Mayor Memmesheimer called the meeting to order and Call to Order led in the salute to the flag. ' Invocation was given by Rev. Roy W. Durnal of Foothill Invocation Park Baptist Church Present at Roll Call: Councilmen: Rubio, Cooney, Solem, Roll Call McLees, Memmesheimer Also Present: City Attorney Williams, City Administra- tor Foxworthy, City Engineer Sandwick, Superintendent of Light & Water Smith, City Clerk Miller, Deputy City Clerk Roehrich The Minutes of the meeting of October 18, 1965 were A pvl.Min. approved as submitted. 10 5 U The hour of 7:30 p.m. being the time set for the public Pub.Hrg. on C� hearing on a zone change from "P" to "C-2" on four zone change parcels and R -3c on 1 parcel of land south of First from "P" to Street (P.C. initiated - Case Z-130 - Planning Commission "C-2" (Case Resolution #557), the Mayor declared the hearing open. Z-130-P.C. Moved by Councilman Solem, seconded by Councilman Mc Lees and unanimously carried that the hearing be closed. ' Moved by Councilman Cooney seconded by Councilman Solem and unanimously carried that the recommendation of the Planning Commission be accepted and the City Attorney Vrepare an Ordinance changing four (4) parcels to 'C-2" and 1 parcel to "R -3c" zoning. The hour of 7:30 p.m. being the time set for the public hearing on a proposed amendment to the Circulation Element of the Comprehensive General Plan, to relocate general alignment of certain streets and highways. (P. C. Res. #558), the hearing was declared open. Moved by Councilman Sol6m seconded by Councilman Cooney and unanimously carried to close the hearing. Moved by Councilman Solem seconded by Councilman Cooney and unanimously carried that Council adopt revised plan according to P. C. Res. #558 and that the City Attorney prepare the necessary Resolution for amendments. The hour of 7:30 p.m. being the time set for the public hearing on an appeal from -denial of_Variance to permit an M'-1 use in an R -3c zone and also request for exemp- tion of off-street,:parking requirements for M-1 use, on property at 310 N. Alameda Ave.(P.C. Res. #562 - ' Case V-142 - 0. H. Costill). Moved by Councilman Mc Lees seconded by Councilman Cooney and unanimously carried to continue the hearing to 11/15/65 meeting, to check City records and for Mr. Costill to attempt to obtain off-street parking facilities. The hour of 7:30 p.m. being the time set for the public hearing on an Appeal from denial of Conditional tse Permit to establish an auto -wrecking yard at 1125 W. M-4 I 1 CITY HALL AZUSA, CALIFORNIA MONDAY, NOVEMBER 1, 1965 Gladstone Street. (P. C. Res. #561 - Case C-54 - H. M. Vallentine). Moved by Councilman Cooney seconded by Councilman Rubio and unanimously carried that the hearing be closed. Moved by Councilman Cooney seconded by Councilman Rubio and unanimously carried that the motion to close the hearing be amended to provide that hearing be continued to 11/15/65 at 7:30 p.m., for sole purpose of hearing any testimony or solution to the question of access to property at rear of the subject property. The hour of 8:00 p.m. being the time set for a Continued Public Hearing on the vacation of portion of Donna Beth Avenue and Newburgh Street, at the intersection thereof (from 10/18/65). Work has been completed, but not inspected as of 7 p.m. *-+ Moved by Councilman Rubio seconded by Councilman Cooney cC and unanimously carried that the hearing be continued to 11/15/65 meeting. Z The City Clerk presented a claim for alleged damages to vehicle by paint specks caused by City workers, in the amount of $24.50. Moved by Councilman Cooney seconded by Councilman Rubio and unanimously carried that the claim be rejected and denied, and referred to the City's insurance carrier. ' The City Clerk presented the actuarial valuation from the State Employees' Retirement System with the amend- ment regarding Section 21264 concerning retired safety members, which states that upon the death of a retired safety member, one-half of his unmodified monthly allowance shall be continued to his widow during her lifetime or to his children under the age of 18. This will add about $14,400 per year to the City's current annual outlay of about $127,500. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried to revert this item to the members of the Finance Committee and City Administrator. Harriman to M.N. DeCamara (D.J.'s 347 S. Irwindale Avenue) Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to request the ABC to withhold issuance of license until applicatns comply with Zoning Ordinance re: parking requirements, #1. