HSU, DIRECTOR OF UTILITIESKc FROM: SONIA CARVALHO, CITY ATTORNEY DATE: DECEMBER 17, 2001 SUBJECT: ORDINANCE REGARDING AGREEMENTS NEGOTIATED BY DIRECTOR OF UTILITIES AND EXECUTED BY THE CITY MANAGER RECOMMENDATION It is recommended that the City Council introduce and waive further reading of Ordinance No. 0= regarding agreements negotiated by the Director of Utilities and executed by the City Manager. BACKGROUND The City Council adopted Ordinance No. 98-014, effective October 5, 1998, which added Sec. 2-296 to the Azusa Municipal Code to establish certain authority for the Director of Utilities to negotiate agreements for the purchase and sale of energy and energy transmission service. In addition, the City Manager is authorized to execute on behalf of the City the agreements negotiated by the Director of Utilities. All such agreements are required to be presented to the City Council/Utility Board within 14 days after such an agreement is executed. Ordinance No. 98-014 was adopted in order to facilitate the negotiation and execution of agreements for the timely acquisition of important sources of energy and energy transmission service. Taking into account the need to facilitate the negotiation and execution of agreements for the timely acquisition of scarce water resources, the proposed ordinance would provide authority for the negotiation and execution of water agreements along the same lines as the authority for energy agreements. ,,/ / (&/)-4. RVPUB\JFF\623127 —1— / /7°/ dAd FISCAL IMPACT The proposed ordinance would not have any new or increased fiscal impact since the authority of the City to enter into such agreements already exists.
