Mayor Memmesheimer called the meeting to order and led in Call to the salute to the flag. Order Invocation was given by Rev. E. M. Almquist of Foothill Invocation Park Baptist Church. Present at Roll Call: Councilmen: Rubio, Cooney, Solem, Roll Call McLees, Memmesheimer Absent: Councilmen: None Also Present: City Administrator Foxworthy, City Attorney Williams, City Engineer Sandwick, Supt. of Light & Water: Smith, City Clerk Miller The City Clerk announced that bids were opened in the office Bid Opening of the City Clerk at 10:00 A.M., on Friday, April 30, 1965, St.Lts. - for the installation of Street Lights on Azusa Avenue, Pro- Azusa Ave. ject No. 2. Present at bid opening were Superintendent Res.#4836 of Light and Water Smith, City Engineer Sandwick, City City Forces Administrator Foxworthy, and City Clerk Miller. The City to perform Clerk presented the Affidavit of Proof of Publication of project. Notice Inviting Bids. Bids were received from the following: Amount of Bid General Maintenance $8,812.37 Sherwin Electric Service 81862.00 Henkels & McCoy, Inc. 9,486.81 C. T. & F., Inc. No Bid A communication was received from the Superintendent of Light and Water with a recommendation that the bids be re- jected, bidders' checks be returned, with work to be done by City forces due to the fact that the cost estimate of the project by Light and Water Department is $3,222.00 below that of the lowest bidder. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that the recommendation of the Superin- tendent of Light and Water be approved, that the bids be rejected and bidders' checks be returned. -Councilman McLees offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DE- CLARING THAT A CERTAIN PROJECT FOR THE CONSTRUCTION OF .STREET LIGHTS CAN BE PERFORMED MORE ECONOMICALLY BY DAY LABOR AND THE MATERIALS AND SUPPLIES FURNISHED AT A LOWER 'PRICE IN THE OPEN MARKET AND ORDERING THE PROJECT DONE IN THE MANNER STATED. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that further reading be waived. Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried that all bids be rejected and bid bonds and checks be returned to the bidders and that the project be re -advertised. A communication was received from the Parents' C1ub,.Saint Req. from Frances of Rome School requesting permission to use three St.Fr.Rome game booths for their annual All States Picnic to be held Parents -Club 16, 1965. - booths. 'May City Clerk Miller stated that the picnic is to be held at Swiss Park in Duarte. Following discussion, it was Moved by Councilman McLees, seconded by Councilman Solem And unanimously carried that the request be referred to the Park and Recreation Commission, with the provision that if favorable action is taken, a reasonable deposit be required to guarantee safe return of the booths. A communication was received from Builders Mortgage Company, Req, for Beverly Hills, requesting the City to°construct curb and imprvmnts. gutter to complete the street work on Ben Lomond Avenue, on Ben Lomond 320' south of Alosta; the owners to dedicate the land and at Alosta. pay for the construction. The City Engineer submitted a memorandum explaining the project, the Engineer's estimate, means of financing and recommendation. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the recommendation of the City Engineer be accepted with conditions as outlined, the project to be included in the 1965-66 Gas Tax.Budget, and requesting a deposit guaranteeing the dedication; con- tract to specify that construction be commenced after July 1, 1965. Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that the City Engineer prepare the plans and specifications for the improvement of Ben Lomond Avenue, and the City accept the proposal submitted by the Builders Mortgage Company. A communication was received from Mr. Sid Mulligan, 356 West Vista Bonita, requesting the City's support in re- questing Aerojet-General Corp. to remove their sign now located within_ the parkways of the City and located adjacent to property recently purchased by Mr. Mulligan at the south west corner of Virginia Avenue and Foothill Boulevard. Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the City Administrator, City Attorney and City Engineer meet with Mr. Mulligan and representatives of Aerojet-General Corp, to discuss the problem and work out an amiable solution. The hour of 8:00 P.M. being the time set for the Public Hearing before Council upon the adoption of the Fire Code of the County of Los Angeles, the Mayor declared the hearing opened. The City Clerk presented the Affidavit of Proof of Publication of the Notice of Public Hearing, and stated that no communications were received regarding the proposed hearing. There being no one in the audience wishing to be heard on the subject, it was. