HomeMy WebLinkAboutE-7 Staff Report - California Metro Patrol Inc Second AmendmentCONSENT ITEM E-7 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ANN GRAF, DIRECTOR OF INFORMATION TECHNOLOGY & LIBRARY SERVICES DATE: DECEMBER 7, 2020 SUBJECT: REQUEST TO APPROVE SECOND AMENDMENT TO AGREEMENT WITH CALIFORNIA METRO PATORL FOR SECURITY SERVICES BACKGROUND: In January of 2018 the City Council approved an agreement with California Metro Patrol to provide Security Services for the Library and City Hall Campus. The City’s primary interest is to ensure the safety of City employees, residents and City guests. The proposed action approves a one-year extension to the Security Services Agreement and increases the annual not to exceed amount to $116,500. RECOMMENDATION: Staff recommends the City Council take the following action: 1)Approve the second amendment to California Metro Patrol to increase the not to exceed annual amount to $116,500 including a one (1) year extension; and 2)Authorize the City Manager to execute an amendment to the contract, in a form acceptable to the City Attorney, on behalf of the City; and 3) Approve necessary budget amendments and adjust the current fiscal year budget accordingly. ANALYSIS: In March of 2016, the Metro Gold Line station in the Azusa Downtown area opened and the result has been an increase in the number of guests visiting the Library, Senior Center and City Hall Campus vicinity. Some of these visits have resulted in trespassing and incivility behavior toward staff and patrons. APPROVED CITY COUNCIL 12/7/2020 Second Amend – California Metro Patrol December 7, 2020 Page 2 On January 16, 2018, City Council awarded a Security Services Agreement with California Metro Patrol. The Contract has been effective from January 17, 2018 and is due to expire January 16, 2021. The city purchasing policy requires that additional one–year extensions of the contract be considered by the City Council. The Second Amendment would extend the contract for a final year through January 16, 2022. Additionally it would approve an annual increase of $27,000 to a not-to-exceed annual amount of $116,500 to the current year and final year of the Contract. FISCAL IMPACT: Upon Council approval of the recommended actions, staff will prepare a FY 2020-2021 budget amendment in the amount of $51,000 under 10-90-000-000-6493. This Second Amendment to the Agreement for Security Services (“Second Amendment”) is entered into on the ____ day of December, 2020, by and between the City of Azusa (hereinafter referred to as the “City”) and California Metro Patrol (hereinafter referred to as the Consultant. City and Consultant are sometimes collectively referred to herein as the “Parties.” 2.RECITALS. 2.1 Agreement. The Parties entered into that certain Agreement for Security Services dated January 17, 2018. (“Agreement”). 2.2 Second Amendment. The Parties now desire to amend the Agreement in order to renew the Agreement for an additional one-year term and increase the total compensation under the Agreement. 3.TERMS. 3.1 Term. : Pursuant to Section 3.1.2 of the Agreement, the City hereby exercises the option to renew the Agreement and extend the term of the Agreement for one year from January 17, 2021 to January 16,2022, unless earlier terminated as provided in the Agreement. 3.2 Compensation. The total compensation for the Services provided pursuant to this Second Amendment shall not exceed One Hundred Sixteen Thousand Five Hundred Dollars, ($116,500) annually without written approval of the City Manager. Consultant shall receive compensation, including authorized reimbursements, for all Services rendered under this Second Amendment. 3.3 Remaining Provisions of Agreement.
