SUBJECT: AMENDMENT TO RESOLUTION 8636 ESTALISHING ACCESS TO STATE AND LOCAL
CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT, LICENSING OR CERTIFICATION
RECOMMENDATION
It is recommended that City Council adopt the attached resolution authorizing amendment to Resolution
8636, to enable the City to access summary criminal history information (resulting from fingerprints) for
employment to include volunteers and contract employees.
BACKGROUND
The City of Azusa utilizes the Department of Justice Criminal Offender Record Information (CORI)
system. Several City departments utilize CORI during the course of work including the Police
Department for criminal history, Community Development fro licensing and Human Resources for pre-
employment processing.
On May 14, 2003 the Department of Justice (DOJ) conducted an on-site audit of the Criminal Offender
Record Information (CORI) system. The audit was intended to provide appropriate staff with up-to-date
training and ensure general compliance related to CORI records storage, security, destruction,
dissemination, and reproduction.
The City’s Resolution 8636, originally adopted in June 1989, authorized the City to access State and Local
criminal history information for employment, licensing or certification purposes. The DOJ audit
determined that this resolution must be updated to enable the City to utilize CORI for volunteers and
contract employees. Currently the resolution does not specify use of CORI for these purposes.
Therefore, an amendment to Resolution 8636 is requested at this time.

There is no fiscal impact.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING
RESOLUTION 8636 AUTHORIZING THE CITY TO ACCESS STATE AND LOCAL SUMMARY
CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT, LICENSING OR CERTIFICATION
PURPOSES
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) authorize cities, counties, and districts to
access state and local summary criminal history information for employment, licensing, or certification purposes;
and
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) require that there be a requirement or
exclusion from employment, licensing, or certification based on specific criminal conduct on the part of the subject
of the record; and
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) require the City Council, Board of
Supervisors or governing body of a City, County or District to specifically authorize access to summary criminal
history information for employment, licensing or certification purposes;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Azusa does hereby authorize to
access summary criminal history information for employment (including volunteers and contract employees),
licensing or certification purposes; and
PASSED AND ADOPTED by the City Council of the City of Azusa at a regular meeting held on the 2nd day of
June 2003.
