THE ANNUAL REPORT REQUIRED BY SECTIONS 186.1 to 186.7 OF THE STATE OF CALIFORNIA STREETS AND HIGHWAYS CODE. A memo was received from the City Engineer regarding the intersection alignment of Fifth Street and Cerritos Avenue, submitting lans and specifications for approval, the expenditure of $5,975.00 for the right-of-way on the school property, and requesting authorization for the City Clerk to advertise a Notice Inviting Bids. Moved by Councilman Mc Lees, seconded by Councilman Jackson and unanimously carried to approve the plans and specifications as submitted. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to authorize the expenditure of $5975.00 for the right of way on the school property. Moved by Councilman Mc Lees, seconded by Councilman Rubio and unanimously carried to direct the City Clerk to advertise the project and accept bids for construction, bid opening set for December 4, 1964. Approve Plans & Specs for re -alignment 5th & Cerritos 1 1 CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 A communication was received from the City Engineer regarding traffic studies for Sixth Street, from Alameda to Soldano Avenues, conducted by City Engineer, Superintendent of Public Works and Police Chief, and requesting authorization for the installation of "Yield" signs. Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried that the recommendation of the Superintendent of Public Works, Police Chief and City Engineer be accepted and the City Attorney be instructed to prepare an Ordinance authorizing the installation of "Yield' signs in a north -south direction at Sixth and Alameda and Sixth and Soldano, and in an east -west direction at Sixth and Dalton. Req. for Yield signs on Various Intersections A memorandum was received from the City Engineer, with a Speed Limit recommendation from the Superintendent of Public Works, of 35 mph the Police Chief and City Engineer, that the speed limit on Cerritos on Cerritos Avenue, from Arrow Highway to Gladstone Street from Arrow to be set at 35 miles per hour. Gladstone Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried to accept the recommenda- tion and authorize the City Attorney to prepare the necessary Ordinance. A communication was received from the City Engineer re- questing authorization to contact residents of the area bounded by Cerritos Avenue, Gladstone Street, Donna Beth Avenue and Big Dalton Wash, regarding a proposal for annexation to the City. Enclosed with the memo was a copy of the proposed letter and a return postcard to be sent to the 350 county property owners within the area. Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried that the City Engineer and City Administrator be authorized to proceed with contact- ing county residents regarding annexation to the City. A communication was received from the Public Works Department recommending appointment of Carl Hauser, Groundsman in the Park Department, probationary at Step 1, Range 15, effective November 2, 1964. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the appointment of Carl Hauser as Groundsman be confirmed upon satisfactory com- pletion of his physical examination. A Resolution was presented for the abatement of weeds and fire hazards on lots within the City and setting a public hearing for November 16, 1964, at 7:30 p.m. Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, DECLARING WEEDS, RUBBISH AND DIRT UPON PARKWAYS, SIDEWALKS OR PRIVATE PROPERTY IN THE CITY OF AZUSA TO BE A PUBLIC NUISANCE, PURSUANT TO TITLE 4, DIVISION 3, PART 2, CHAPTER 13, ARTICLE 3 (SECTION 39560 TO 39587 INCLUSIVE OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA) Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that further reading be waived. Req.to contact property owners re: proposed annexation Appt. C.Hauser Groundsman 11/2/64 Res.#4749 Weed Abatement 1 CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 Page 9 Moved by Councilman Cooney, seconded by Councilman Rubio that the Ordinance be adopted. Ordinance passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Cooney, Jackson, Mc Lees, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: None and numbered Resolution 4749. An endorsement for a proposed change, due to certain discrepancies being found, amending policy provisions with Intercoast Life Insurance Company was presented. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the Mayor be authorized to sign the endorsement, to become effective November 10, 1964. Amend provisions of Intercoast Life Ins. A communication was received from the County of Los Amend. to Angeles, Chief Administrative Officer requesting execution County -City of an Agreement of Assumption of Liability for the "Hold service Harmless" amendment regarding County -City service con- contracts re: tracts. "Hold Harmless The Assistant City Attorney advised Council he had examined the document and found it to be in proper form. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the Mayor be authorized to sign and City Clerk attest the Assumption of Liability Amendment. ' A communication was presented from the State Division of Re: two Highways regarding a study of the request by the City for way traffic conversion of the existing one-way traffic pattern on on Azusa Azusa Avenue and San Gabriel Avenue to two-way operation, Ave. with the decision to maintain one-way couplet on Azusa and San Gabriel Avenues. Following discussion, it was Moved by Councilman Jackson, seconded by Councilman Rubio and unanimously carried that a letter of acknowledg- ment be written by the City Administrator, to be signed by the Mayor and City Administrator, stating that the City is not happy with the decision and request that the matter be kept on the agenda and further study be made on these two streets, with the hope that this will not be considered as the final decision. A memo, with a report, was received from the City Re:fence Administrator regarding contact with residents on the rear of south side of East Mason Street regarding the sharing property on of costs for the erection of a 6 -foot chain-link type E.Mason St. fence on the rear property line of their property. The report indicated that those contacted were not interested. Moved by Councilman Cooney, seconded by Councilman Jack- son and unanimously carried that the report be filed. It was requested that the Agreement regarding uniform Agrmt. re: County -City Joint Mutual Assistance for Fire Protection Mutual Asst. and Rescue Services remain tabled and no action be taken -Tabled pending the return of the Fire Chief. An Ordinance was presented for first reading amending 1st rdg.Ord. Section 9213.10(b) of the Municipal Code regarding coin Car Washes operated and automatic car washes. CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1964 Page 11 An inquiry was presented concerning the status of the Drainage complaint of Henry Van Ginkle regarding the drainage Problem problem on property owned by him which borders on Azusa H.Van Ginkle and San Gabriel Canyon Road, north of Sierra Madre Avenue. The complaint was referred for study and report to the City Engineer at the meeting of September 8, 1964, and a report had been prepared by the City Engineer outlining the situation and methods of solving the problem. It was noted that Mr. Van Ginkle had received a report and had been requested to reply if the proposed action would be satisfactory to him. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the drainage problem of Mr. Van Ginkle be placed on the agenda for action at the next Council meeting, with a statement to be presented from Mr. Van Ginkle. The City Administrator presented a notice from the League Notice of of California Cities regarding a hearing to be held in LCC Pub.Hrg.re San Diego on November 10, 1964, regarding the operation LAFCOM 11/10/6 of local agency formation commissions. San Diego Following discussion, it was Moved by Councilman Mc Lees, seconded by Councilman Rubio and unanimously carried to authorize the City Adminis- trator to contact the League office to inquire if present anticipated legislation includes powers to include addition- al territory to original annexation if they feel it is for the best interest of the annexation, and if that is be- ing considered, to write a letter advising that Council does not desire such power be granted to the Local Agency Formation Commission. The City Clerk presented notice of dues for 1964-65 for Pmt.of the Committee of Mayors of the Cities of Los Angeles Dues Comm. County in the amount of $45.00. of Mayors Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the City Clerk be authorized to draw a warrant in the amount of $45 for dues to the Committee of Mayors for 1964-65.
