The City Council of the City of Azusa met in regiklar session at the above time and place. Mayor Solem called the meeting to order and led in the Call to salute to the flag. Order 'Invocation was given by Rev. Dean F. Klarr, Presbyterian Invocation Minister. Present at Roll Call: Councilmen: Rubio, Decker, Snyder, Roll Call Clark, Solem . Also Present: City Attorney Wakefield, City Administrator Sandwick, Superintendent of Light & Power Gerharz, Acting City Engineer Wells, Police Chief Elkins, Fire Chief Torrance, Director of Parks and Recreation Dangleis, Associate Planning Director Fitzsimmons, Accounting Director Cooney, City Clerk Klarr' The Minutes of the meetings of 2/2/70, 2/16/70, 3/2/70, Appvl.Min. 3/16/70, 4/6/70, and 9/8/70 were approved as submitted. Councilman Rubio presented an`award to Miss Jacquelyn Ross, Serv.Award, Senior Utility Clerk, for 15 years service with the City. Miss J.Ross Councilman Decker presented an award to Stephen Rodgers, Serv.Award, Welder in the Water Department, for 5 years service with Stephen the City. Rodgers 'The City Clerk announced that bids were opened in the office Bid Award - of the City Clerk at 10:00 a.m. on Thursday, September 17, Jan. Maint. 1970, to provide Janitorial Maintenance Service at the Serv.(excl. Police Facility Building (not including jail area). Present jail area) at bid opening were City Administrator Sandwick, Police QPol. Fac. Chief Elkins, Acting City Engineer Wells, and City Clerk Bldg. Klarr. (Merchants Bld .Maint. The City Clerk presented the affidavit of proof of publi- Co. cation of the Notice Inviting Bids, published on 9/2/70 in the Azusa Herald & Pomotropic. Only one bid was received: Contractor Bid Merchants Building Maintenance Co. $545 per month (Engineer's estimate was $600 per month) A ftcommendation was received from the Acting City Engineer that the contract be awarded to Merchants Building Mainte- nance Co. for the reason that the single bid was below the engineer's estimate, and sufficient money has been budgeted for this work; also this contractor is presently performing the maintenance of the Library and the Light & Power Build- ing and the services to date have been very satisfactory. Moved by Councilman Rubio, seconded by Councilman Clark and unanimously carried by roll call to approve the recom- mendation to award the contract to Merchants Building Maintenance Co. for $545 per month. The hour of 7:30 p.m. being the time set for the Public Pub.Hrg.on Hearing on amendment to Sections 9214.10(b)2(RR), 9213.10 amdnd. M.C. (b)25, and 9206 of the Municipal Code re: proper,zoning for re: zoning vehicle and/or equipment rental, recommended by Planning for vehicle Commission Resolution No. 869 (Planning Commission initiated), and/or equip. rental AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, SEPTEMBER 213 1970 Page 2 the Mayor declared the hearing open. The City Clerk presented the Affidavit of Proof of Publica- tion of Notice of this Hearing in the Azusa Herald & Pomo- tropic on September 2, 1970. ' A memo was received from the Planning Commission, which stated there appear to be three separate uses involved: 1. Rental of heavy equipment such as earthmovers, bulldozers, etc., which would be proper within a manufacturing zone. 2. Vehicle and equipment rental establishments, which proper use would be C-3, since outside storage is involved. Also, that due to the various properties within the City zoned C-3 and adjoining many different uses, a Conditional Use Permit should be required to allow review of each location and set forth development standards (walls, access, landscaping, etc.) tailored to each individual site. Further, that a maximum allowable vehicle capacity of 22tons should be set. 3. Rental of trailers, etc., as an accessory use in conjunction with an automobile service station. It is felt that with the amendments recommended above, including "Utility Trailer and Truck Rental Yard" as a new definition, this would be permitted as an accessory use in conjunction with a service station in a C-3 zone. No further communication having been received and no one in the audience wishing to be heard, it was Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to close the hearing. Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to refer to the City Attorney for the necessary Ordinance to amend the Municipal Code as recommended. The City Clerk requested authorization for payment of the Auth.paymt. 