PERSON, ASSISTANT CITY MANAGER VIA RICK COLE, CITY MANAGER SUBJECT: GRANT DEED ACCECPTANCE FOR AZUSA HEALTH CLINIC, 150 N. AZUSA AVENUE FROM LOS ANGELES COUNTY DATE: FEBRUARY 18, 2003 RECOMMENDATION It is recommended that the Azusa City Council adopt Resolution Number to accept the Quitclaim Deed from the County of Los Angeles to reconvey title to the City for the Azusa Health Clinic property located at 150 N. Azusa Avenue. This resolution is in compliance with the reversionary condition contained in the original deed to the City. BACKGROUND The Vosburg Estate entered into an agreement on December 8, 1931 with the County of Los Angeles to have it operate the clinic. Resolution 1277 delineated the terms under which the clinic was to be operated. Specifically, if the County failed, at any time, to continue operation, the clinic, including all the property and appurtenances would be taken over by the City for operation. If the City could not maintain or continue its operation as a public health center, the whole property would revert to the Vosburg heirs. Los Angeles County closed the clinic along with ten other clinics as part of its cost cutting strategy due to the County and State budget crisis. The doors were closed on October 1 , 2002. A coalition of representatives from the City, County, Azusa Pacific University, Azusa Unified School District and various health care providers was formed to develop plans to re-open the clinic. On November 19, 2002, the Los Angeles County Board of Supervisors approved the transfer of the facility back to the City along with equipment donation from the County. A $50,000 grant from the California Endowment was also awarded to the City through Supervisor Gloria Molina's office to assist the City with initial start up costs The City's challenge and goal is to partner with a health care agency that is interested and capable to act as the lead fiscal agent and administrator for the clinic. Meetings have been held with interest agencies. At this time, discussions are in progress to reach the necessary agreements. FISCAL IMPACT The City will be obliged to maintain the building on an on-going basis until a partner is selected to manage the facility. it is anticipated that this may not reduce the City's financial responsibility since any partner will probably request that the City contribute toward the building's upkeep. Staff will be assessing that cost and will include it, if necessary, in the FY2004 budget for Public Works (Facilities Maintenance). At this point, only a $50,000 grant from the California Endowment to Azusa Pacific University has been identified to fund the clinic start up costs. It should be noted that a community clean-up of the clinic was conducted last Saturday at no expense to the City. �i The Canyon City—Gateway to the American Dream r CERTIFICATE OF ACCEPTANCE This is to certify that the interest in the real property conveyed by the within document to the CITY OF AZUSA, a municipal corporation, is hereby accepted by approval of the City Council at its meeting of February 18, 2003, and the CITY OF AZUSA consents to the recordation thereof by the County Recorder of the County of Los Angeles. LAWdisk5memo;crusc Retype for bener legiblliry June 7 , 1995 TO : Mayor and City Council FROM : City Clerk Re : Azusa Health Center Wesley Kloepfer , in the course of writing his book on the history of Azusa , advised me today of a hitherto unknown fact concerning the Azusa Health Center- - -which , by the way , is one of the ones scheduled to be closed by the County , as part of its cost-cutting program. Resolution 1277 , dated 12/8/31 , attached , in summary , is an agreement delineating the terms under which the Clinic is to be operated : The Vosburg Estate entered into an agreement with Los Angeles County , to have it operate the Clinic . If the County fails , at any time , to continue the operation , then the Clinic , including all the property, and appurtenances , would be taken over by the City , for operation . If, at any time , the City cannot maintain or continue its operation , then the whole thing would revert the Vosburg heirs . In light of the County ' s intentions , this should be looked into, for future consideration , vis-a-vis the City ' s position in the matter .
