Order Invocation was given by Rev. H. M. Sorweide of the Church Invocation of the Nazarene. ' Present at Roll Call: Councilmen: Rubio, Decker, Cooney, Roll Call Calvert, Solem Also Present: City Attorney Terzian, City Administrator Foxworthy, Director of Public Works Sandwick, Director of Utilities Marron, Planning Director Smith, Police Chief Elkins, City Clerk Klarr. There being no corrections or additions, the Minutes of the Appvl.Min. meeting of February 17, 1969, stand approved as written. 2/17/69 The City Clerk announced that bids were opened in the office Bids on of the City Clerk at 10:00 a.m. on Thursday, February 27, install.of 1969, on installation of Traffic Signals for Mid -block Cross- traffic sig. walk on Citrus Avenue, approximately 500 ft. north of Mauna on Citrus N. Loa Avenue (Project No. 474). Present at the bid opening of Mauna Loa, were City Treasurer Watkins, Director of Public Works Sand- Proj.#474 wick, and City Clerk Klarr. (awarded to Fischbach & The City Clerk presented the Affidavit of Publication of Moore, Inc.) Notice Inviting Bids. ' Four bids were submitted as follows: Contractor Amount Bid Fischbach and Moore, Inc. $4,426. Smith Electric Co., Inc. 4,795. Steiny and Mitchel, Inc. ,800. Seco Electric Co., Inc. 6,166. (Engineer's estimate, $4,000.) The Director of Public Works submitted a memo, recommending that the contract be awarded to Fischbach and Moore, Inc., low bidder. Moved by Councilman Calvert, seconded by Councilman Cooney and unanimously carried by roll call to approve the recom- mendation to award the bid to Fischbach and Moore, Inc., low bidder ($4,426.), and to return bid securities to unsuccess- ful bidders after contract has been signed. Specifications for the application of the Payroll System to data processing, prepared by the Accounting Director, was, again submitted to Council, having been tabled from the 2/3/69 and 2/17/69 meetings. The City Clerk suggested the date of Thursday, 3/13/69, for the proposed adjourned meeting to discuss EDP. Moved by Councilman Cooney, seconded by Councilman Calvert and unanimously carried to lift from the table. After discussion, it was Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to continue this item to the pro- posed adjourned meeting on 3/13/69. The City"Clerk presented a request from Boy Scout Troop Req.by Boy #404 for permission to paint house numbers on curbs in the Scout Troop City, for which they will request a donation from the #404 to residents. This is a fund-raising project to enable the paint house Scouts to purchase equipment for the troop and also a numbers on community service project for awards, curbs (referred to The City Clerk had discussed this request with the Sr. C.Adm.9- Dir. It was noted that the College students are experiencing an average of 50% of the residents who will allow the house numbers to be painted on the curbs. Councilman Calvert suggested that the Troop might contact Azusa -Pacific College and arrange for a "gentleman's agreement" to assist the students in this project. Moved by Councilman Cooney, seconded by Councilman Rubio and unanimously carried to refer this request to the City Administrator and Director of Public Works with a report to Council. The City Clerk presented two claims against the City for Claims vs. personal and property damage re: auto accident by alleged City re: failure to place adequate warning at excavation site on auto acc. Gladstone Street near Garelock Avenue on 1/26/69, submitted on Gladstone by Richard Fusilier, attorney for Joan M. and Robert L. St. near Madore. A memo was received from Assistant City Engineer Garelock Ave. Gerlofs, giving the result of his investigation regarding (Madore) this alleged accident. Moved by Councilman Calvert, seconded by Councilman Rubio and unanimously carried to deny these claims and refer them to the City's insurance carrier. Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to table this item until the 3/17/69 meeting, with a report to be submitted by the Police Chief. The City Clerk presented a Resolution from the City of City/Inglewood Inglewood, opposing Assembly Bill #238 re: Court Consolida- Res.opposing tion Plan. Hoes Rule A Resolution was presented, urging support of S.B. #4. Councilman Cooney offered the Resolution entitled: - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA URGING SUPPORT OF SENATE BILL 4 INTRODUCED IN THE 1969 SESSION OF THE STATE LEGISLATURE BY SENATOR H. L. RICHARDSON. Moved by Councilman Cooney, seconded by Councilman Calvert and unanimously carried that further reading be waived. The Mayor and Councilmen received an invitation to attend the installation -of Sam Cianchetti as Judge of Citrus Municipal Court on Friday, 3/7/69, at 3:00 p.m. in Division 1 of the Courthouse. Moved by Councilman Cooney, seconded by Councilman Calvert and unanimously carried to file. A communication was received from the Azusa City Employees Association, stating a committee, comprised of members of the Association and the Azusa Police and Fire Association, met and reviewed their needs regarding employee and employer communications. It was the opinion of the.com- mittee that Sections 3500 thru 3511 of the Government Code are adequate as they stand. The letter further stated that if Council feels the need to update or change their present arrangement, Section 3507 allows the Council to adopt reasonable rulesand• regulations to administer the new law. Assn.re: employee & employer communication (filed) AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, MARCH 3, 1969 Page 4 The City Administrator referred to the motion passed by Council on December 16, 1968, that the City Administrator and representatives of the City Employees meet,to discuss an Ordinance