1970-71 dues for the Committee of Mayors, in the amount $45 dues for of $45. Hall of Administration on Thursday, 10/1/70, at 9:30 a.m. Guide, 10/1/70 Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to authorize attendance by Acting City Engineer Wells. The City Clerk presented a petition containing 198 signa- tures submitted by Michael Agabra, protesting re-routing of the proposed Cerritos Avenue and possible high density apartments in the former Rainbow Angling Club area. The Associate Planning Director told Council that the Planning Commission is studying the possible realignment of Cerritos Avenue, which had been referred to them, and said a report will be submitted to Council within a few weeks. Moved by Councilman Snyder, seconded by Councilman Clark and unanimously carried to refer the petition to the Planning Commission and to forward a copy to Supervisor Bonelli and to the County Road Department. Notice was received from Alcoholic Beverage Control of Person -to -Person Transfer of On -Sale Beer (Food) License from Norma J. Crouch to Bellen L. Santa Cruz, for premises at 708 North Azusa Avenue. Moved by Councilman Rubio, seconded by Councilman Clark and unanimously carried to file. Notice was also received from'Alcoholic Beverage'Control of new On -Sale Beer (Food -Conditional) License application by Maria R. Salce, for premises at 302 North Dalton Avenue; known as "Sonora Cafe". The City Clerk received a petition containing 21 names, protesting issuance of a liquor license in a residential area, which would disturb the peace and quiet in the neigh- borhood. The Associate Planning Director addressed Council and stated that, while the property is zoned C-2, it is in the middle of an R-3 zone and within 300 feet of residences, and for this reason requires a Conditional Use Permit. The owner has filed a request for such Conditional Use Permit and the Alcoholic Beverage Control has been so informed. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried to table this item until the Plan- ning Commission takes action on the request for a Condi- tional Use Permit. 'A communication was received from the Veterans of Foreign Wars, Azusa Post 8070, registering a protest against the contractor who has been doing work on East First Street and adjacent to the VFW hall and in their parking lot. The Acting City Engineer addressed Council and explained the situation, and stated that when the project is completed, the parking lot for the VFW Hall will be rejuvenated and left in a better condition than before. Robert Strosser, 621 W. Hollyvale, Quartermaster of VFW Post 8070, addressed Council, outlining problems that the VFW Hall had experienced with the contractor, including such matters as access to the property being prevented, Petition protesting re-routing of propo. The City Clerk presented to Council the auditors' report Auditors' for the fiscal year ending 6/30/70. annual rpt.presented Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried to receive the report. The City Treasurer's Financial Statement was submitted, C.Treas. showing a balance of $1,157,241.57 as of August 31, 1970. 'The Personnel Board submitted a recommendation to revise Pers.Bd.recom, Section 47, paragraphs 4 and 6, of the Rules and Regulations to revise re: minimum increase of salary upon promotion or'acting in R&R re:min. a higher capacity. incr.of salary upon It was explained that since a'minimum of 5% increase was promotion to be granted in each instance, and due to the present or actg.in salary schedule indicating less than 5% increases between higher some of the higher steps/ranges, this resulted in an capacity additional step being granted'to conform to the present Rule. The differences in some of the higher levels ranged from 4.34% to 4.94%, and it was felt by the Board that it would be desirable to eliminate the required minimum of 5%, but still grant the increase at the lowest step of the appropriate pay range that would yield an increase over an employee's present salary. Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried to table to the 10/5/70 meeting, and to forward this material to the Azusa City Employees Association and the Azusa Police and Fire Association, for whatever comments they may wish to make. Notice was given that the Planning Commission, by Resolu- P.C.Res.