Mayor Memmesheimer called the meeting to order and led in Call to Order salute to the flag. Invocation was given by Rev. Paul Farrell of First Christian Invocation Church. ' The City Clerk presented the Affidavit of Proof of Publica- Warshawer) tion of the Notice of Public Hearing, published on 9/6/65 in the Azusa Herald and Pomotropic. A memo was submitted from the Planning Department stating that the General Plan has recommended that this triangular portion between the Little Dalton Wash, north from Arrow Highway be commercial (Office -Institutional). The property under consideration is an area which lends itself to commercial development. This area combined with the County area (Valleydale) at Clydebank to the west is more logically commercial than resid- ential. The request for a zone change was recommended by the Planning Commission. Mr. W. Warshawer addressed Council and stated that at the time the property was originally zoned they were unable to find a commercial tenent, now it appears he has an offer from someone to buy a piece of the property. There being no written communications in protest and no one appearing in opposition, it was Moved by Councilman Rubio, seconded by Councilman Solem and unanimously carried that the hearing be closed. The Mayor read in full a Resolution approving the termination of certain Covenants and Restrictions. Councilman Solem offered for adoption the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE TERMINATION OF CERTAIN COVENANTS AND RESTRICTIONS. Moved by Councilman Solem, seconded by Councilman Rubio that the Resolution be adopted. Resolution passed and adopted by the following vote of Council: AYES: Councilmen: Rubio, Cooney, Solem, Memmesheimer NOES: Councilmen: None ABSENT: Councilmen: McLees and numbered Resoltuion 4902. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried that the new Declaration of Covenants and Restrictions be accepted, subject to checking of the legal description by the City Engineer. The City Clerk presented a complaint from Mr. Carl Rukasin, owner of the apartment building at 316 N. Alameda Avenue, re: substandard condition of buildings to the south. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that abatement proceedings be Compalint re; substandard bldg. at 316 N. Alameda Ave. The City Clerk submitted a request from Youth for Christ, Req, for Aud. Inc. for use of the Azusa Civic Auditorium on the first use by Youth and third Saturday nights of each month from 7:00 until for Christ,Inc, 9:00 p.m., beginning September 18, 1965. Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried that the request be granted as previously, except that arrangements be made for payment of custodial services at overtime rate, through the City Clerkts Office. The City Clerk presented a memo from Glenn Watson who Res. #4901 represents Fred Heyden in requesting a proposed amendment adopted re: to Condition #4, in Resolution #3546. In Condition #4 the access road special use permit provided: "Access north from Huntington to Fish Canyon Drive", the request is that this condition be modified to Road permit access from Fish Canyon within 1100 feet north from Huntington Drive. The City Clerk requested that those attending the League of California Cities Conference notify his office, as the advance registrations must be made immediately. The City Clerk again broughtbefore Council the request from Irwindale Raceway, Inc., for water service from the City of Azusa deferred from 9/7/65. After discussion, it was Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried to table and refer to the City Attorney, Superintendent of Light & Water and City Engineer for further study re: water service requested by Raceways, and also investigate other water uses further in that manufacturing area, for report as soon as possible. Davis, builder of Tract #2847, deferred from the meeting of 9/7/65, re: the matter of the City paying the difference in cost between a 8" and 12" water line, was again brought before Council. Req. frm. M. Davis, builder for City to pay for larger water lines Mr. Davis addressed Council and explained that an 8" line was sufficient to serve the construction he proposed, but that 'the larger line would serve other tracts, for future developments. It was suggested that item G of Planning Commission Resolution #547 be modified to state planting materials, shall be required, along the west property line, subject to the approval of the Planning Department. The City Treasurer's Financial Statement was submitted showing a balance of $1,180,508.09 as of August 31, 1995. Notice was given that the Planning Commission requested approval of a relocation permit for the removal of house and garage from 428 E. First Street to 161 N. Alameda Avenue (Ruth Rameriz). Moved by Councilman Solem, seconded by Councilman Rubio and unanimously carried to accept the recommendation of the Planning Commission to grant relocation permit. Notice wasiven that the Planning Commission, by Resolution #555 granted a Variance for parking at 710 N. Azusa Avenue. No action taken by Council. Notice was also given that the Planning Commission by Resolution #556 granted a CUP for manufacture of explosive detonating device and storage not in excess of 25# of P.E.T.N., at 352-254 S. Irwindate Avenue. No action taken by Council. An Ordinance was presented for second reading and adoption amending the Municipal Code re: Stop Intersections designation by Resolution. Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried to authorize Superintendent of Public Works to construct the sewer line as soon as possible.
