Sec. 54957.6). Agency Negotiators: Chief Negotiator Bill Floyd, City Manager Cole, Assistant City Manager Geoff Craig, and Human Resources Manager/Personnel Officer Dottie Wallace. RE: Bargaining Units: ACEA, AMMA, APOA, IBEW, APMA and CAPP. B. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Gov. Code Sec. 54956.9 (a)). McCurdy v. City of Azusa, et. al. Case No. Los Angeles Municipal Court, 99C02938. C. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (c )). One Case - Amicus Brief. 7:30 P.M. REGULAR MEETING TO CONVENE. ! Call to Order ! Pledge to the Flag ! Invocation - Father David Granadino of Saint Frances of Rome Church. ! Roll Call II. CEREMONIAL A. Presentation of Proclamation recognizing Cancer Control Month in the month of April, 2000. III. PUBLIC PARTICIPATION (Person/Group shall be allowed to speak without interruption up to five (5) minutes maximum time, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker=s questions or comments, shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes time.) A. Mr. Paul Naccachian of the Balzac Café to provide an update on the Downtown Business Association. IV. REPORTS, UPDATES, COUNCIL BUSINESS AND ANNOUNCEMENTS FROM STAFF A. City Clerk to request waiver of fees for rental of the Civic Auditorium in order to hold National Day of Prayer service by all denominations, on Thursday, May 4, 2000, at 7:00 p.m. B. City Manager Cole to provide an update on Citizen Congress. V. SCHEDULED ITEMS AIf you challenge the City=s proposed actions in court, you may be limited to raising those issues that you or someone else raised at the public hearing described in this Agenda, or in any written correspondence delivered to the City on or prior to the public hearing.@ A. PUBLIC HEARING - to consider an appeal of Planning Commission denial of Zone Change No. Z-99-01, made by Alexander/Catania and consideration of Planning Commission recommendation for denial of General Plan Amendment No. GPA-99-01 and Tentative Tract Map No. 52800, for the property located at 1724, 1730- 1770 & 1790-1830 North Azusa & San Gabriel Canyon Road. RECOMMENDATION: Open the Public Hearing; receive testimony, close the Hearing. City Council may either: 1) Concur with the Planning Commission recommendation, waiving further reading and adopting Resolution Nos. 00-C46 and 00-C47, denying the General Plan Amendment No. GPA-99-01 and Tentative Tract Map No. 52800 and Resolution No. 00-C48, upholding of the Planning Commission=s decision to deny Zone Change No. Z-99-01 for the property located at 1724, 1730-1770 &1790-1830 North Azusa & San Gabriel Canyon road based on the findings of fact listed in the attached resolutions; or 2) Direct staff to prepare the necessary ordinance and resolutions for approval, based on the modified proposal by the applicant for 26 lots and a minimum lot size of 7,500 square feet, and based on the findings as articulated in the public hearing. B. ADAY LABORER@ UPDATE - The staff report covers a number of elements that are critical ingredients to resolving the day laborer issue in the City, such as, research and recommendations from an informal committee that has been studying the issue, a revised approach to design and cost of a relocation site; a draft lease agreement for the alternate site in the industrial area of Gladstone Street; a transition plan for moving the laborers from the residential area; and a draft ordinance to limit solicitation of labor by both laborers and employers. While not a complete solution, it appears to have the support of all parties and provides the outlines of one. Recommendation: With Council approval staff hopes to move forward to implementation. 04/17/00 PAGE TWO C. Dedication of Land and Grant Deed for the ATrail@ on the Northwest corner of Sierra Madre and Todd Avenues. Pending City Council approval, CLTF is offering to dedicate to the City, the existing 41' wide pedestrian/bicycle/service-road (ATrail@), in order to be absolved from the maintenance, repair, operation, and liability. Recommendation: After discussion, and if Council concurs, approve and accept the land dedication and grant deed therefor, plus the Certificate of Acceptance for the property on the northwest corner of Sierra Madre and Todd Avenues, subject to conditions listed in the staff report. VI. CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. A. Approval of Minutes. Recommendation: Approve minutes as written. B. Wheeler Meter Maintenance - Amendment to Blanket Purchase Order. Wheeler Meter Maintenance has proven that it provides service required at the most reasonable cost. This year, some meters have required more extensive repairs thereby exceeding the anticipated meter maintenance expenses. Recommendation: Approve an amendment to the existing Blanket Purchase Order to Wheeler Meter Maintenance in the amount of $30,000 for maintenance and repair to large water meters. C. Purchase of truck for the Consumer Service Division, using the Alternative Purchase Procedure. The State of California=s Department of General Services has completed the bidding process and awarded contracts for the purchase of 2000 model sedans and trucks. The Consumer Service Division needs to replace two older vehicles which are no longer economical or safe transportation. Recommendation: Authorize the purchase of two 2000 Ford Ranger Trucks for the Consumer Service Division using the State of California, Department of General Services Contract #1-00-23-20. D. Well No. 5 Emergency Repairs. In February of this year, Well No. 5 stopped producing water after many years of service. It required emergency repairs, such as, substantial cleaning, pipe system replacement and motor modifications. Quotations were sought based upon five phases which are detailed in the staff report. Recommendation: Adopt Resolution No. 00-C49, waiving formal bidding procedures and approving a purchase order in the amount not to exceed $87,500 to General Pump Company. E. ProForma Quality Printing - Amendment to Blanket Purchase Order. The existing Blanket Purchase Order amount for the printing of utility bills, notices and other pertinent printed materials was underestimated. There is a need to increase the amount to $15,000. Recommendation: Approve the amendment to the Blanket Purchase Order in the amount of $15,000. F. Proposed Letter in Support of Rule 1191 regarding Clean On-Road Light and Medium Duty Public Fleet Vehicles. Rule 1191 will present a wide variety of already available passenger cars and light/medium trucks that are the cleanest in their class. Recommendation: Authorize the Mayor to send a letter to the South Coast Air Quality Management District supporting Proposed Rule 1191 regarding the Clean On-Road Light and Medium Duty Public Fleet Vehicle. 04/17/00 PAGE THREE G. Human Resources Action Items. Recommendation: Approve. Merit and/or regular appointments: D. Munoz and J. Polizzi. New Appointments: M. Westrup, Customer Service Representative I, effective 4/24/00. H. Citizen Congress Delegates. The first of four Citizen Congress sessions will convene on Friday, May 12th and Saturday, May 13th, in the Civic Auditorium and Senior Center. As a result of outreach efforts, 264 community members have volunteered or were nominated to be delegates to the Citizens Congress. Recommendation: Confirm the 264 community members as Citizen Congress Delegates. I. Resolution authorizing payment of warrants by the City. Recommendation: Adopt Resolution No. 00- C50. VII. CONVENE AS THE REDEVELOPMENT AGENCY A. Approval of Minutes. Recommendation: Approve minutes as written. B. Resolution authorizing payment of warrants by the Agency. Recommendation: Adopt Resolution No. 00- R10. VIII. ORDINANCES/SPECIAL RESOLUTIONS A. Bus Shelter/Bus Bench Advertising Ordinance. Franchising the installation and maintenance of, and advertising on, bus shelters and bus benches within a city=s jurisdiction provides as an important amenity to transit users while serving as a source of revenue to the city=s General Fund. A proposed Ordinance that would enable Azusa to have franchised bus shelters and bus benches as well as a share of the advertising revenues is presented. Recommendation: Waive further reading and introduce proposed Ordinance which would add Article VIII to Chapter 62 of the Azusa Municipal Code pertaining to bus shelter and bus bench franchises for city service.
