The City Council of the City of Azusa met in regular session at the above time and place. Mayor Solem called the meeting to order and led in the Call to salute to the flag. Order Invocation was given by Elder Frank Herber of Church of Invocation Jesus Christ of Latter Day Saints. ' Present at Roll Call: Councilmen: Rubio, Decker, Snyder, Roll Call Clark, Solem Also Present: Acting City Attorney Allen, City Administra- tor Sandwick, Director of Parks & Recreation Dangleis, Acting City Engineer Wells, Fire Chief Torrance, Police Lieutenant Trujillo, Associate Planning Director Fitzsimmons, Accounting Director Cooney, City Clerk Klarr The Minutes of the meeting of October 5, 1970, were approved Appvl.Min. as submitted. 10/5/70 Councilman Clark presented an award to Walter Boyko, Public Serv.Award Works Inspector, for 5 years service with the City. Walter Boyco The hour of 7:30 p.m. being the time set for the continued Cont.Pub.Hrg. public hearing on an appeal from denial of a Variance by on appeal fr. Planning Commission Resolution #560 (Case V-251- Kathryn den.of Vara . Soleberg) to permit multiple family residential use in a (Case V -?5.1- C-3 zone, on property at 990 E. Alosta Avenue, the Mayor K.Soelberg). declared the hearing open. (appeal denied) A report was received from the Planning Commission, which stated the Commission had reviewed the new data submitted by the applicant to support the request for a Variance to construct apartments on the rear 310 feet of the property located at the southwest corner of Calera and Alosta Avenues. The new data included a more detailed plot plan, date q.heet, floor plans of individual units, and elevations of proposed development (conies of which were submitted to Council). Submitted also was a letter containing 49 signatures of people in the area who are opposed to this development. Upon review of the new evidence; and additional testimony by the proponents and opponents; the Planning Commission recommended that their earlier decision be reversed and the request for a Variance be approved, subject to the following conditions: (1) Proposed development shall comply with plans as submitted, as additional evidence. (2) Precise Plan subject to review and approval by ( the Planning Commission. Glenn B. Soelberg, 2030 Lorraine Road, San Marino, addressed Council and expressed his appreciation for the patience and understanding of the Council and for providing him time to ,meet the Planning Commission requirements on his request. He noted that he would like to begin immediately with a com- mercial development on the property. Dave Simmerman, 6250 Hanlin Ave., addressed Council as a representative of the concerned citizens opposing the pro- posed apartment complex. In his discussion, he made the following points: (1) There are already two large apartment complexes in the same area. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, OCTOBER 19, 1970 (2) Residents of the area have had to suffer the noise created from the vehicles of the apartment dwellers. (3) The school in the area (Powell School) cannot accomo- date the children which would reside in the proposed apartments. (4) The concerned citizens feel that the increase of ' school children would require bussing of the children to other schools or adding buildings to the existing school, which would increase taxes. (5) Residents of the area oppose the opening of any cul- de-sacs or deadend streets to meet the traffic increase created by the apartment dwellers. (6) The location of the apartments would increase traffic which would be a threat to the children coming and going to school. (7) The home owners of the area agree that the orchard presently on the .property should be removed because it is the location for criminal acts such as drug parties, and noise and dust disturbing activities such as motorbike riding. (8) It is their suggestion that rather than an apartment complex, a professional building or small stores be placed on this property, which would not increase traffic. (9) It is their understanding that the sewer line down ' Calera Avenue would be inadequate to serve the apart- ments and would need to be replaced, which would also increase taxes. (10) Apartments tend to bring in undesirable persons, and the home owners in the adjacent area would feel they would be forced to move to find peace and a better place to live. Michael Saffell, 6261 Hanlin Avenue, addressed Council and re-emphasized the fact that this opposition was the feeling of a majority of the people in the area and not just one or two persons. He further explained that the shortest route from the proposed apartments to the Freeway would be south on Calera Avenue and west on Mauna Loa Street, thus increasing the traffic going by the school. The congestion of people would also increase police problems. He felt the original concept of com- mercial zoning for this property was correct and would be in error to change it to residential. David Armstrong, 620 No. Cerritos Avenue, addressed Council stating that he felt the student body at Powell School would increase normally anyway, even without the apartment complex. He felt there was a need for housiln- in the City and that this housing would benefit the City -a§ a whole, where denial of the housing would benefit only a few people. Wayne Rowe, 6256 Hanlin