The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Mayor Gonzales called the meeting to order at 6:30 P.M. ROLL CALL: Roll call was taken by City Clerk Cornejo. PRESENT: COUNCILMEMBERS: GONZALES, MACIAS, ALVAREZ, AVILA, MENDEZ ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT Elected Officials: City Clerk Cornejo. City of Azusa; Claim No. 1999296. CONSENT ITEM F-1 APPROVED CITY COUNCIL 6/21/2021 REGULAR SESSION Mayor Gonzales called the meeting to order at 7:46 P.M. The Pledge of Allegiance was led by Councilmember Alvarez. CITY COUNCIL ROLL CALL: Roll call was taken by City Clerk Cornejo. CLOSED SESSION REPORT The City Council reconvened at 7:46 P.M.; City Attorney Martinez announced the following regarding Closed Session: The Council heard Items 1, 2, and 3, and the Council will reconvene at the end of the regular meeting to hear Items 4, 5, and 6. Item 1 – The City Council heard a presentation from its negotiating team regarding price and terms regarding a potential lease or purchase of property, no reportable action; Item 2 – City Council heard a presentation from its negotiating team concerning price and terms of a potential lease and the Council provided direction, no further reportable action; and Item 3 – Pursuant to the Azusa personnel rules, the City Council reviewed an employee discipline matter and by a vote of 4-1, voted to sustain the discipline imposed by the department head in accordance with the City’s personnel rules. CEREMONIAL 1. Presentation of Proclamation proclaiming the month of June 2021 as LGBTA+ Pride Month in the City of Azusa Moved by Mayor Pro-Tem Avila, seconded by Councilmember Alvarez and carried by unanimous vote of the Council to proclaim the month of June 2021 as LGBTQ+ Pride Month in the City of Azusa: AYES: COUNCILMEMBERS: GONZALES, MACIAS, ALVAREZ, AVILA, MENDEZ NOES: COUNCILMEMBERS: NONE ABSTAIN: COUNCILMEMBERS: NONE PUBLIC COMMENT Arturo Ortega, Azusa Unified School District Superintendent, provided highlights and updates about the School District. Ryan Serrano, Los Angeles County Board of Supervisors Representative, provided updates regarding the safe reopening of Los Angeles County; provided information regarding vaccinations; and provided information about available resources. REPORTS, UPDATES AND ANNOUNCEMENTS FROM STAFF/COUNCIL City Manager Communications City Manager Gonzalez provided a COVID-19 update stating City Hall is now completely open; Staff is continuing to work on increasing vaccinations in the City; and Staff is working on an educational workshop in conjunction with Los Angeles County Department of Health, a local medical provider, and a parent advocate, to provide information to those individuals that are reluctant to get a vaccine. Council Comments Mayor Pro-Tem Avila expressed his condolences to the family of Richard Sanchez and requested that the meeting be adjourned in his honor; thanked the Veteran’s Memorial Day Committee for their Memorial Day Ceremony; congratulated the St. Francis of Rome promotion class; congratulated the Lady Aztecs Softball Team on an undefeated season and wished them luck in CIF; congratulated all of the high school graduates; commended and thanked the Azusa Police Department for their hard work on an incident that took place over the weekend; thanked Superintendent Ortega for his announcements; and, on behalf of the family of Mr. George Romero, thanked everyone for their well wishes. Councilmember Macias congratulated all of the graduates in the City of Azusa; inquired about the swim lessons start date; requested an update on the clock at CVS; and inquired about the process for speed bump installation in residential neighborhoods. PAGE TWO – 6/7/2021 Councilmember Alvarez provided information regarding the Foothill Transit meeting that he recently attended; and requested that street lanes be repainted on westbound First Street and Azusa Avenue, eastbound Foothill Boulevard and Azusa Avenue, westbound on Foothill Boulevard and San Gabriel Avenue. Director of Community Resources Carpenter provided an update on the swimming pool and vaccine clinics. Councilmember Mendez congratulated Gladstone High School Counselor Abdo on his retirement; congratulated the graduating class of 2021; commended the officers for their work during the incident on Foothill Boulevard; inquired about an incident which took place in the riverbed; requested an update on the homeless situation in the riverbed; inquired about the homeless count and enforcement jurisdiction; requested a formal update from the Homelessness Ad-hoc Committee to be placed on the agenda for the following Council Meeting; and inquired about Gold Line TAP Card readers in the City of Azusa. Chief of Police Bertelsen provided information regarding an assault that took place in the riverbed; provided information regarding the homeless in the riverbed and locations in which enforcement can be taken by Azusa Police Department; and discussed patrol operations surrounding the Gold Line and homeless outreach on the train. City Manager Gonzalez provided further information regarding the homeless count, enforcement in the riverbed, and Lario Park. Mayor