HomeMy WebLinkAboutE-6 Staff Report - Lease Agreement with AT&TCONSENT ITEM E-6 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MIKE BERTELSEN DATE: JUNE 7, 2021 SUBJECT: AUTHORIZE A COMMUNICATIONS SITE LEASE AGREEMENT WITH AT&T MOBILITY CORPORATIONS. BACKGROUND: AT&T Mobility Corporations is interested in leasing a small portion of Azusa Police Department’s property for the expansion of a previously built communication facility, which will commercially enhance wireless communication service to Azusa residents as well as non-residents. The proposed action will lease approximately 330 square feet including the air space above such ground space. The initial term will be for a period of five (5) years and automatically renew for four additional five (5) year terms, at a monthly rental rate of $2,600 per month with a 3% per year escalation rate. RECOMMENDATION: Staff recommends the City Council take the following actions: 1)Approve the Communication Site Lease Agreement with AT&T Mobility Corporations; and authorize the City Manager, or designee, to execute the agreement, in a form acceptable to the City Attorney, on behalf of the City; and approve subject to non-substantive changes approved by the City Attorney and City Manager. ANALYSIS: LA-RICS was established for the purpose of coordinating governmental services to establish a wide-area interoperable public safety communications network. LA-RICS built out public safety grade Long Term Evolution (LTE) broadband communications for first responders, who are part of LA-RICS, in the City of Azusa. In this regard, they have previously built a cellular/radio communication facility on Azusa Police Department property located at 725 N Alameda Ave, Azusa, California. Following receipt of appropriate federal approvals, this LTE site will be incorporated into the federal First Responder Network Authority’s (FirstNet) National Public Safety Broadband Network, which is operated by FirstNet’s contractor, AT&T, Inc. and its subsidiary, New Cingular Wireless PCS, LLC. APPROVED CITY COUNCIL 6/7/2021 AT&T Communications Site Lease Agreement June 07, 2021 Page 2 AT&T has submitted plans to lease approximately 330 square feet of Azusa Police Department property for the transmission and reception of communications signals and the installation, construction, maintenance, operation, repair, replacement and upgrade of communication fixtures and related equipment. The approximate location is shown in Exhibit “1” of the agreement, and the exact location and description of facilities is under review by the Azusa Planning Commission, and will be attached in place of Exhibit “1” of the Agreement once approved. The initial lease of this Agreement will be five (5) years, commencing upon signature and of the agreement. The Agreement shall automatically be extended for four additional five (5) year periods, unless written notice of termination is given by the Landlord or Tenant. FISCAL IMPACT: Commencing on the Effective Date, Tenant will pay Landlord (City of Azusa) in monthly installments of $2,600 per month. Annual consideration shall be increased by 3% each year throughout the term of the Agreement and any extensions or renewals thereof, effective on each anniversary of the commencement date. Revenue from this Agreement will be to the City’s General Fund.
