The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. This meeting was held via teleconference only. Mayor Pro-Tem Macias called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: MACIAS, ALVAREZ, AVILA, MENDEZ ABSENT: COUNCILMEMBERS: GONZALES ALSO PRESENT Elected Officials: City Clerk Cornejo. Staff Members: City Manager Gonzalez, City Attorney Martinez, Director of Economic and Community Development Marquez, Director of Administrative Services Johnson, Deputy City Manager DeAnda-Scaia and Chief Deputy City Clerk Garcia. PUBLIC COMMENT None. CLOSED SESSION The City Council recessed to closed session at 6:31 P.M. to discuss the following: 1. CONFERENCE WITH LABOR NEGOTIATORS - Pursuant to California Government Code, Section 54957.6. City Negotiator: Sergio Gonzalez, City Manager and Talika Johnson, Director of Administrative Services Organizations: PMA (Police Management Association) and Unrepresented Employees. 2. CONFERENCE WITH REAL PROPERTY NEGOTIATORS – Pursuant to California Government Code, Section 54956.8. City Negotiators: Sergio Gonzalez, City Manager Property Address: 890 The Promenade Negotiating Parties: Los Angeles County Metropolitan Transportation Authority Under Negotiation: Price and Terms for Lease 3. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Pursuant to California Government Code, Section 54956.9(d)(2). 1 Possible Case: Liability Claim No. 3000375 Café Cultura Sewer Spill Agency Claimed Against: City of Azusa REGULAR SESSION Mayor Pro-Tem Macias called the meeting to order at 7:30 P.M. The Pledge of Allegiance was led by Mayor Pro-Tem Macias. CITY COUNCIL ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: MACIAS, ALVAREZ, AVILA, MENDEZ ABSENT: COUNCILMEMBERS: GONZALES ALSO PRESENT Elected Officials: City Clerk/Secretary Cornejo. Staff Members: City Manager Gonzalez, City Attorney Martinez, Chief of Police Bertelsen, Director of Economic and Community Development Marquez, Director of Administrative Services Johnson, Director of Utilities Robledo, Director of Public Works/City Engineer Delgadillo, Director of Information Technology and Library Services Graf, Director of Community Resources Carpenter, Deputy City Manager DeAnda-Scaia, and Chief Deputy City Clerk Garcia. CLOSED SESSION REPORT The City Council reconvened at 7:30 P.M.; City Attorney Martinez announced the following regarding Closed Session: Mayor Gonzales was absent; Item 1 –No reportable action; Item 2 – No reportable action and Item 3 – No reportable action; CEREMONIAL None PUBLIC COMMENT None REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL City Manager Communications. City Manager Gonzalez announced that the virtual tree lighting ceremony took place and was aired on channel 3; stated that Mayor Gonzales is battling Covid-19 and was unable to participate in the ceremony; provided an update on Covid-19 stating that there are 2,445 positive cases and 31 lives lost in the City of Azusa; announced that the State has issued a Regional Stay at Home Order and provided information regarding the Order; and provided information regarding available resources for local businesses and residents. Council Comments Councilmember Avila congratulated the eight retirees and expressed his gratitude for their years of service; wished Mayor Gonzales a speedy recovery; sent thoughts and prayers to all of the individuals that tested positive for the virus and the families of the individuals that lost their lives; and thanked Staff for continuing to serve the community during the pandemic. Councilmember Alvarez congratulated the eight retirees and thanked them for their many years of service; stated that it was Pearl Harbor Remembrance Day; encouraged everyone to patronize Azusa businesses; and announced that Christmas boxes will be shipped to active-duty Azusa military personnel and encouraged everyone to contact him with their names and addresses. Councilmember Mendez wished Mayor Gonzales a speedy recovery; expressed his appreciation of the eight retirees; stated that it was Pearl Harbor Remembrance day and thanked Mayor Pro-Tem Macias and Councilmember Alvarez their service; thanked Staff for the virtual tree lighting ceremony; announced that Santa Claus will be driving through Azusa on December 19; a food giveaway is being coordinated with Assemblywoman Blanca Rubio, details will be available shortly; and encouraged everyone to purchase from local restaurants. Mayor Pro-Tem Macias congratulated the eight retirees on their accomplishments; requested an update regarding status of the 890 