SUBJECT: PAWN SHOP ZONING MATTER
BACKGROUND
In 1982,the zoning was amended in and around downtown from C-3 to CBD,that in effect phased-out
pawns shops as permitted uses. The zoning code provides for a 20 year period during which these
nonconforming uses would be amortized. After that, pawn shops would then need to be relocated to
a C-3, M-1, or M-2 zone under C.U.P. provisions. The Code also provides for the ability by the
business owner to request a time extension of 5 years of the Zoning Administrator.
This zoning provision affects both Wimpy's Pawnshop, as well as Azusa Pawnshop. At present, the
Azusa Pawnshop is being sold to another entity, who is interested in a 10 year time extension.
However, in accordance with the Zoning Code, the Zoning Administrator has the authority to consider
a 5 year extension, after a public hearing. Staff understands that the Azusa Pawnshop owner intends
to address the Council on this matter under "Public Participation" at the February 19 Council meeting.
The forthcoming new development code will examine all aspects of our current Code, including
amortization and how we deal with phasing-out non-conforming land uses. In addition, the policy
issue whether pawn shops ought to continue to be disallowed in the CBD zone will also be examined.
Meanwhile, Staff will examine the various alternatives that may be available to address the current
situation of the sale of the Azusa Pawnshop. There appear to be several alternatives available that need
to be examined:
1. The business owner may apply for a 5 year time extension.
2. Reconfigure the pawnshop business into a use that is permitted, such as an antique shop.
3. Assist in the relocation of the business.
4. Wait until the new development code is prepared.
Most of these options have been discussed with the business owner, and another meeting will be set
up to discuss these and other possible options.