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that the hearing be closed.. Adopt Fire Code Ord. 037 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE AZUSA MUNICIPAL CODE TO ADOPT BY REFERENCE THE "FIRE CODE" OF THE COUNTY OF LOS ANGELES ADOPTED BY COUNTY ORDINANCE NO. 2947 AS AMENDED BY ORDINANCE NO. 8531. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that further reading be waived. The City Clerk stated that a communication was received from LAF Com. Local Agency Formation Commission setting a hearing on May Hrg. 26, 1965 -at 9:00 A.M. on the request of the City of West 5/26/65 .Covina to annex certain territories to the Upper San re: W.Covina Gabriel Valley Municipal Water District and the Metropolitan Annex MWD Water District of Southern California. After discussion, it was CITY HALL AZUSA, CALIFORNIA MONDAY, MAY 3, 1965 Page 4 Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the City oppose the proposed annexation of West Covina area to the Metropolitan Water District and that the City Administrator appear at the hearing before the Local Agency Formation Commission on May 26th to present the protest on behalf of the City. Moved by Councilman Solem, seconded by Councilman McLees and unanimously carried that the Mayor be authorized to contact the San Gabriel Valley Municipal Water District and request that the District submit a protest to the annexation. A report was received from the Planning Director with Decision on reference to conditions and recommendations following a Appeal Var. Public Hearing held before the Council on April 19, 1965, (T.Swedlow) on an appeal to the denial of a Variance by Planning Com- Grtd. mission Resolution No. 509 (Case V-122), Theo Swedlow, to permit a combination auto dismantling and transmission repair business in an M-1 zone, at 1020 West Foothill Blvd.; the public hearing before Council was closed on April 19, 1965. Conditions recommended by the Planning Director in Communi- cations of April 27th and 29th were presented to Council. Moved by Councilman Rubio, seconded by Councilman Cooney that a Conditional Use Permit be granted as petitioned, subject to the conditions set forth by the Planning Director's communications of April 27th and 29th, with the exception that the hours of operation be from 6:00 a.m, to 6:00 p.m., 'Monday through Saturday, and directing the City Attorney to prepare the necessary document. Bd. mending an overall 3% increase in employee salaries for the rec.Salary coming fiscal year. Inc. 3% A communication was received from the Azusa City Employees ACEA req. Association requesting Council consideration for a one-step Salary Inc. range increase for all ranges, with consideration to an additional increase in the lower ranges. Moved by Councilman Cooney,.seconded by Councilman Rubio and unanimously carried that, in accordance with the recommendation of the Mayor, both communications be referred to Councilmen McLees and Cooney, as members of the Personnel Committee, and to the City Administrator for a report. A communication was received from the Personnel Board recom- mending acceptance of a proposal.by Gold -Thompson and Company for personnel services on a continuing basis and with a regular monthly charge, estimated at $75 per month. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that this matter also be referred to the above committee. Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried to grant authority to the Committee to question any Department Head and/or any employee of the City, with reference to all three Personnel items referred for study. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the report be filed. Notice was given by the Planning Commission, by Resolution No. 518 (Case V-121) that the application made by Fred Perz was denied for a Variance to relocate a four -unit apartment building on a lot in an Rlc zone at 651 West Gladstone St. Council was advised that an appeal was received on April 28, 1965. Hearing on the appeal will be held before Council on Monday, May 17, 1965. Notice was also given that the Planning Commission, by Resolution No. 519 (Case c-49) has denied the application of H. C. Burgraff for a Conditional Use Permit to permit an interior -illuminated sign of 24 square feet in an Rlc zone for a medical -dental office building at 210 North Citrus Avenue. An appeal to the action of the Planning Commission was received by the City Clerk on April 30, 1965. Public hearing on the appeal will be held before Council on May 17, 1965. Page 5 Ch.of Comm. Notice was further eiven that the Planning Commission, by Resolution No. 521 Case V-129), petitioned by 0, John Conforti, has granted a Variance to permit the continued erection -of a real estate directional sign for six months with permission for further time limit extensions of 6 -month intervals on property just south of 452 Norbh Azusa Avenue. Notice was also given that the Planning Commission, by Resolution No. 521 (Case C-48) has granted a Conditional Use Permit to permit the remodeling of a single family residence to combine a commercial business in front and residential rental in the rear of property at 615 North San Gabriel, as requested by John & Myrtle Thomma. 