HomeMy WebLinkAboutMinutes - July 17, 1967 - CC (2)1 LJ CITY HALL AZUSA, CALIFORNIA JULY 17, 1967 The City Council of the City of Azusa met in regular session at the above time and place. 7:30 p.m. Mayor Memmesheimer called the meeting to order and led in Call to the salute to the flag. Order Invocation was given by Dr. Frank Mason of the First Baptist Invocation Church. Present at Roll Call: Councilmen: Cooney, Solem, McLees, Memmesheimer Absent: Councilmen: Rubio Also Present: City Administrator Foxworthy, City Engineer Sandwick, Superintendent of Light & Water Smith, Planning Director J. Smith, City Clerk Miller. With no corrections or omissions offered, Minutes of the adjourned meetings of June 9, 1967, June 16, 1967, and June 20, 1967, were approved as written. Council Actions of July 33 1967, were also ordered approved as written. Awards were made for service with the City of Azusa to the following persons: 1. Police Officer F. Noriega -5 years 2. Police Sergeant J. Hammond -5 years Councilman Solem presented a 5 -year service award to Police SeraPa.nt Hammond. Police Officer Noriega was unable to be present for presentation. The hour of 7:30 p.m. being the time set for the Public Hearing for the Filing Assessment and Diagram for Im- provement of Aspan Avenue in the City of Azusa, and of the time and place when all persons interested in the work done or the assessment may be heard, the Mayor de- clared the hearing opened. (For hearing protests or objections a ainst the assessment for improvement of Aspan Avenue . The City Clerk presented the Affidavit of Publication, the Affidavit of Posting, and the Affidavit of Mailing of the Notice of Filing Assessment for the improvement of Aspan Avenue. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried to receive and file the affidavits. The City Clerk stated that no written protests or objections against the assessment, the improvement as constructed, or the proceedings have been received. ' Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF ASPAN AVENUE (AD 1965-1) Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that further reading be waived. Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that the recommendation of the Planning Commission be accepted as set forth in their communication dated June 12, 1967, and that the City Attorney be instructed to prepare the necessary ordinance amending the Azusa Municipal Code. The hour of 7:30 p.m, also being the time set for the continuation of the Public Hearing from May 15, 1967, and June 5, 1967, on a proposed amendment to Article IX, Chapter 2 of the Zoning Chapter relating to Section 9230.40 (1) and (m) and further subsections pertaining to fences, the Mayor declared the hearing re -opened. There being no written communications received nor any person wishing to speak either in favor or in protest to the proposed amendment, it was Moved by Councilman Solem, seconded by Councilman Cooney and unanimously carried that the hearing be closed. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the recommendation of the Planning Commission, dated July 11, 1967, be accepted and that the City Attorney be instructed to prepare the necessary ordinance to amend the Municipal Code. Notice was also received from the Alcoholic Beverage Control of the original application for off -sale beer and wine license by Maria R. Salce, 300 North Dalton Avenue. Snyder Res -#5262 for his fifteen (15) years of service to the City as E.C.Snyder a member of the Azusa Library Board. Commendation Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA COMMENDING EDWARD C. SNYDER. City Clerk Miller read the Resolution. Moved by Councilman Cooney, seconded by Councilman Solem that the Resolution be adopted. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that the Resolution commending Mr. Snyder and the plaque be presented by Mayor Memmesheimer at the dinner to be given by the Library Board members on Wednesday, July 26, 1967. A Resolution was presented approving the report of the Res.{#5263 Street Superintendent regarding the Abatement of Weeds. Weed Abatement Councilman Cooney offered the following Resolution Report appvd. entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, APPROVING THE REPORT OF THE STREET SUPERINTENDENT OF THE CITY RELATIVE TO THE ABATE- MENT OF WEEDS AS PROVIDED IN SECTION 39560 THROUGH AND INCLUDING SECTION 39587 OF THE GOVERNMENT CODE. