Mayor Memmesheimer called the meeting to order and led Call to Order in the salute to the flag. Invocation was given by Reverend Charles A. Bailey of First Invocation Assembly of God Church. There being no corrections or additions, Council Actions Appv11. Cncl.Act of March 6, 1967 stand approved as written. 3-6-67 mtg Service Pin Awards were to be scheduled at this time, Service Awards however, due to delay in transit, presentation will be delayed, contin. made at the next Council meeting of April 3, 1967. to 4-3-67 mtg. Bids wereopened in the City Clerk's Office on March 16, Bids for planter 1967 at 10:00 AM, for planter islands in State Highways, in Foothill Blvd Foothill Blvd., Azusa Avenue, Project 446. Only one bid & Azusa Ave. was received from Mac -Well Compriny of Van Nuys, California for a lump sum price of $11,111.11. The Engineer's estimate was $6525.00. It is the recommendation of the City Engineer that the bid be rejected and that authorization be given to Public Works Department to purchase materials on the open market and proceed with construction of the planters. 'Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to reject bid of Mac -Well Company and authorize work be done by City forces and bid security be returned. Councilman Cooney offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DECLARING THAT A CERTAIN PROJECT FOR THE CONSTRUCTION OF PLANTERS IN FOOTHILL BLVD. AND AZUSA AVE. CAN BE PERFORMED MORE ECONOMICALLY BY DAY LABOR AND THE MATERIALS AND SUPPLIES FURNISHED AT A LOWER PRICE IN THE OPEN MARKET AND ORDERING THE PROJECT DONE IN THE MANNER STATED. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that further reading be waived. Co. 31,193.00 32,294.00 It was recommended by City Engineer that in view of the fact that all bids were considerably more than the Engineer's esti- mate (21,000.00), and that the current budget is not sufficient to meet the lowest bid, that all bids be rejected with recommen- dation that Engineering Department study other roof systems, with the possibility of revising the plans and rebidding. 1 1 L' Ll CITY HALL AZUSA, CALIFORNIA MONDAY, MARCH 205 1967 Moved by Councilman Rubio, seconded by Councilman Cooney and unanimously carried to accept recommendation of Engineer and that all bid securities be returned. The City Clerk announced that bids were publicly opened in his office on March 16, 1967 at 10:00 AM for the purchase of six police units. Two bids were received as follows: Bidder Amount Bryant Pontiac, Covina, CA 75920.02 Savage Pontiac, Monrovia, CA 85793.96 It was the recommendation of the Police Chief and City Administm for that low bid of Bryant Pontiac at $7,920.02 be accepted and that security check be returned to other bidder. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried by roll call that recommendation of Police Chief and Administrator be accepted. Page 2 Bids for 6 pol. units. The deferred bid from March 6, 1967 on improvement of Aspan Deferred Bid Avenue from its present terminus southerly of Third St., Improv. Aspan to First Street (1911 Act - Assessment District No. 1965-1), Ave. was presented. Bids were opened in Council Chambers at 7:30 PM on March 6, 1967 and twelve bids were received as follows: Bidder Total Bid' Weisz & Associates $ 19,458.50 F. W. The low bidder was Weisz and Associates of 2347 Oakleaf Canyon Rd., Walnut, CA. The next lowest bidder was F. W. Richter Construction, Inc., of 80 E. Montecito Ave., Sierra Madre, CA. The bid of Weish & Associates contained an irregularity due to the fact that the bond was not property executed for: 1. bond did not state project # or any reference to this particular project; 2. bond was not dated; 3. notarial acknowledgement on bond was not dated; 4. bid did not contain the corporate seal or a resolution authorizing the signature of the party who signed; 5. there is no evidence that this contractor ever has comple- ted any project and therefore it is impossible to determine that he is a responsible bidder. After consultation with the City Attorney, it was determined that this bid should be rejected. It is the recommendation of the City Engineer that the City Council find that the bid of Weisz & Associates is irregular and insufficient; that it be rejected and that the City Council adopt a resolution to accept the second lowest bid from F. W. Richter Construction Inc., for a total of $19,720.20. Moved by Councilman Solem, seconded by Councilman Cooney to accept recommendation of Engineer to reject low bid of Weisz and Associates; to return secutiry bid bonds to unsuccessful bidders and that resolution beadopted awarding bid to Richter Construction Company. The hour of 7:30 PM being the time set for the continued Public Hearing on appeal for Variance to permit the in- stallation of advertising signs exceeding the allowable sign area and sighn height in C-2 zone, on property at 330 N. Citrus Ave. (Case V-183 - P.C. Resolution 649 - Edith A. Bowers), the Mayor declared the hearing open. It was the recommendation of the Pl&nning Directorand City Engineer that due to problems always---being-.present in a commercial development such as this (Jack In The Box) that to resolve this the following could be accomplished: 1. Redirect the lights away from the residential areas. 2. Use a softer type of lighting with less wattage, which would reduce the harshness of lighting in the area. 3. A heavier, thick, fast growing landscap6d buffer would help screen out light and noise. 