Promenade Project; inquired about whether street sweepers are required to use water mist to keep down the dust; wished a Happy 85th Birthday to Julia Aldana; and thanked Director of Community Resources and Staff for the beautiful tree lighting ceremony. City Manager Gonzalez provided an update on the 890 The Promenade project stating that Staff is in the final stages of negotiating a long-term lease with Metro which would provide additional security in the area; upon completion of negotiations, the final lease agreement will be presented to the Council for approval. Director of Public Works/City Engineer Delgadillo responded to the inquiry regarding the street sweeper use of water stating that the street sweepers have access to water and have the ability to connect to fire hydrants to fill up; the lack of water use may be due to a maintenance issue; and he will follow-up with Athens Services to ensure that the street sweepers are being maintained. SCHEDULED ITEMS – CITY COUNCIL None PAGE TWO – 12/21/2020 CONSENT CALENDAR: Moved by Councilmember Alvarez, seconded by Councilmember Avila and carried by the following vote of the Council, to approve Consent Calendar Items E-1-E-7, E-10 and E-11 with the exception of Items E- 8, E-9 and E-12 which was handled under the Special Call portion of the Agenda. The minutes of the Regular Meeting of December 21, 2020 were approved as written. 2. Resolution No. 2020-C71 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items, in accordance with the City of Azusa Civil Service Rules Section 5.75 and applicable Memorandum of Understanding(s), were approved as follows: Merit Increases/Regular Appointments: A. Tohmeh, M. Garcia, A. Devezin, Y. Cardenas, L. Ferrari, J. Rush, F. Vasconcelos, B. Munoz. Separation/Retirement: R. Camarena, D. Ursua, M. Orta. 4. The maintenance agreement with Motorola Solutions for all current software programs for the period of December 1, 2020 through November 30, 2021 in the amount of $76,713.06 was approved; and the City Manager was authorized to execute the maintenance agreement on behalf of the City. 5. Accepted the LSTA Grant award from the California State Library; and Approve necessary budget amendments and adjust the current fiscal year budget accordingly was approved. 6. Authorize staff to solicit a Request for Qualifications for on-call public works general services was approved. 7. The issuance of a purchase order to Consolidated Electrical Distributors, LLC in an amount of $90,568.81 for the purchase of underground copper cable was approved. 10. Resolution No. 2020-C72 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA EXTENDING AND UPDATING THE PROCLAMATION OF LOCAL EMERGENCY REGARDING NOVEL CORONAVIRUS (COVID-19) 11. The assignment of the Molson Coors USA LLC Amended and Restated Water Supply Agreement dated February 23, 2009 from IBY, LLC to IBY Property Owner, LLC, was approved; and the City Manager was authorized to execute the assignment agreement. SPECIAL CALL 8. APPROVAL OF AN INTERNSHIP AFFILIATION AGREEMENT WITH AZUSA PACIFIC UNIVERSITY DEPARTMENT OF KINESIOLOGY. Approve an Internship Affiliation Agreement with Azusa Pacific University to provide Kinesiology intern(s); and Authorize the City Manager to execute an Agreement with Azusa Pacific University, in a form acceptable to the City Attorney, on behalf of the City. APPROVAL OF AMENDMENT ONE TO THE LICENSE AGREEMENT FOR USE OF NORTH RECREATION CENTER LOCATED AT 340 N. ORANGE PLACE FOR COVID-19 TESTING BY AND BETWEEN COUNTY OF LOS ANGELES AND CITY OF AZUSA. RECOMMENDED ACTION: Review and approve the amendment to the license agreement for use of city facilities for COVID testing, by and between the County of Los Angeles and the City of Azusa; and Authorize the City Manager to execute Amendment Number One to the License Agreement for use of City Facilities, in a form acceptable to the City Attorney, on behalf of the City. RECOGNITION OF NEW EMPLOYEE ORGANIZATION - AZUSA POLICE EXECUTIVE ASSOCIATION (APEA) AND APPROVAL OF MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF AZUSA AND THE AZUSA POLICE EXECUTIVE ASSOCIATION. RECOMMENDED ACTION: Adopt Resolution No. 2020-C73, acknowledging Azusa Police Executive Association (APEA) as the recognized employer organization for Police Captains for the Azusa Police Department; and Approve initial Memorandum of Understanding between the City of Azusa and the Azusa Police Executive Association January 1, 2021 through December 31, 2024. It was the consensus of the Council to adjourn the meeting.