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that further reading be waived. It was the consensus of Council that another Weed Abate- ment Program be commenced as there are many hazardous areas since the last posting. It was further requested that street addresses as well as the legal description ' be included on future listings. An Ordinance was introduced for first reading authorizing Amend the adoption of an amendment to the contract between the Contract City Council and the Board of Administration of the State SERS re: Emplovees' Retirement System, which pertains to providing Widows & widows and survivors benefits for safety members. Survivors Resolution No. 5257, having been adopted unanimously on Benefits July 3, 1967, gave notice of intention to approve the amendment to the contract. Councilman Cooney offered for first reading the following Ordinance entitled: 1 L 1 1 CITY HALL AZUSA, CALIFORNIA JULY 17, 1967 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEES' RETIREMENT SYSTEM. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that further reading be waived. A communication was received from Mrs. Dorothy Bruce, Acting Senior Account Clerk, together with a letter from her doctor, Donald W. Ross, M.D., requesting a three -months extension, from July 17, 1967, of the temporary change of working hours of 7:30 a.m. to 4:00 p.m. as granted on June 5, 1967. Moved by Councilman Solem that the extension be granted. Motion died for lack of a second. Moved by Councilman Cooney, seconded by Councilman McLees that the request be denied. Denied A communication was received from National Communications Inc. requesting a 21 -year franchise, to be paid on a mileage basis, in order to install communication cables. A memo from the Assistant City Engineer suggested a delay in action at this time. Moved by.Councilman Cooney, seconded by Councilman McLees and unanimously carried that this item be continued to the meeting of August 7, 1967. Councilman Rubio invited the Mayor, Councilmen, Fire and Police Chiefs, City Administrator, City Engineer and Superintendent of Light and Water to attend a picnic for the children visiting from our participating Sister City, Zacatecas, Mexico, to be held at Zacatecas Park, starting at Noon on Sunday, July 23, 1967. Following discussion, it was Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried authorizing an amount not to exceed $15C be made available for the entertainment of the visitors arriving from Zacatecas July 22, 1967. Receipts for expendi- tures to be submitted. The Treasurer's Financial Statement for the month ending June 30, 1967, was presented to Council, showing Bank Balances of all funds as of that date to be $1,308,568.66. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that the report be filed. Notice was given that the Planning Commission, by Resolution No. 676, has recommended the change and amend- ment of the text of Section 9212.10(B), Uses Permitted in C-2 Zone, relating to Public Dance Hall, to be permitted after a public hearing in each case under Conditional Use Permit. City Attorney Williams entered the meeting at 8:40 p.m A communication was received from the Park and Recreation Commission reaffirming the position of the Commission opposing the use of any part of City Park for the pro- posed Police and E.O.C. facility, and requested that consideration be given to other sites which would be more desirable for such construction and less disruptive to the community. Moved .by Councilman Cooney, seconded by Councilman McLees and unanimously carried directing the City Administrator ' to write a letter to the Park and Recreation Commission acknowledging receipt of their letter, that the statements expressed will be taken under advisement and given due consideration. Councilman McLees offered the following Ordinance for second reading entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ADDING A SECTION TO THE AZUSA MUNICIPAL CODE CREATING AN ACCUMULATED SICK LEAVE FUND. Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that further reading be waived. The City Administrator requested Council authorization for Car payment of the car allowance in the amount of $90 per month Allowance to Police Captain Richard Lara. Council was advised that of $90 the amount has been included as a budgeted item. Police Cpt. A communication was received from the City Engineer Appt. recommending the appointment of John White, Senior Maint- S.White enance Man, probationary, at Step 1, effective July 18, 1967,Sr.Mtnce. upon satisfactory completion of the Physical examination. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried authorizing the change order in the amount of $451.00 to M. C. Larson. A communication was received from the City Engineer re- College garding a change of engineering course at California Course State College by Mr. James Skinner and recommending J.Skinner reimbursement of the tuition fee in the amount of $25.50 Tuition Pd. upon satisfactory completion of the course. