CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (b). One Case. 7:30 p.m. - Convene to Regular Meeting of the City Council. ! Call to Order ! Pledge to the Flag ! PUBLIC PARTICIPATION (Person/Group shall be allowed to speak without interruption up to five (5) minutes maximum time, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker=s questions or comments, shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes time.) A. Mr. Art Ramirez, Chairman of the Azusa Golden Days Committee to make announcements and presentations regarding Azusa Golden Days events. B. Mr. David James of the Forest Preservation Society to address Council regarding potential debris flow in the National Forest. C. Ms. Ginny Dadaian and Ms. Kristen Stephenson of Azusa Pacific University to address Council to announce the continuance of AZUSA READS program. III. REPORTS, UPDATES, COUNCIL BUSINESS AND ANNOUNCEMENTS FROM STAFF A. Assistant City Manager Person – update on FY2003 Workplan – 1st Quarter. IV. SCHEDULED ITEMS A. PUBLIC HEARING – on revised Water Development and Annexation Fees. Recommendation: Open the Public Hearing, receive testimony; close the Hearing. 1. Waive further reading and adopt Resolution No. 02-C102, adopting the amounts of the Water System 2002 Development Fee. 2. Waive further reading and adopt Resolution No. 02-C103, adopting the Water System 2002 Annexation Fee. B. PUBLIC HEARING - on proposed amendment of condition of approval of Tentative Parcel Map No. 26484, which calls for the creation of a property owners association to maintain the existing bike trail. Recommendation: Continue the Public Hearing to Monday, October 21, 2002. 10/07/02 PAGE TWO V. CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. A. Approval of Minutes. Recommendation: Approve minutes as written. B. Project Acceptance and Notice of Completion: City Auditorium Interior Renovations. Recommendation: Accept the City Auditorium Interiors Renovations project as complete, approve the attached notice of completion, and approve extras in the amount of $29,585.00. C. Human Resources Action Items. Recommendation: Approve Personnel Action Requests in accordance with Section 3.3 of the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s). D. Plans and Specifications to Advertise for Bids – San Gabriel Canyon Road Beautification Project. Recommendation: Approve the San Gabriel Canyon Road Beautification project plans and specifications and authorize the City Clerk to advertise for bids, pending CalTrans’ approval. E. Employment Contract with Mike Lorusso for Public Works Department. Recommendation: Approve the “Employment Contract” with Mike Lorusso, effective October 8, 2002, through February 7, 2002. 10/07/02 PAGE THREE F. Updated Class Specification and Salary for the Position of Recreation Coordinator and Reclassification of the Director of Recreation. Recommendation: Approve the updated class specification and salary for the position of Recreation Coordinator and the reclassification of an Associate Director of Recreation and Parks to Director of Recreation. G. License Agreement between City of Azusa and California State University of Long Beach (CSULB). Recommendation: Adopt Resolution No. 02-C104, approving the License Agreement between the City of Azusa and the Occupational Studies Department of California State University Long Beach. H. Request for Amendment of $8,575 to the Administration Department /Information Services Division Operating Budget for the 2002-2003 Fiscal Year. Recommendation: Approve an Amendment to the operating budget of the Administrative Department Information Services Division in the total amount of $8,575.00, for the 2002-2003 fiscal year. The increase will be distributed accordingly: $3,525 – Messaging Architects, $1,800 – Reimbursement costs for Council DSL and $3,250 Bi-Tech Software Maintenance. I. Letter of Engagement for Outside Legal Services with Fulbright and Jaworski. Recommendation: Approve the Letter of Engagement with Fulbright and Jaworski for legal services in connection with Edison’s lawsuit against the City. J. Azusa Reads, Off-Campus Federal Work-Study Program Agreement with Azusa Pacific University. Recommendation: Approve and authorize the City Manager to sign the Off-Campus Federal Work-Study program agreement between Azusa Pacific University (APU) and the Azusa City Library. 10/07/02 PAGE FOUR K. Contract with North East Trees for Design and Construction of the USDA Forest Service Canyon Gateway Interpretive Center. Recommendation: Enter into a contract with North East Trees to design, develop, and construct the USDA Forest Service/San Gabriel Canyon Gateway Interpretive Center. Located at the north end of Highway 39, the Interpretive Center will consist of 1500 square foot building to house the Forest Service, adjacent parking lot and native plant garden. L. Grant Agreement from CA Office of Traffic Safety for the East San Gabriel Valley Driving Under the Influence Checkpoint Coalition project. Recommendation: Adopt Resolution No. 02-C105, accepting the Grant agreement from the California Office of Traffic Safety (OTS) awarding the City of Azusa up to $120,147 for the purchase of equipment for and the hourly wages at overtime rate to conduct 20 Drunk Driving Checkpoints from January 1, 2002 to December 31, 2004 throughout the Cities of Azusa, Baldwin Park, Covina, Glendora and Irwindale. M. Resolutions Authorizing Payment of Warrants by the City. Recommendation: Adopt Resolution Nos. 02-C106 and 02-C107. CONVENE JOINTLY WITH THE REDEVELOPMENT AGENCY TO DISCUSS THE FOLLOWING: VI. JOINT CITY/AGENCY ITEM A. CONTINUED JOINT PUBLIC HEARING - on a proposed Disposition and Development Agreement with SY Development Corporation. Recommendation: Continue the Public Hearing to the meeting of October 21, 2002. CITY COUNCIL TO RECESS AND REDEVELOPMENT AGENCY TO CONTINUE. VII. REDEVELOPMENT AGENCY CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. Exclusive Negotiation Agreement between the City of Azusa Redevelopment Agency and Hanrich Enterprises, Inc. for the Redevelopment Project Commonly Known as Block 36. Recommendation: Adopt Resolution No. 02-R28, approving the Exclusive Right to Negotiate Agreement between the Agency and Hanrich Enterprises, Inc. for the redevelopment of Block 36 (southeast corner of Azusa Avenue and Foothill Boulevard). C. Resolution Authorizing Payment of Warrants by the Agency. Recommendation: Adopt Resolution No. 02-R29. VIII. ORDINANCES/SPECIAL RESOLUTIONS A. Fireworks Ordinance. IX. ADJOURNMENT. A. Adjourn to Saturday, October 19, 2002, at 8 a.m., to meet jointly with the Azusa Planning Commission, at the Senior Center in order to conduct a workshop on Monrovia Nursery Specific Plan, specifically, the promenade portion of the plan and traffic circulation.