Avenue, `addressed Council, re- emphasizing the desire of the residents to not lose the cul- de-sacs and also underlining the threat to the school children from the increase of careless drivers. He felt that if the property were developed commercially, the traffic would not increase on Calera Avenue and Mauna Loa Street, as shoppers would use Alosta and Citrus Avenues. Walker, 6250 Calera Avenue, addressed Council and expressed the present problem of apartment house dwellers parking in front of their properties, and expressed the feeling that this would be compounded with additional apart- ments in the area. James Fairchild, 1007 E. Hollyvale Street, addressed Council, stating he lived in one of the apartments already in the area and did not feel that the apartment residents parked their cars in front of the adjacent homes, particularly because of possible vandalism. Charles Rupert, 6262 Calera Avenue, addressed Council in response to a question raised by Councilman Clark and stated that the residents of the area have more trouble getting Azusa Police to respond to the disturbances in the City area than they do from the County Sheriffs re- sponding to the County territory just across the street. Janice Powell, 6239 Galanto Avenue, addressed Council and re-emphasized that there was no more room for addition- al children to attend Powell School. Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to close the hearing. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried by roll call to deny the appeal and to uphold Planning Commission Resolution #860, and to direct the City attorney to prepare the necessary Resolution denying the Variance. Councilman Decker explained he voted "Aye" not because of 'the testimony presented, but because he felt it is commercial property and he had objected previously to the other apart- ments going in. Council again considered the notice received from Alcoholic ABC Notice Beverage Control of a new On -Sale Beer (Food -Conditional) (302 N.Dalton License application by Maria R. Salce, for premises at "Sonora Cafe" - 302 No. Dalton Avenue, known as "Sonora Cafe", having M.Salce been tabled from 9/21/70 meeting. (filed) Moved by Councilman Clark, seconded by Councilman Rubio and unanimously carried to raise from the table. Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to file the Notice. The recommendation from the Personnel Board to revise Section 47, paragraphs 4 and 6, of the Rules and Regula- tions re: minimum increase of salary upon promotion or acting in a higher capacity, having been tabled at the 10/5/70 meeting, was again presented to Council. The City Administrator stated he had been unable to meet with representatives of the Associations and asked that the matter be held over to the next regular meeting. lMoved by Councilman Clark, seconded by Councilman Decker and unanimously carried that the item remain tabled to 11/2/70 meeting. A request was received from the attorneys for Mr. W. B. Req.granted Ihnen for continuance of abatement order on property at to Mr. W.B. 116 W. Foothill Blvd., ordered by Resolution #5761 Ihnen (Subst. (Substandard Structure Case #176). Str.Case#176) for 90 -day ext. Lawrence Teplin, of Leslie, Rubin & Teplin, attorneys re: abatement for Mr. Ihnen, addressed Council and explained to Council (116 W. Foot - that Mr. Ihnen had retained a registered Civil Engineer hill) to inspect the building, who reported that it would not be economically feasible to rehabilitate the building. Presently, Mr. Ihnen is looking for a buyer who would purchase the building and assume the cost of demolition. In the interim, Mr. Ihnen has fixed the roof, cleaned up the property, removed the offensive sign, closed off the upstairs portion of the building, and painted the front. Further, he has taken steps to cancel the lease for the hotel in the building and is preparing for the disposition of the proerty. A communication was received from the Personnel Board, with recommended classifications for Maintenance Man I, Maintenance Man II, and Maintenance Man III. As a result of the reclassification survey and subsequent recommendations, the classification of Maintenance Man was approved with three levels of salary. However, according to the Rules and Regulations, each salary must be related to a classification and the employee appointed to a classification,.or:.promoted by way of a competitive examination. In essence, a change of title only is involved which would match their position title to that of their salary, and all salaries remain the same. The following classifications were recommended for adoption, with salary levels which are already included in the salary schedule: ' Maintenance Man I Range 110.5 Maintenance Man II Range 112.0 Maintenance Man III Range 113.5 After discussion,it was Moved by Councilman Rubio, seconded by Councilman Snyder and unanimously carried to approve the recommendation, and to refer to the City Attorney for preparation of a Resolution at a later date, incorporating all new classifications. Man I,II, & III AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, OCTOBER 19, 1970 A communication was received from the Personnel Board, recommending that the former classification of Account Clerk be re-established and approved for the vacancy in the Accounting Department now classified as Intermediate Typist Clerk, with a salary range of 108.5, which is the same range as Intermediate Typist Clerk. The City Clerk explained the reason for the need to establish the position of Account Clerk instead of Intermediate Typist. Clerk in the Accounting Department, and took exception to the proposed salary range of 108.5. He explained that the type of duties required, in his estimation, should have a salary range of 109.5. Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried to refer back to the Personnel Board for further consideration of the proposed salary. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried to confirm the appointment. A report was submitted by the Police Chief regarding the installation of a television surveillance system for the exterior of the new Police Facility Building. Since the total cost is less than $3,500, the item would not have to be put out for bid and, therefore, he requested auth- orization for issuance of a purchase order to Metrovonics, Inc., of Los Alamitos, in the amount of $3,075 for the necessary equipment. Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried by roll call to approve the request. A report was received from the Police Chief regarding the termination of Mrs. Etba S. Casperson, Police Clerk, probationary, effective 10/33/70. Moved by Councilman Snyder, seconded by Councilman Rubio and unanimously carried to accept the termination, as recommended. A request was received from the Police Chief for con- firmation of the appointment of Mrs. Lillian B. Stewart as Police Clerk, probationary, at Step 1 of Range 109.5, effective 10/26/70. Moved by Councilman Rubio, seconded by Councilman Snyder and unanimously carried to confirm the appointment. A memorandum was received from the Building Inspector regarding Substandard Structures located at 723 No. Azusa Avenue, owned by Anthony M. Ortuno, and 733 No. Azusa Avenue, owned by Marsh, Fairfield, Suman, Inc., notifying Council that the owners of the above described properties have failed to comply with properly served notices to abate the substandard building violations on said properties, and that the period stipulated for compliance has expired. Council ascertained that the owners of the properties had not been notified that this matter was coming before Council and felt, in deference to them, that they should be notified prior to any action. Moved by Councilman Decker, sAcnnded by Councilman Rubio and unanimously carried to table these two Substandard Structure Cases to 11/2/70 meeting. A recommendation was received from the Acting City ,Engineer that Michael San Miguel, Civil Engineering Associate, be authorized to take a course on Structural Design at California State College in Los Angeles, with reimbursement of $48 tuition upon successful completion of the course. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried by roll call to approve the recom- mendation. A request was submitted by Mrs. Irene Gilbertson, Assis- tant Director of Civil Defense, to attend the Civil Defense Management Seminar (CDM -2-70), from October 26-30, 1970, to be held at Holiday Inn in Thousand Oaks, with reimbursed accountable expenses not to exceed $100. Per request of Council at a prior Council meeting, the Acting City Engineer submitted a report of planting and irrigation of the mountain sides north of the City. The report indicated that it was economically infeasible for the City to enter into such a program, and it was recom- mended that this program not be adopted by the City, but that the City support the ('forts of the U.S. Forest Service and other agencies. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried to receive and file the report. Inasmuch as plans for the Cerritos Avenue extension be- tween Fifth Street and Sierra Madre Avenue are nearing completion, and the Los Angeles'County Road Department will soon be acquiring segments'of right-of-way to complete the project, a recommendation was received from the Acting City Engineer for adoption of a Resolution of Consent to portions of Cerritos Ave. becoming part of County Highway System. A Resolution was presented, consenting to the establish- ment of portions of Cerritos Avenue, et al., within the City as a part of the system of County Highways. Councilman Rubio offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA CALIFORNIA, CONSENTING TO ESTABLISHMENT OF PORTIONS OF CERRITOS AVENUE, ET AL., WITHIN SAID CITY AS A PART OF THE SYSTEM OF COUNTY HIGHWAYS OF THE COUNTY OF LUS ANGELES. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried that further reading be waived. The City Administrator presented for approval an Agreement between the City and the County of Los Angeles for services provided by the Los Angeles County Sheriff's Department for the Azusa Golden Days Parade on 10/10/70, which Agreement has been approved as to form by the City Attorney. Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to approve said Agreement and authorize its execution. The City Administrator reported that the person who was to be employed as Administrative Secretary for his depart- ment would not be able to fill this position. He expressed to Council that he felt the position could be filled by a person with Senior Secretary abilities and asked for per- mission to proceed to have a list established for Senior Secretary.
