Mayor Memmesheimer called the meeting to order and led in the salute to the flag. Invocation was given by Rev. B. J. Paroulek of the ' First Presbyterian Church. Present at Roll Call: Councilmen: Rubio, Cooney, Solem, Mc Lees, Memmesheimer Absent: Councilmen: None Also Present: City Attorney Williams, City Administra- tor Foxworthy, City Engineer Sandwick, Superintendent of Light & Water Smith, City Clerk Miller There being no corrections or additions, the Council Actions of the meeting of November 15, 1965 were approved as submitted. AThe City Clerk announced that bids were opened in the office of the City Clerk at 10:00 A.M., on Friday, December 3, 1965, for the purchase of two (2) trucks for the Light and Water Department. Present at bid opening were Councilman Mc Lees, City Engineer Sandwick, Superintendent of Light and Water Smith and City Clerk Miller. The City Clerk presented the Affidavit of Proof of Publication of Notice Inviting Bids published in the Azusa Herald November 21, 1965. Three bids were received as follows: Amount of Bid Davies Chevrolet, Inc. $4,529.67 Ben Barclay Ford 45529.68 Russ Davis Ford 4,921.19 A communication was received from Superintendent of Light and Water Smith with a recommendation that the bid be awarded to the low bidder, Davies Chevrolet, Inc. subject to compliance with specifications established by the Light and Water Department. Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried that the recommendation of the Superintendent of Light and Water be accepted and bid awarded to Davies Chevrolet, Inc., low bidder, in the amount of $4,529.67, subject to compliance with specifi- cations determined by the Superintendent of Light and Water, and that bid bonds or checks be returned to the unsuccessful bidders. The hour of 7:30 P.M. being the time set for the Public Hearing the Mayor declared the hearing open on the pro- posed amendment to Article IX, Chapter 2 of the Munici- pal Code relating to Drive -In Businesses permitted under a Condithnal Use Permit, and recommended by the Planning Commission per Planning Commission Resolution No. 568. The City Clerk presented the Affidavit of Proof of Pub- lication of Notice of the Public Hearing published in the Azusa Herald November 21, 1965, together with the analysis and recommendation of the Planning Commission. 7:30 P.M. m 77 J 1 r 1 L CITY HALL AZUSA, CALIFORNIA MONDAY, DECEMBER 6, 1965 There being no one in the audience wishing to speak either in favor or in protest, it was Moved by Councilman Rubio, seconded by Councilman Mc Lees and unanimously carried that the hearing be closed. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the recommendation of the Planning Commission be accepted as set forth in Planning Commission Resolution No. 568, and that the City Attorney be instructed to prepare the nec- essary Ordinance. The hour of 7:30 P.M. also being the time set for the Public Hearing on the proposed amendment to the Municipal Code relating to the Distance Between Buildings in the R-1. R-2, and R-3 zones, as recom- mended by Planning Commission Resolution No. 569, the Mayor declared the hearing opened. The City Clerk presented the Affidavit of Proof of Publication of Notice of the Public Hearing, together with recommendation from the Planning Director. There being no one in the audience wishing to speak either in favor or in protest to the proposed zone change, it was Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that the hearing be closed. Following discussion with the Planning Director regarding the distance between garage and main building in R-1 zone and the feasibility of further study of this amendment, it was Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to rescind the previous motion to -=close the hearing. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the public hearing be continued to the meeting of December 20, 1965, with a request for a report as to what restrictions, if any, are required by the Building Code. The hour of 7:30 P.M. also being the hour set for the Public Hearing on the proposed amendment to the Muni- cipal Code relating to Provisions for Increased Park- ing Requirements for R-2 uses, as set forth in Plan- ning Commission Resolution No. 570, the Mayor declared the hearing opened. The City Clerk presented the Affidavit of Proof of Publication of Notice of the Public Hearing, together with the recommendation of the Planning Director. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that the recommendation of the Planning Commission be accepted and the City Attorney be authorized to prepare the necessary Ordinance. 252: 1 1 1 05 1 CITY HALL AZUSA, CALIFORNIA MONDAY, DECEMBER 6, 1965 Page 3 Mrs. Donald J. DeCamara, 18214 Woodcroft Street, appeared before Council relative to their applica- tion for an On -Sale beer license, having been referred to the Chief of Police at the November 1, 1965 meeting, and stated that a second hearing was held before the Alcoholic Beverage Control, who said, if the Chief of Police drops the protest, the ABC will issue the license. Mrs. DeCamara reviewed the past record of her husband and the history of their residence in the area, and requested that Council reconsider the matter. Mr. Bill Fox. realtor, 604 North Azusa Avenue, West Covina, addressed Council and stated that he spoke to Police Chief Kendrick, who told him that no further action on the withdrawal of the protest would be taken until the matter was presented to Council. After further discussion, it was Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that this matter be referred to the City Administrator and the Police Chief for study and evaluation of conditions, with authority to revoke the protest previously filed, if in their opinion, they consider this is warranted. A written protest was received from Mr. James G. Aszman, 19826 Navilla Place, Covina, regarding a charge of $7.50 for weeds cleared on Lots 33, 343 and the north 24 ft. of Lot 35, Block 77, Map of Azusa. Mr. Aszman stated in the communication that the property is completely asphalted, is used as a used car lot, and that no signs were posted on the property. A report from the Superintendent of Public Works advised that considerable debris and some weeds were removed from the rear of the lot and records indicate that material was collected and hauled to the dump. In checking further, it was determined that the property had been properly posted, and the $7.50 charge is for the actual work of clean-up of debris. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the protest be rejected. A communication was received from Li'l Gabriel Cadet Band Squadron #11, California Wing, Civil Air Patrol, requesting permission to hold a fund-raising candy sale by soliciting door-to-door, commencing December 6th and continuing until December 18th. re:ABC license @347 S.Irwindale Ave.(DeCamara) Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that permission be granted. It was suggested by Council that the Squadron also be advised that any future requests be sub- mitted in sufficient time for Council consideration and action at a Council meeting prior to the intended date of sale. A communication was received from the Signal Hill City Council, urging membership in the Independent Cities of Los Angeles County with an invitation to attend their next meeting of Independent Cities on December 15, 1965, in the Rodger Young Auditorium, at 7:30 P.M. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that a letter be directed to the City Council of Signal Hill, thanking them for their invitation and extending their regrets that 25'6. 1 1 CITY HALL AZUSA, CALIFORNIA MONDAY, DECEMBER 6, 1965 Councilmen are unable to attend the meeting due to previous commitments; also advise that they would be pleased to attend another meeting in the future. A communication was received from Mr. Robert A. Elliott, secretary, B.P.O. Elks #2038, requesting the loan of tables and chairs for their annual ' Christmas Charity Ball to be held at the Lodge Hall on December 11, 1965, and inviting Council members to attend. After discussion regarding policy established by Council that City equipment may not be loaned for other than City use, the City Administrator informed Council that the Recreation Department does not have 50 tables as requested. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the City Adminis- trator be instructed to write a letter to the B.P.O.E. Lodge #2038 informing them of Council policy regard- ing use of City -owned property, advising them, there- fore, that the request must be denied, and thanking Gr1� them for their invitation, which will be accepted.by any Councilman able to attend the event on December 11th. A communication was received from the Azusa Chamber of Commerce requesting the Mayor to issue a Procla- mation declaring December 15, 1965, as "Jack Benny Day in Azusa". ' After discussion, it was Moved by Councilman Cooney, seconded by Councilman Mc Lees and unanimously carried that the Mayor be authorized to sign the Proclamation as requested. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that a plaque be prepared, making Jack Benny an honorary citizen of Azusa. A report was submitted by the Finance Committee and City Administrator regarding an amendment to the State Employees Retirement System program for safety members by the addition of Section 21264 of the Retirement Law relating to the safety members' retirement benefit program. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that the City Adminis- trator be authorized to proceed with a survey of the safety member employees to determine the majority of opinion, and report back to Council. A letter of resignation from the Planning Commission ' was received from Mr. Robert Kesler, dated November 1T, 1965. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that Mr. Kesler's resignation be accepted with a letter to be sent to Mr. Kesler, accepting the resignation with regret, and expressing appreciation for his services; and that a plaque be prepared and sent to him. Mayor Memmesheimer offered the name of Mr. W. Wesley Kloepfer, and Councilman Cooney submitted the name of Mr. Cecil V. Romero as nominees to serve the balance of Mr. Kesler's term, which expires June 30, 1966. Notice was received from the Department of Alcoholic ' Beverage Control of a premises -to -premises transfer of application of Veterans Club License and Caterers Permit License by V.F.W. Azusa Post 8070, Inc., to premises at 250 East 1st Street, with an approximate completion date -in six months. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the Notice be filed. A communication was received from the Azusa City Employees Association inviting the Councilmen and t- their families to their Family Christmas Party to be kj held at the Recreation Building on Saturday, December V 185 1965, from 4:00 P.M. to 8:00 P.M., and also requesting permission to use a City truck for Christ- mas caroling on Saturday evening, December 18th. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that permission be granted for the use of a Light and Water or Public Works truck by the City Employees Association, as requested, providing a qualified City employee is driver. ' The City Clerk asked Council's wishes regarding send- ing Christmas cards from the Council to cities listed in the roster of the Los Angeles County Division of the League and the Board of Supervisors. Motion carried by the following vote: AYES: Councilmen: Rubio, Cooney, Solem, Memmesheimer NOES: Councilmen: Mc Lees ABSENT: Councilmen: None The hour of 8:00 P.M. being the time set for a public Pub.Hrg. on hearing on the vacation of a portion of First Street street vacation from the westerly line of Lot 29, Subdivision #2, portion of 1st St. Azusa Land and Water Co., westerly for 950.03 ft., the hearing was declared opened by the Mayor. The City Clerk presented the Affidavit of Proof of Publication of Resolution No. 4920, declaring intention to vacate and setting the date of hearing and also the Affidavit of Superintendent of Public Works, stating that posting of said Resolution of Intention was completed on November 4, 1965, according to law. The City Clerk stated that no communications were ' received. The City Engineer informed Council that, after inves- tigation, the Engineering Department has found it would be in the best interests of the City to proceed with this street vacation as the portion of the street described in the Resolution of Intention is unnecessary for public street purposes. Councilman McLees offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ORDERING THE VACATION OF A CERTAIN PORTION OF FIRST STREET. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that further reading be waived. Notice was given that the Planning Commission, by Resolution No. 571 (Case C-56) has granted a Conditional Use Permit to permit the continuance of an auto wreck- ing yard at 1160 West Gladstone Street, as requested by William Zellers. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the notice be filed. Notice was also given that the Planning Commission, by Resolution No. 572, has approved the Tentative Tract Map #21464, with conditions, which was filed by Kenneth and Kathleen Barnard, Cecilia Phipps, and Martin and Jacklyn Burns. Notice was also given that the Planning Commission, by Resolution No. 573, has initiated zoning hearings on two parcels of property at 302 East 1st Street from zone R -lc to zone C-2, and at 250 East 1st Street, from zone R -3c to zone C-2. Notice was also given that the Planning Commission, by Resolution No. 574, has initiated a hearing on an amendment to the Zoning Chapter of the Municipal Code relating to the deletion of "Auto Wrecking Yard' and Junk Yard Establishments" from Section 9215.20 (M-2 - General Manufacturing Zone). Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that the above notices covering Planning Commission Resolutions numbered 572, 573, and 574 be filed. ' Mr. Harold M. Vallentine, 17469 East Sierra Madre Avenue, appeared before Council regarding a set -back requirement on property at 1125 West Gladstone Street. Moved by Councilman Cooney, seconded by Councilman McLees to change one condition of Conditional Use Permit by establishing building and frontage wall set- back to 50 ft. from centerline of Gladstone Street (instead of 55 ft.) Res. # 4934 adopted, granting Conditonal Use Permit, subject to conditions imposed by Planning and incorporating change in set back. A communication was received from the Chief of Police, together with a letter of resignation effective Decem- ber 4, 1965 from Lieutenant Paul E1 Sheehan, and requesting Council confirm resignation and remove the name from the payroll. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the resignation be accepted. A communication was received from the Chief of Police recommending the confirmation of the appointment of Richard Lara as Police Lieutenant, probationary, ' effective December 4, 1965, at Step 4, Range 26. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that the appointment be confirmed as recommended. Presentation of Plans and Specifications for Garage and Warehouse Building to be located in the City Yard were submitted by City Engineer Sandwick with a recom- mendation for approval of the plans and specifications and authorization for the City Clerk to advertise for bids. 208 1 1 CITY HALL AZUSA, CALIFORNIA MONDAY, DECEMBER 6, 1965 Page 10 Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried that the plans and specifications be approved. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried that the City Clerk be authorized to advertise for bids, to be opened ' on January 14, 1966. A communication was received from Mr. David Hermanson requesting that the City construct a concrete cross gutter and gutter at the northwest corner of Foothill Blvd. and Lucky Avenue, together with a recommendation of the City Engineer that the request for the construc- tion be approved an an estimated cost of $650.00. Moved by Councilman Cooney , seconded by Councilman Mc Lees and unanimously carried that the recommenda- t- tion of the City Engineer be accepted and authoriza- Z tion be given for the expenditure of $650.00 for the in construction. U A Resolution was presented approving an agreement for supplying electrical energy for power and lighting service between the B & B Heat Treating Co. located at 752 North Loren Avenue, and the City. Councilman Mc Lees offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ' APPROVING AGREEMENT FOR ELECTRICAL DISTRIBUTION FACIL- ITIES AND ENERGY BETWEEN THE CITY OF AZUSA AND B. & B. HEAT TREATING CO. Moved by Councilman McLees,.seconded by Councilman Solem and unanimously carried that further reading be waived. A communication was received from the Superintendent of Light and Water, together with a letter from Mr. Ben H. Davis, 208 North Azusa Avenue, requesting that an alley light be installed at the rear of store parking lot, estimated cost of installation $125.00. Moved by Councilman McLees, seconded by Councilman Rubio and unanimously carried that Superintendent of Light and Water be authorized to install necessary light at 208 North Azusa Avenue. The proposed agreement with the Southern Pacific Com- pany with respect to the opening of Todd Avenue, Crossing No. 6TD-23.15, was presented for Council consideration. Notice was given of the hearing before the Public Utilities Commission regarding the Todd Avenue crossing set for January 5 to 7, 1966. No action was taken by Council. Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID . A notice and list of inventory was received of an auction to be held at Anaheim. Moved by Councilman Rubio,seconded by Councilman Cooney and unanimously carried that the City Admin- istrator, City Equipment Mechanic and Superintendent of Public Works be authorized to attend the auction in Anaheim, to inspect and bid on Weaver Hoist regarding purchase at reasonable cost. Commission hearing, Supervisor Bonelli commended Azusa on its annexation program.