'A communication was received from the Police Chief re- questing the acceptance of the resignation of Dorothy Moskus, Secretary -Stenographer in the Police Department, effective May 15, 1965, and requesting that her name be placed on the eligibility list for reinstatement at a later date. The communication further requested permission to appoint one Stenographer - Clerk from the eligible list, subject to physical examina- tion requirements, to be effective after May 16, 1965. Light and Water requesting execution of the license to of License permit installing electric lines over the Atchison, Topeka ATSF R/R and Santa Fe Railway Company at Angeleno Avenue. Moved by Councilman McLees, seconded by Councilman Solem 'and unanimously carried that the execution of the license be approved and authorize Mayor to sign. A Resolution was presented accepting a Grant of Easement from Donald M. Gustafson for roadway purposes, fora thirty-foot strip on the north side of Sierra Madre Avenue between San Gabriel Avenue and Rodeffer's property. Res.#4840 Grt.of Easmnt. A communication was received from the City Engineer regarding Notice of the final.completion of Irwindale Avenue reconstruction and Completion recommending the acceptance of the project and authorizing (Irwindale) the execution of the Notice of Completion. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the recommendation of the City Engineer be accepted and authorizing the execution and recor- dation of the Notice of Completion. A report was presented from the Laura D. Jones Memorial Com- Rpt.Laura D. mittee with a sketch of the proposed memorial to be erected Jones at the northwest corner of the "Laura Jones Park" and re- Memorial commending that Council authorize the acceptance of public contributions from all persons or groups for the memorial, such contributions to be received and deposited in a special account at the First National Bank of Azusa. A communication was received from the City Administrator Preliminary with an attached summary of the preliminary 1965-66 1965-66 Operating Budget, with preliminary estimated revenues, Operating and requested that budget meetings be scheduled as soon Budget as convenient. The Mayor suggested budget meetings be set for May 18, 19, 25 and 26, at 7:00 P.M. Mr. Aubrey Wilson, 4 East Tremont, Pasadena, appeared before Council regarding the proposed purchase of the Rainbow Angling Club. Mr. Wilson stated the property is in escrow at the present time and, it is hoped, the escrow will be completed within a short time. The City.Admini- strator stated that, as directed by Council, he had tried to obtain a lot book report. However, he had been advised that, because the property ownership was so involved and so encumbered, it would be necessary to purchase the complete title search. A communication was received from the Atchison, Topeka and Santa Fe Railway Company regarding the proposed purchase of railroad property by the City and requested the City's review and approval of the Grant Deed in order that the transaction may be submitted to the executives of the Company for final approval. The City Administrator stated that City Attorney Williams had reviewed the Grant Deed and approved it as to form. The City Administrator advised Council regarding notice of PUC Hrg. hearing before the PUC, Monday, May 17, 1965, at 10:00 A.M., 5/17/65 in the Commission Courtroom, State Office Building, 107 crossing South Broadway, Los Angeles, with reference to the safety, devices maintenance, operation, use and protection of public grade crossing devices. A communication was received from the League of California LCC re: Cities regarding Senate Bill 218, with reference to FPC SB 218 authority to regulate wholesale electric rates, hearings to be held on May 12 and 13, 1965. Councilman.McLees stated he had been contacted regarding Re:wall @ the conditions stipulated by the Planning Commission car wash Resolution regarding a block wall constructed enclosing 514 N.Azusa a proposed coin-operated car wash at 514 North Azusa Avenue. Councilman McLees, together with Members of Council, Azusa High commended the achievements of the Azusa High Schocl Band Band & Ross and Director Ross Davis on their success in receiving Davis the Sweepstakes Award for their performance and for music commended at the Maytime Band Review, at National City, May 1, 1965.