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried authorizing the change of course and reimbursement of the tuition fee in the amount of $25.50. ' A communication was received from the Superintendent of Light and Water together with the resignation of Donald Urbanek as Lineman Helper, effective June 29, 1967, and a request for the Personnel Board to establish an eligibility list for this classification. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the resignation be accepted as recommended. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that the Personnel Board be authorized to hold an examination and establish an eligibility list for the classification.of Lineman Helper. Resign. S. Schulman Electric Company for the installation of three 12 KV Oil Circuit Breakers and Associated Switchboard Wiring at the Azusa Substation, waiving of the penalty provisions, and requesting authorization, of payment of the final billing less logo' retention for 35 days from Jure 20', 1967. Moved by Councilman, McLees, seconded by Councilman Cooney and unanimously carried to accept the recommendation regarding the acceptance of completion of the project, to waive the penalty clause, and that final payment be made less the 10% retention for 35 days from the completion date of June 26, 1967. A communication was received from Superintendent of Light and Water Virgil D. Smith requesting permission to start his vacation on July 18, 1967,for a period of one month. -+ Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that the request be approved. Notice of resignation of Fireman Alvin 0. Wilson, effec- tive July 163 1967, was submitted, with a request by Chief Madison for permission to appoint the next avail- able man from the eligibility list as a replacement. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried to accept the resignation, and that permission be granted to fill the vacancy from the ' eligibility list. The City Administrator presented the insurance policies covering insurance on buildings, equipment and vehicles and requesting authorization for the payment of the insurance premiums in the amount of $34,903.00. A communication was received from the Azusa Teen Post regarding City work for three boys through the Neighbor- hood Youth Corps Work Experience Program. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that the three teenage 1rouths be placed, following approval of City's liability insuance policy by the City Attorney. Moved by Councilman Cooney, seconded by Councilman Solem and unanimously carried that Aerojet personnel be invited ' to meet with the City Administrator and other personnel to study City operations and requirements in order to recommend a possible course of action or proposal. A communication was received from the City of Monterey Park City of regarding the adjudication of the San Gabriel River Basin. Monterey Pk. Adjudication Following discussion, it was -Water - Moved by Councilman McLees, seconded by Councilman Solem and unanimously carried that the City acknowledge receipt of the letter and advise the City of Monterey Park that we are deeply concerned and are studying the matter and will give due consideration; that at the present time, this 11 1 0'J CITY HALL AZUSA, CALIFORNIA JULY 17, 1967 City is not in agreement with any of the proposed drafts of the "Principles of Management of San Gabriel Basin as an Adjudicated Area"; and that a copy of the letter from Monterey Park be sent to Edward Taylor, special counsel, requesting his comments. A question was raised as to the status of the proposed meeting of the city attorneys of the four cities who are members of the Municipal Water District. Mayor Memmesheimer advised Council that a hearing on the Legislative Bill AB245 would be held on July 26, 1967, at 9:00 a.m., in Sacramento and of the necessity for our City being represented. Moved by Councilman McLees, seconded by Councilman Cooney and unanimously carried that either the Mayor or the City Administrator be authorized to be in attendance at the hearing in order to state the City's opposition to this legislation, and authorizing reimbursement of accountable expenses. Notice was made by Mayor Memmesheimer of a meeting of the Citizens Advisory Council on Public Transportation at Occidental College, at 10:00 a.m. on July 25, 1967. The Mayor requested that the City Engineer attend this meeting,if at all possible. Moved by Councilman Cooney, seconded by Councilman McLees and unanimously carried that City Engineer Sandwick be authorized to represent the City at this meeting. Councilman Cooney offered the following Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Moved by Councilman Cooney, seconded by Councilman Solem that the Resolution be adopted.
