RECOMMENDATION
There is no recommendation. This report is for information only.
BACKGROUND
A status report was requested regarding the El Patio Restaurant. As Council is aware, the restaurant has
been a nonconforming use since 1982, and the current owners desire to sell the business. The potential
new buyers would like certainty that the restaurant will be allowed to continue before committing to
purchasing the business. The attached memo was provided to the City Council last year as background
information regarding this issue.
CURRENT STATUS
As explained to the broker, Mr. Jerry Baker and a prospective buyer last year, the new General Plan and
Development Code will propose allowing greater flexibility, and encouraging mixed uses that are of a
neighborhood-serving character. This concept was supported in the neighborhood meetings of the
Citizen Congress held last year, and if ultimately adopted as part of the General Plan and Development
Code, the restaurant would be allowed to remain indefinitely.
Because the General Plan must go through a public hearing process, no commitments can be made at
this point that the proposed concept will actually be adopted as part of the new General Plan. In an
attempt to provide a level of comfort to the business owners concerning this matter, Staff has written a
letter to Mr. Baker mentioning the proposed General Plan and Development Code concept to allow
neighborhood-serving uses in residential areas.
The General Plan Citizen Congress is scheduled to again convene on April 12, 2003. At this event,
citizens will be asked to approve the essence of the General Plan concepts, as well as suggesting
implementation measures. Following that event, final detailed draft documents will be completed for
the EIR process. It is anticipated that the public hearing process will occur in August/September of this
year.