Gonzales provided information regarding the Homeless Ad-hoc Committee meeting that he attended with Councilmember Alvarez; requested that a discussion regarding the homeless issues in the riverbed be placed on agenda for the next City Council meeting; discussed the homeless situation at Lario Park; thanked the Veteran’s Committee for the Memorial Day Ceremony; requested certificates for the Christbridge Academy graduates; announced the LeRoy Harris Kelly III Annual Walk on June 12, 2021 at Veteran’s Freedom Park; and announced a candlelight vigil in memory of the individuals that lost their lives to COVID-19 on June 26, 2021. Chief of Police Bertelsen stated the requirements for requesting that a homeless individual leave a specific area. SCHEDULED ITEMS – CITY COUNCIL AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING SECTION 30-137 (C) OF THE AZUSA MUNICIPAL CODE RELATING TO ADMINISTRATIVE CITATIONS AND FINES FOR VIOLATIONS OF THE CITY OF AZUSA’S FIREWORKS REGULATIONS City Attorney Martinez presented the Item stating that at the May 3, 2021 City Council Meeting, Staff was directed to prepare an Urgency Ordinance increasing the fines related to the discharge of illegal fireworks; the fines would be established at $1,000 for the first violation, $2,000 for the second violation, and $5,000 for the third violation occurring within five years; a provision was included to state that any violations after the five year period, the fine would continue to be $5,000; and the Urgency Ordinance would take effect immediately after adoption. In response to questions posed by the Council, Chief of Police Bertelsen stated that approximately two-thirds of the citations issued were to Azusa residents. Councilmember Mendez offered Urgency Ordinance No. 2021-03 entitled: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING SECTION 30-137(c) OF THE AZUSA MUNICIPAL CODE RELATING TO ADMINISTRATIVE CITATIONS AND FINES FOR VIOLATIONS OF THE CITY OF AZUSA’S FIREWORKS REGULATIONS Moved by Councilmember Mendez, seconded by Mayor Pro-Tem Avila, and carried by unanimous vote of the Council to introduce and adopt Urgency Ordinance No. 2021-03 amending Section 30-137(c) of the Azusa Municipal Code related to administrative citations and fines for violations of the City of Azusa’s fireworks regulations. The minutes of the Regular Meeting of May 17, 2021 and Special Meeting of May 19, 2021 were approved as written. PAGE THREE – 6/7/2021 2. Resolution No. 2021-C27 was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items, in accordance with the City of Azusa Civil Service Rules Section 5.75 and applicable Memorandum of Understanding(s), were approved as follows: New Appointments: A. Aviles, S. Kim Promotion: R. X. Saldana, Jr. Separations/Retirements: S. Martinez, J. Bitonti 4. A request to increase fiscal year 2020/21 blanket purchase order for Turbo Data Systems – Parking Citation Processing, to a not-to-exceed amount of $35,000, was approved. 5. A request to increase fiscal year 2020/21 blanket purchase order for City of Glendale to a no-to-exceed amount of $36,000, was approved. 6. The Communications Site Lease Agreement with AT&T Mobility Corporations was approved; the City Manager, or designee, was authorized to execute the agreement on behalf of the City; and non-substantive changes approved by the City Attorney and City Manager were approved. 7. A professional services agreement in an amount not-to-exceed 20% of each housing rehabilitation grant funded, up to a maximum amount of $35,000, for the administration of the City’s Single Family Housing Rehabilitation Project beginning July 1, 2021 through June 30, 2022, and for up to an additional two consecutive years upon annual renewal, was approved. 8. The issuance of a purchase order to ERMCO in an amount of $65,682.54 for the purchase of Pad-mounted Transformers, was approved. 9. The City Manager was authorized to execute Amendment No. 1 to the Memorandum of Agreement with the San Gabriel Valley Council of Governments (SGVCOG) for $25,000. 10. The grant award from California Library Literacy Services (CLLS) was accepted; and necessary budget amendments were approved and the current fiscal year budget will be adjusted accordingly. 11. The grant award from California State Library for Family Literacy was accepted; and necessary budget amendments were approved and the current fiscal year budget will be adjusted accordingly. 12. The City Manager was authorized to execute a three year Volume Licensing Agreement with Microsoft Corporation for the renewal of software assurance/support for Microsoft Office ProPlus; and an agreement was awarded to Dell in the amount of $42,504.33 annually. SUCCESSOR AGENCY RELATED BUSINESS RESOLUTION AUTHORIZING PAYMENT OF WARRANTS BY THE SUCCESSOR AGENCY DATED MAY 14, 2021 THROUGH JUNE 2, 2021 Agency Member Alvarez offered Resolution No. 2021-R08 entitled: A RESOLUTION OF THE SUCCESSOR AGENCY OF THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS TO BE PAID OUT OF SUCCESSOR AGENCY FUNDS Moved by Agency Member Alvarez seconded by Agency Member Avila and carried by unanimous vote of the Agency to adopt Resolution No. 2021-R08.