and report to Council; however, the City Employees Association would not meet with him, although Mr. Foxworthy endeavored to meet with the president of the Association, Mr. Roth. Also, the City Administrator had received no correspondence on this matter. During the discussion which ensued; it was noted that, in the past, a Committee has been formed, which included members of the Finance Committee, Personnel Cler} Parks, and representatives of the Associations, to discuss fringe benefits. Man effective 2/26/69 AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, MARCH 3, 1969 Page 7 A recommendation was submitted by the 01ty Administrator for payment at straight hourly rate for overtime hours worked by five (5) supervisory employees, in connection with the recent flood emergencies: Public Works Supt. Wayne Loyd 132 hrs. Park Supt. Arthur Brown 60 hrs. Police Lt. C. J. Flynn 22 hrs. Police Lt. Ray Roth 231 hrs. Police Lt. G. Trujillo 8 hrs. making a total of $1,324.94 for said overtime. According to Resolution #4709, employees above the first level of supervision will not receive cash payment for overtime worked without recommendation of the City Admin- istrator and the approval of the City Council. Moved by Councilman Calvert, seconded by Councilman Cooney to approve the recommendation and thank the City employees for doing a tremendous job. Motion carried by the follow- ing vote of Council: AYES: Councilmen: Decker, NOES: Councilmen: Rubio ABSENT: Councilmen: None Cooney, Calvert, Solem Councilman Rubio further stated that he voted "No" on the above motion, as he believed this matter needs further discussion and that supervisory personnel should be re- quired to put in ten hours overtime on their own before being granted cash remuneration. Councilman Decker further stated that he voted "Aye" on the above motion as it was his feeling that perhaps the line drawn, which delineates between employees receiving automatic overtime and those who would not, should be re- evaluated and possibly changed so that certain personnel not now receiving automatic overtime would be included with the employees who are receiving autonna, is overtime. He specifically mentioned Police Lieutenants and the Public Works Superintendent. The City Administrator suggested that Council review Resolution #4709, which is the current.. Resolution on overtime, for possible amendments, as the presept dif- ference between "emergency" overtime and "'scheduled" overtime is a decision"making problem and rhould be clarified. He further stated that none of the Police Department personnel worked overtime without the sanction of the Department Head. Moved by Councilman Decker, seconded by Councilman Rubio to refer to the Personnel Board the matter of overtime for supervisory personnel above the first level of supervision, especially Police Lieutenartc and Public Works Superintendent. Motion was carried by the following vote of Council: AYES: Councilmen: Rubio, Decker, Solem NOES: Councilmen: Cooney, Calvert ABSENT: Councilmen: None The City Administrator presented a recommendation from the Director of Public Works that, in the event the City's insurance company can hold harmless the Flood Control District, the Mayor and Citv Clerk be authorized to sign the Agreement with the L. A. The City Administrator further asked that the Mayor and Director of Public Works accompany him to a meeting on 3/4/69 with the Board of Directors of the Lark Ellen Home for Boys. After discussion re: communication to be received from the insurance company regarding possible additional cost to the City, and also a report on the actions of the Lark Ellen Home for Boys, it was Moved by Councilman Cooney, seconded by Councilman Calvert and unanimously carried to continue this item to the pro- posed adjourned meeting of 3/13/69. The City Administrator presented a request by the Police Conf.appt. Chief for confirmation of the appointment of Robert J. The City Administrator requested the wishes of the Council Comm.apptd. regarding tie annual.Clean-Up Week Campaign this year'be- re: Clean -Up cause of City's expense due to flood damage. If the City Week Campaign has this Campaign, the City Administrator recommended the appointment of a Committee, as in the past. The Mayor expressed he would like to have the same Com- mittee appointed and the publicity taken care of; however, if funds are not available, residents could dump their own trash at Azusa -Western. Moved by Councilman Decker, seconded by Councilman Cooney and unanimously carried to appoint the same Committee to work on the Clean -Up Week Campaign, to consist of the Mayor, Mayor Pro Temppre, Fire Chief, Police Chief, Director of Public Works, and City Administrator. Regarding the destruction of obsolete City records, the Req.by Dir. City Administrator presented a request from the Director of Util.for of Utilities for approval of the destruction of certain appvl.of City records, papers etc., in his Department, dated destruction prior to March of 1994. The procedure requires that a of City records request form be filled out by the Department Head, with in his Dept., signed approval by the City Administrator, City Clerk and dated prior to City Attorney. In order elig.for HUD to qualify, 60% of the buildings in said area must be sub- standard. It was the understanding of the Planning Director that such a survey would be free of charge, and that two public hearings need to be held before the City can actually apply for federal funds for the project. Moved by Councilman Cooney, seconded by Councilman Calvert to request the Housing and Urban Development Department (HUD) to make a survey of the proposed area recommended by the Downtown Study Committee, to determine eligibility for NDP.
