PUBLIC PARTICIPATION (Person/Group shall be allowed to speak without interruption up to five (5) minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker=s questions or comments, shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes). A. Mr. David James of the Forest Preservation Society to address Council regarding potential debris flow in the Angeles National Forest. B. Ms. Karen Fortus of the U.S. Forestry to provide and update on the Williams Fire. III. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM COUNCIL AND STAFF A. Associate Director of Recreation and Parks, Noriega to provide a presentation on Azusa Park Renaissance. IV. CONTINUED ITEMS A. Employment Contract with Mike Lorusso for Public Works Department. Recommendation: Approve the Employment Contract with Mike Lorusso, effective October 21, 2002, through March 25, 2003. B. Project Acceptance and Notice of Completion: City Auditorium Interior Renovations. Recommendation: Accept the City Auditorium Interiors Renovations project as complete, approve the notice of completion, and approve extras in the amount of $26,626.50. 11/04/02 PAGE TWO C. Offer of Dedication, Parcels “A” and “B” of Mountain View Business Park, 1201 N. Todd Avenue. Recommendation: Waive further reading and adopt Resolution No. 02-C127, accepting dedication of Parcels A and B described in the Grant Deed, subject to the Applicant’s submittal, and City’s approval of Phase 1 environmental studies clearing the parcels from any contamination issues. V. SCHEDULED ITEMS A. Consideration of Potential Ballot Measure. Recommendation: Because of court decisions indirectly affecting the collection of the City’s Utility Users Tax, it is recommended that the Council schedule public consideration of a ballot measure to be placed on the March ballot that would: • Reduce the rate for residential electric, water and gas from 5% to 4%. • Increase rate for commercial electric, water and gas from 5% to 8%. • Apply commercial rate to commercial telephones and wireless devices. It is also recommended that the City appoint a community “Tax Review Task Force” to work with the Council and staff on a broader tax reform plan to be put before voters in November 2003. B. PUBLIC HEARING - relating to adoption by reference of the 2001 edition of the California Building Standards Code. Recommendation: Open the Public Hearing; receive testimony, close the Public Hearing. Waive further reading and introduce proposed ordinance amending Chapter 14 of the Azusa municipal Code adopting by reference the 2001 edition of the California Building Standards Code (California Code of Regulations, Title 24), incorporating California Building Code, California Mechanical Code, California Plumbing Code, and the California Electrical Code and adopting the uniform Swimming Pool, Spa and Hot Tub Code, the Uniform Sign Code, and the Uniform Housing Code chapters 4, 5, 6 and sections 701.2 and 701.3, (1997) edition), and amending sections 14-1, 14-51, 14-55, 14-91, 14-111, 14-150, 14-191, 14-193, 14-194 referencing code adoptions and adding sections 14-57 of the Azusa municipal Code. 11/04/02 PAGE THREE C. PUBLIC HEARING - to receive and consider all evidence and reports presented relative to the City’s schedule of fees and charges for various services, for which users make a direct payment proportionate to the services rendered. Recommendation: Open the Public Hearing; receive testimony, close the Public Hearing. Approve the addendum to the User Fee Schedule approved September 3, 2002, for various municipal activities and services in accordance with the Coast of Service Study by Revenue and Cost Specialists and input by Staff. D. Resolutions Placing a Ballot Measure on the March 4, 2003, General Election, to Prohibit Sales and Discharge of Fireworks. Recommendation: Waive further reading and adopt Resolution No. 02-C128, ordering the submission of a measure to the qualified electors of the City of Azusa to prohibit the sale of Fireworks and waive further reading and adopt Resolution No. 02-C129, providing for the filing of rebuttal arguments for city measures submitted. VI. CONSENT CALENDAR The Consent Calendar adopting the printed recommended action will be enacted with one vote. If Staff or Councilmembers wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. A. Approval of Minutes. Recommendation: Approve minutes as written. B. Re-titling of New Recreation Department: Recommendation: Approve the department title “Recreation and Family Services” as recommended by the Parks and Recreation Commission. 11/04/02 PAGE FOUR C. Resolution Calling and Giving Notice of the Holding of a General Municipal Election to be held on Tuesday, March 4, 2003, for the Election of Certain Officers as Required by the Provisions of the Laws of the State of California Relating to General Law Cities. Recommendation: Adopt Resolution No. 02- C130. D. Resolution Requesting the Board of Supervisors of Los Angeles County to Render Specified Services to the City Relating to the Conduct of a General Municipal Election to be Held on Tuesday, March 4, 2003. Recommendation: Adopt Resolution No. 01-C131. E. Human Resources Action Items. Recommendation: Approve Personnel Action Requests in accordance with Section 3.3 of the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s). F. Resolution Authorizing Payment of Warrants by the City. Recommendation: Adopt Resolution No. 02- C132. CONVENE JOINTLY WITH THE REDEVELOPMENT AGENCY TO DISCUSS THE FOLLOWING: VII. JOINT CITY/AGENCY ITEM A. CONTINUED JOINT PUBLIC HEARING - on a proposed Disposition and Development Agreement with SY Development Corporation. Recommendation: Continue the Public Hearing to the meeting of November 18, 2002. CITY COUNCIL TO RECESS AND REDEVELOPMENT AGENCY TO CONTINUE. 11/04/02 PAGE FIVE VIII. Proposed Ordinance regarding Fireworks. Recommendation: Waive further reading and adopt Ordinance No. 02-O11. X. ADJOURNMENT. A. Adjourn to Wednesday, November 13, at 6:00 p.m. to conduct a Joint Planning Commission- City Council Workshop regarding Monrovia Nursery.
