CITY HALL AZUSA, CALIFORNIA MONDAY, AUGUST 8, 1966
The City Council of the City of Azusa met in adjourned
regular session at the above time and place.
The meeting was called to order by Mayor Memmesheimer.
Present at Roll Call: Councilmen: Solem, McLees,
Memmesheimdr
Absent: Councilmen: Rubio, Cooney
Also Present:
City Administrator Foxworthy, City
Engineer Sandwick, City Clerk Miller
A communication was received from Latham & Watkins,
attorneys for Consolidated Rock Products Co., re: pro-
tection of quarry property by City while chain-link
fence is down along the western boundary of the existing
right of way, during construction.of Todd Avenue
extension.
Mr. Weber, of Consolidated Rock Products Co., appeared
before Council relative to the protection of the quarry
property during the Todd Avenue extension and absence of
fencing of quarry property.
After discussion, it was moved by Councilman McLees,
seconded by Councilman Solem and unanimously carried that
the City Engineer take whatever steps are necessary to
protect the City's interests and have the Police Depart-
ment alerted for illegal entry to the rock company's
property.
' The City Administrator submitted the decision of the
Court in the Consolidated Rock Products Co. case re:
Todd Avenue condemnation, which ordered that the secur-
ity deposit be increased to a total amount of $95,000,
requiring that the City deposit $56,330 additional
security. A recommendation was received from the City
Engineer that $56,330 be deposited, with any additional
funds necessary for the Todd Avenue project to be
obtained from the Gas Tax Funds.
Moved by Councilman Solem, seconded by Councilman McLees
and unanimously carried that the decision of the Court
be filed.
Moved by Councilman McLees, seconded by Councilman
Solem and unanimously carried that the recommendation
of the City Engineer be approved, and that Council
authorize the forwarding of a warrant to the County Clerk
in the amount of $56,330, as ordered by the Court.
A Resolution was presented accepting an Indenture from
Southern Pacific Company, conveying to the City a 56 ft.
roadway easement for the opening of Todd Ave. Crossing
No. 6TD-23.15.
Councilman Solem offered the following Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA
APPROVING A CERTAIN WRITTEN INSTRUMENT AND DIRECTING THE
MAYOR AND THE CITY CLERK TO EXECUTE THE SAME AND ACCEPTING
THE SAME AND DIRECTING ITS RECORDATION AFTER IT HAS BEEN
EXECUTED BY THE SOUTHERN PACIFIC COMPANY.
Moved by Councilman Solem, seconded by Councilman McLees
and unanimously carried that further reading be waived.

Moved by Councilman Solem, seconded by Councilman McLees that
the Resolution be adopted. Resolution passed and adopted by
the following vote of Council:
AYES: Councilmen: Solem, McLees, Memmesheimer
NOES: Councilmen: None
ABSENT: Councilmen: Rubio, Cooney and numbered Resolution 5086.
The City Administrator informed Council of a meeting with the
Chief of Police and two members of the Department of Alcoholic
Beverage Control re: protest filed against the issuance of an
On -Sale Beer License to Pete Lugo, Jr., for PD's Cafe, 301 N.
Dalton Ave. A report of investigation by the Alcoholic Bever-
age Control was presented to Council, stating that the circula-
tor of the petition of protest, and the persons signing it,
thought that the petition in itself would cause the premises
to be closed down, and not that the former owners, G. and T.M.
Flores, could re -open and operate the premises. It was the
Police;Chief's recommendation that he be authorized to withdraw
the protest he was previously directed to file.
Moved by Councilman Solem, seconded by Councilman McLees and
unanimously carried that the Chief of Police be authorized to
withdraw the protest filed with the Department of Alcoholic
Beverage Control against premises at 301 N. Dalton (Pete
Lugo, Jr.).
The City Administrator that a daily 4 -hour schedule be main-
tained by the County Building Inspector at the Building
Department offices, instead of the present 2 -hour period,
with such change to be conducted on a 3 -month or 6 -month trial
basis, without posting the new time schedule.
Moved by Councilman Solem, seconded by Councilman McLees and
unanimously carried that the subject of additional office
hours for the Building Inspector be placed on the 8/15/66
Agenda.
Moved by Councilman McLees, seconded by Councilman Solem and
unanimously carried that the meeting be adjourned.
