BRUCKN "lam i MMUNITY DEVELOPMENT DIRECTOR VIA: RICK COLE, CITY MANAGER DATE: NOVEMBER 1, 1999 SUBJECT: ORDINANCE ALLOWING THE CITY COUNCIL TO APPOINT A SUBSTITUTE REVIEWING BODY Recommended Action: Waive further reading and introduce the Ordinance. Background: The City of Azusa adopted a mobile home rent stabilization Ordinance in 1991,which also provided for the creation of a Rent Stabilization Review Board. The Board that was created at that time subsequently ceased meeting approximately one year after it was created due to the absence of any business for the Board to act on. By Ordinance the Board is comprised of two mobile home park owners and two mobile home park alternates selected by the mobile home park owners, two mobile home park residents and two mobile home park resident alternates selected by the mobile home park tenants associations, and one city resident approved by the City Council. Over the years the mobile home park associations have disbanded in some mobile home parks, and they have not elected new representatives from their mobile home parks. In essence,the Ordinance worked so well both mobile home park owners and mobile home residents lost interest in maintaining the Board and resulting permitted rent increases were not over burdening either party. Discussion with the City Attorney revealed that many cities have had similar problems with inactive Boards,and has provided the attached Ordinance as a solution. In recent weeks, staff has been informed of the desire of one mobile home park owner to increase rents significantly, which will require a hearing by a reviewing body. Since the Rent Stabilization Review Board is not active at this time, an alternate hearing body will be required. The proposed Ordinance will allow the City Council to hear such appeals, or allow it to designate a hearing body, such as the Planning Commission to conduct the required hearing.