#871 'tion No. 871, conditionally granted a Variance to permit rtg. A memo was received from the Associate Planning Director, Hrg, re: giving notice of a public hearing in the Regional Planning County Zene Commission hearing room on 10/1/70 at 9:30 a.m. re: Los Eccep. Case Angeles County Zone Exception Case #9594-(1). The subject #9594-(1) property is located on the west side of Barranca (Ben Lomond) Avenue between the Foothill Freeway and the park which is presently being developed by the County; and which AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, SEPTEMBER 21, 1970 Page 5 falls within the City's planning area. The applicant pro- poses to construct, operate and maintain two 4 -unit apartment buildings, garages, covered recreation areas, and appurtenant facilities on subject property. The memo further stated that the subject property should be developed as an extension of the proposed park and an exten- sion of Alford Street easterly to Barranca Avenue. Other than this development, it should be single-family residential. The Associate Planning Director requested that Council take some action to make the Regional Planning Commission aware of the City's feelings on this subject. Moved by Councilman Decker, seconded by Councilman. Snyder and unanimously carried to indicate City's opposition by a letter from the Mayor, and to authorize the Associate Planning Director and City Administrator to attend this hearing. Swap Meet problem Mr. Myrl Kavanaugh, 140 W. Valley Boulevard, San Gabriel, addressed Council and explained that, to his knowledge, the number of cases of stolen merchandise being sold at the Swap 'Meet was very small during the period of time the Swap Meet has operated. However, he would like to employ the services of an off-duty Police Officer,to help control even this minimal amount. He and the Council discussed the problems of merchants selling new merchandise at the Swap Meet in competition with local City merchants, and the problem of sales tax being collected. Mrs. Pat Gleason, 5220 N. Leaf Avenue, appeared before Council in support of the Swap Meet, and presented state- ments from nine businesses in'the immediate area, indicating the increase of business in their establishments due to the presence of the Swap Meet. She further stated that persons attend this Swap Meet from many cities and this provides advertising for the City. She pointed out that the Foothill Swap Meet is the cleanest and best operated of all Swap Meets with which she is familiar. After further discussion, it was Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to approve the following conditions of operation for the Swap Meet, to be sent to Mr. Kavanaugh: 1. Theatre operators to obtain the names and license numbers, as well as the general classifications of items being offered by the various Swappers, with these lists being forwarded to the Police Department. 2. Employ personnel from the Azusa Police Department, to be present during the operation of the Swap -Meet each Sunday, to investigate any illegal transactions. 3. Require any Swappers, who offer new merchandise for sale, to post the retail sales license in view for any inspectors or Police personnel. The City Administrator presented a request from the Police Sgt.Molloy Chief for Sgt. James T. Molloy and Police Officer Richard & Pol.Off. ' Allen to be permitted to participate in the National Allen to Police Olympics, to be held in Phoenix, Arizona, on attend Natl. October 2, 3 and 4, 1970, and request authorization for Pol.Olympics expenses for gasoline. Councilman Clark, as Project Chairman of the Aztec Band Sale Auto Boosters presented a letter which is being mailed out re: Lic.Plate their sae of automobile license frames containing the Frames by words "Azusa - The Canyon City", at $2 a pair, as a fund- Aztec Band raising project for uniform replacement for the Band. Councilman Clark informed Council of complaint regarding Re: ped. the pedestrian traffic in the Murray School area: in the traffic vicinity of Gladstone Street and Cerritos Avenue, where problem in posting is needed; also along both Pasadena and'Heathdale vicinity of Avenues at Gladstone Street, where it is almost impossible Murray School to walk along the street and where better crossings should be provided, ` 'Mrs. Rose Black, 432 South Rosalinda, addressed Council, stating curbs should be painted red on Gladstone Street on the north and south sides, or post no parking or stopping signs during school hours. Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to refer this matter to the Police Chief and the Acting City Engineer. The City Clerk read in full a Resolution authorizing Res. #5785 payment of warrants by the City. Bills & Reqs. Councilman Decker offered for adoption the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS•AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