4. In the event that the Council should wish to approve the pole sign, it would be advantageous to allow the higher height as applied by the applicant. Cont. Publ. Hrg. re: appeal for Var. - Bowers Also, the City Administrator presented Incident Reports from the Police Department pertaining to any police action at the location. Twenty three incidents were reported at the location between 2-28-66 and 8-26-66; no incidents reported between 8-26=66 and 2-28-67; therefore, the amount is very minimal and pertained largely to officers' observations, employees of the drive-in calling or victims calling from that location; making the calls less than 2 per month. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried to close the hearing. Moved by Councilman Solem, seconded by Councilman McLees and adopted to approve recommendation of Planning Commission subject to further conditions that lighting of new sign and existing lighting be reduced in intensity and so rearranged directed as to cause minimum interference or annoyance to adjoining property, while still permitting sufficient light; satisfaction and approval of Engineer and Planning Director and the Attorney prepare necessary Resolution. Regarding the Committee for study of downtown area, the Planning Department submitted Ed Wolfe and Wes Kloepfer, Planning Commission members, as those to serve on the com- mittee.d The Chamber of Commerce submitted Chamber members of George H. Grandstaff, First National Bank of Azusa and Anthony Benedetto, of Trude's in Azusa as members to the committee. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried to accept members selected by Planning Commission; and Chamber of Commerce for Azusa Downtown Committee, plus any other members that Committee feels necessary to be included, with notificationto Council. A request by Milton J. Wershow Company, auctioneers, for permission to hold real estate auction sale on March 29, 1967 at 10:30 AM at 501 W. Foothill Blvd., which is the sale site. Moved by Councilman Cooney, seconded by Councilman Solem and unanii1ously carried that permission be granted as requested. A request for adjustment of City's contribution to SERS ($331.37) military leave, September 1950 to December 1951, for J. W. Warrent was presented to Council. ReverendParoulek estimates the Presb.Church time needed would be approximately one hour. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried to accept recommendation of Mayor 's appointment of committee (Superintendent of Light and Water, City Administrator, Mayor, City Engineer,) to study this matter with authority to act on this request. Request was received for authorization to employ Mrs. June Req. employing Miller, Range 13-A, Step #1, $396.00 per month and Ronald J. Miller & R. Smith, Range 13-a, Step #1, $396.00 per month, as temporary Smith temp. vac. vacation relief for a period not to exceed 90 days. relief in L&W Moved by Councilman Rubio, seconded by Councilman Solem and carried that request be granted. Councilman Cooney dissenting. Request was received from the Azusa Committee on Aging, coupled with letter from Los Angeles County requesting nominations of Mr. or Mrs. or Miss Older American Azusa 'to attend the Second Annual Recognition Day for Older Ameri- cans on April 29, 1967 at the Hall of Administration, Los Angeles. The Azusa Committee on Aging requested that their body be authorized to receive these nominations and choose the worthy recipient and that Council publicly honor the person son named at the City Council meeting of April 17th, and that a certificate beawarded at that time. Req, for Mr. -Mr: or Miss Older American of Az Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried to accept request of Committee on Aging; that Committee select from nominees one person to be known as Mr., Mrs., or Miss Older American of Azusa, which name is to be submitted in sufficient time to Mayor for submission to County, in name of the Council, prior to 4-15-67 deadline. An oral report was given by City Administrator that City enter into an agreement with Tel -Plan, Inc., to study present telephone service in an effort to provide such service at a lower cost. Tel Plan - repos by C.Adm. Moved by Councilman Cooney, seconded by Councilman McLees and carried that, after approval by City Attorney, Council request study of City's telephone system by Tel -Plan, with recommendations to be submitted, without any obligation, and, if 'approved, that Mayor be authorized to sign agreement. Councilman Rubio dissenting. Report was made by City Engineer regarding Public Utilities Report on PUC Commission Hearing, Covina, California, on March 8, 1967, Hrg, by C. Moved by.i Councilman Cooney, seconded by Councilman Rubio' and unanimously carried to accept Mayor's recommendation for City Administrator, City Engineer, Mayor and at least one member of Council to attend this meeting. Councilmen Solem, McLees and Rubio are planning to attend. Councilman Cooney gave an oral report on the meeting with City Treasurer and the Finance Committeeregarding City's bank deposits and possibility of earning more interest. Mayor suggested postponement of any action until after the demands have been presented to Council at 4-3-67 meeting, to be compared with Treasurer's Statement of 3-31-67. AB 877 AB 399 Moved by Councilman Cooney, seconded by Councilman Solem SB 267 -361 -482 - and unanimously carried to authorize Mayor to sign letter 274-648 to Committee Chamirman endorsing AB 877, pertaining to preemption by State, with copies to LCC and local legislators.
