Mayor Memmesheimer called the meeting to order and led in Call to the salute to the flag. Order 'Invocation was given by Rev. W. C. Schnute of Concordia Invocation Lutheran Church. Present at Roll Call: Councilmen: Rubio, Cooney, Jackson Roll Call Memmesheimer Absent: Councilmen: McLees Also Present: Assistant City Attorney Terzian, City Administrator Foxworthy, City Engineer Sandwick, Superintendent of Light & Water Smith, City Clerk Miller The Mayor informed Council that Councilman McLees asked to Cnclmn. be excused from the meeting because of injury to his back. McLees exced.frm. Moved by Councilman Jackson, seconded by Councilman Cooney mtg. and unanimously carried that Councilman McLees be excused from the meeting as requested. With no corrections, the Minutes of the meeting of October 19, Appvl.Min. 1964, were approved as written. 10/19/64 The hour of 7:30 P.M. being the time set for a public hearing Pub.Hrg.on an appeal by Council to the granting of a Variance by appeal b 'on Planning Commission Resolution No. 476 (Case V-107 - W. Council to Warshawer), to permit reduced rear yards of 5 feet, 10 feet grtg.of Var. and 13 feet on property located on the west side of Lark by P.C.Res. Ellen Avenue from approximately 150' north of Arrow High -#476(V-107) way to approximately 1235' north of Arrow Highway, the Warshawer hearing was declared opened by the Mayor. re:reded. rear yds. The City Clerk presented the Affidavit of Proof of Publica- W.S.Lark tion of Notice of Public Hearing, and stated that no written' Ellen Ave. communications were received regarding the case. N.of Arrow Mr. W. Warshawer, 771 Claymont Drive, Los Angeles, appeared before Council and submitted an architect's rendering which was reviewed by Council. Mr. Warshawer stated that the three areas involved are side yards rather than rear yards; there 1s no access into the yard areas; there is no legal light or ventilation for units in this area; also, the Los Angeles County Flood Control easement will prohibit any building on the adjacent property. He further stated that without this Variance, there would be a reduction of three units. Ralph Fitzsimmons, Acting Planning Director, reported to Council that the Department had checked this, although they 'have not received the Precise Plan as yet, and a condition to the granting of the Variance by the Planning Commission was that the Precise Plan of Design be reviewed and approved by the Planning Commission prior to the issuance of a building permit. Mr. Warshawer further asked if it would be possible to have �;ze Variance granted if he brought in his Precise Plan, or :would it be held in abeyance subject to approval of the Plan? Kesler, a member of the Planning Commission, appeared before Council and explained the reasoning behind the adoption of .Resolution No. 476 by the Planning Commis- sion, He stated further that this is a very difficult lot to plan and, since it backs up to the Flood Control Wash, it certainly will not violate the circulation of air and 'ventilation nor affect anyone's property in this respect. Attorney Terzian suggested that if review and approval of a Precise Plan by the Planning Commission and Council was to be a condition to the granting of the Variance, the record should show that Mr. Warshawer, the petitioner and developer, was in agreement. Mr. Warshawer stated that he would agree to the conditions. Mrs. Florence Smith, 16834 Laxford Rd., addressed Council requesting information regarding the type and plan of con- struction. There being no written communication received and no one else in the audience wishing to speak on this subject, it was Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the Attorney prepare a Reso- lution granting a Variance subject to Council approval of the Precise .Plan. The time of 7:30 P.M. also being the time set for a public Pub.Hrg.re: hearing on a change of zone from R -3c to C-2, recommended zone change by Planning Commission Resolution No. 478 (Case Z-115 - to C-20 E.S. Joseph Caudle), on property located on the east side of Azusa Ave. Azusa Avenue just north of Little Dalton Wash opposite no. of Lttle Paramount Street, the hearing was declared opened by the Dalton Wash Mayor. (Case Z-115 - Caudle) The City Clerk presented the Affidavit of Proof of Publica- tion of Notice of Public Hearing and stated that a communi- cation was received from Anthony S. Mareno requesting that Council defer any action on the rezoning of this property until a Precise Plan of development is approved. Mr. Travis Heatly, realtor at 654 South Azusa Avenue, representing Mr. Caudle, addressed Council and presented a plan which was reviewed by Council. Mr. Heatly stated that the applicant intends to construct stores on this property, since, in his opinion, R-3 zoning would not be appropriate as it fronts mostly on Azusa Avenue which is quite a noisy highway. The City Clerk stated that Mr. Mareno's main concern was 'assurance of adequate circulation of light and ventilation. There being no further communications and no one else in the audience wishing to be heard on this subject, it was. CALIFORNIA MONDAY, NOVEMBER 16, 1964 The hour of 7.30 P.M. also being the time set for a public hearing relative to the Weed Abatement Program, the hearing was declared opened by the Mayor. No newspaper publication of a legal notice being required for this hearing, a signed statement from Superintendent of Public Works Brusnahan was presented, which stated that on November 6, 1964, the follow- ing four lots were posted for weed abatement nuisance, as listed in Resolution No. 4749: 325 West 2nd Street 10 North Alameda Avenue 310 North Alameda Avenue 719 West Duell Street There being no written communications received and no one in the audience wishing to be heard in regard to this matter, it was Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman Jackson, seconded by Councilman Cooney and unanimously carried that the Superintendent of Public Works be instructed to proceed with the Weed Abatement Program. The City Clerk presented a communication from the Chamber of Commerce, requesting authorization be granted to the Light Department to decorate the Christmas tree and the Public Works Department to erect the Nativity Scene, both Christmas displays being located at the Civic Center. Moved by Councilman Jackson, seconded by Councilman Cooney 'and unanimously carried that authority be granted for erection of the Nativity Scene and illumination of the Chris.tmas tree on the Civic Center lawn. A communication was received from Donell M. Spencer, president of the Azusa Historical Society, requesting available space for Museum use, After discussion, it was recommended by the Mayor that Councilman Jackson and the City Administrator be appointed to confer with Mr. Spencer and submit recommendations to the Council at a future date. After discussion, it was moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that City Engineer Sandwick be authorized to complete the balance of his plans outlined in his memo of September 30, 1964, and also consider the construction of berms as suggested, Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOW- Res. #4757 ING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT Bills & OF WHICH THE SAME ARE TO BE PAID, Reqs.