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to file, #2. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to amend motion and that the ABC be requested to withhold issuance of license until applicants comply with Zoning Ordinance re: parking requirements, #2. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to file, #3 and #4. cD U Moved by Councilman Cooney, seconded by Councilman G Mc Lees and unanimously carried to refer to the Police Chief for further action, #5. The City Clerk presented for Council consideration a memo with regards to Swap Meets. It is his recommen- dation that Section 6128.1 of Ordinance No. 851, be amended to state, in effect, that a license tax of $50.00 per year be paid in advance, plus $15.00 for ' each day the Swap Meet is conducted. Moved by Councilman Solem seconded by Councilman Cooney and unanimously carried that the City Attorney, City Clerk, and the City Administrator study the proposed changes. Moved by Councilman Mc Lees, seconded by Councilman Cooney and unanimously carried that the Bicycle Ordi- nance be amended making it a one-time deal rather than annually but re -registered upon transfer of bicycle, with Recreation Department to handle licensing. Moved by Councilman Mc Lees, seconded by Councilman Cooney and unanimously carried that permission be granted for auction sale of vacant stores @644-646-648, and 650 North Azusa Avenue, by Mitchell Co., November 14 or 21. A letter was submitted by the Park and Recreation Commission regarding the selection of a suitable name for the park site at 1st and Virginia Avenues. The Commission Members are in agreement that they would like to invite suggested names from interested persons, particularly 6th grade students at Paramount and ' Mountain View Schools. Moved by Councilman Mc Lees, seconded by Councilman Solem and unanimously carried that the Park & Recrea- tion Commission be authorized to select a name for the park site at 1st and Virginia, in manner suggested in their letter or otherwise, to be submitted for Council approval; also that Council agrees to refrain from naming this Park after a particular individual. Page 3 Amend Sec. 6128.1 M.C. re: Swap Meet Ltr.from P&R Comm.re:naming park site at 1st & Virginia Avenues Notice was given that the Planning Commission by Resolu- P.C.Res..#565 tion No. 565 initiated a hearing on amendment to the amend.Zoning Zoning Chapter of the Municipal Code relating to pro- Chapter vision for increased parking requirements for R-2 uses. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the request be denied. The City Clerk presented a request by X1 Epsilon Zeta Chapter of Beta Sigma Phi International to have a rummage sale, on 11/6/65 at 630 North Azusa Avenue. Moved by Councilman Solem, seconded by Councilman Mc Lees and unanimously carried that permission be granted. An Ordinance was presented for second reading and adoption amending Sec. 5210.7 of the Municipal Code relating to rubbish and/or garbage collection fees. A proposed Resolution was presented, declaring inten- tion to vacate a portion of 1st Street from westerly line of Lot #29, westerly for a distance of 950.03 feet; (hearing on 12/6/65). Councilman offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE TERMINATION OF CERTAIN COVENANTS AND RESTRICTIONS. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that further reading be waived. Res.#4920 declaring intention to vacate portion of 1st St. (hrg.12/6/65) Moved by Councilman Cooney, seconded by Councilman Solem that the Resolution be adopted. He is filling the vacancy created by the disability retirement of Mr. Sammie Crouch. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the appointment be confirmed. The Superintendent of Light & Water submitted a request from the Southern California Edison Company for per- mission to supply temporary power to the Main Building Co., located at 761 S. A letter was received from the County Road Department ' that traffic signals are not recommended now for the intersection of Citrus and Mauna Loa, but they will design left turn channelization and cooperate with the City on installation of same. The City Clerk read in full a Resolution authorizing payment of warrants by the City.
