The City Council of the City of Azusa met in regular session at the above time and place, Mayor Solem called the meeting to order and led in the Call to Order salute to the flag. Invocation was given by Rev. Billy L. Lewis of Azusa Invocation Friends Church. The Minutes of the meeting of October 19, 1970, were Appvl. Min. approved as submitted. 10/19/70 The City Administrator read in full a Resolution commend- Res. #5792 Ing Neal and Joan Robertson for their leadership and con- commending Mr. scientious efforts which have resulted in outstanding & Mrs. Neal parades during the Golden Days Celebrations. Robertson for successful Councilman Rubio offered for adoption the Resolution Golden Days entitled: Parades A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA COMMENDING NEAL AND JOAN ROBERTSON. Moved by Councilman Rubio, seconded by Councilman Clark that the Resolution be adopted. Hearing on amendment to Sections 9206 and 9100.17, M.C. re: con - with the addition of Sections 920q.10(f) and 9210.10(h), dominium to the Municipal Code re: condominium developments, developments recommended by Planning Commission Resolution No. 874 (Planning Commission inititated), the Mayor declared the hearing open. The City Clerk presented the Affidavit of Proof of Publication of notice of this hearing in the Azusa Herald and Pomotropic on October 21, 1970. A memo was received from the Planning Commission, recom- mending the addition of the definition of "condominium", Its use in an R-2 zone and an R-3 zone after a public hearing in each case under a Conditional Use Permit, with the further recommendation, which pertains to park and recreation area, to revise the Municipal Code to read: "...the subdivider may pay or tender to the City. prior to approval of the final map and subject to such approval, a sum equivalent to $25 per each lot or dwelling unit, whichever is greater, contained in the subdivision...", which revision is being included at the request of the Park and Recreation Commission. The memo further stated that the Planning Commission adopted Resolution No. 873, establishing basic development standards for condominium developments, The Associate Planning Director addressed Council, explaining the amendments. No further communications having been received and no one in the audience wishing to be heard, it was Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried to close the hearing. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to approve the recommendation and instruct the City Attorney to prepare the necessary Ordinance. A request was received from David Miranda t:o address D.Miranda add. Council regarding opposition to a restaurarit in back of Council in meeting of 11/16/70 at 7:30 p.m, arid, if he wishes to 300 N. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1970 Page 3 A report was submitted by the City Administrator as a result of his meeting with the representative of the Police and Fire Association and of the City Employees Association. The report read that under the Personnel Board's recom- mendation, it is possible for an employee to receive slightly less than 22% increase upon promotion, which is not in the spirit of the present ruling. For instance, a Police Officer on 5th Step of Range 119A, if he were promoted to Sergeant, which is in Range 123, would receive an increase of only 2.25%. Therefore, it would appear that the first sentence of paragraph 4 should read as follows: When promoted, an employee is entitled to be paid minimum rate of the appropriate pay range or a min- imum of one pay step, or full range higher than his current pay range, whichever is higher; provided that such promotion shall give him a minimum increase of one full pay range." In the case of an employee acting temporarily in a higher classification, the employee representatives have indicated that they have no objection to•his receiving just one pay range or step, which is slightly less than 5%. It was recom- mended that Paragraph 6 be changed to read as follows, with the changed portion being underlined: "Any employee in any class, rank or position, acting temporarily in a higher classification, rank or posi- tion for the full working time of a period of more than thirty-one consecutive calendar days, shall, during the entire period in which such employee is acting in the higher classification, rank or position, receive,an appropriate salary that shall give him a minimum of one step or one full ranee increase." The City Administrator recommended that the matter be referred back to the Personnel Board for clarification and resubmittal to Council. Ray Quesada, president of the Azusa City Employees Associa- tion, addressed Council, stating they agreed with the recom- mendation of the City Administrator. After discussion, it was Moved by Councilman Clark, seconded by Councilman Rubio and unanimously carried to refer back to the Personnel Board for clarification as recommended. The memorandums to Council from the Building Inspector Tabled item re: Substandard Structures located at 723 and 733 No, re: Subst. Azusa Avenue, with notice that the period stipulated Struc. @ 723 for complicance has expired, having been tabled from & 733 N, ,the 10/19/70 meeting, was again presented to Council. Azusa Ave. Moved by Councilman Clark, seconded by Councilman Snyder and unanimously carried to'raise from the table. Re: Substandard Structure at 723 No. Azusa Avenue, Subst.Struc. owned by Anthony M. and Julia A. Ortuno, the Building @ 723 N.Azusa Inspector submitted a copy of the notice, dated October (Ortuno) 21, 1970, which he sent informing the owners that Council will consider further proceedings in this case on 11/2/70. Ortuno, 346 No. Azusa Avenue, addressed Council and reminded them he had stated at the outset that it would take more than 90 days to comply with the abatement order. He further stated he had been in contact with engineers and others, and hopes to have plans within two weeks to a month which would meet the nepessary require- ments. He asked for an additional 90 -days extension of the 'abatement order. Councilman Snyder declared that inasmuch as he was the engineer who designed the front wall of the subject build- ing, he would abstain from discussion and voting on this matter. Moved by Councilman Clark, seconded by Councilman Decker to grant a 30 -day extension to Mr. Ortuno for submission of plans by an engineer to the Building Inspector. Motion carried by the following vote of Council: AYES: Councilmen: Rubio, Decker, Clark, Solem NOES: Councilmen: None ABSENT: Councilmen: None ABSTAIN: Councilmen: Snyder Mr. Ortuno also stated he had a communication from the Building Inspector regarding his property at 231 No. Azusa Avenue, outlying the necessary corrections which must be made to bring the building up to Code to meet the Variance granted by the Planning Commission, and on the same day as he received the letter from the Building In- spector, he also received a letter from the Fire Depart- ment inquiring as to why he had not completed items listed in the letter from the Building Department. Re: Substandard Structure at 733 No. Azusa Avenue, owned by Marsh, Fairfield, Suman, Inc., the Building Inspector read in full the report from the District Engineer, in which it was stated that it does not appear practical to rehabilitate each store unit in The Arcade Building separately, and that there are now two vacancies. Mr. A. L. Suman, 332 Sturtevant Drive, Sierra Madre, addressed Council and referred to Council Minutes of 10/19/70 in which Mr. Ihnen, with property at 116 w. Foothill Boulevard, was granted an extension of 90 days for a number of re2sons which he feels applies to his case as well. He stated that he has conferred with structural engineers who do not feel it would be feasible to rehabilitate just one store within the building. He Is presently working on a proposed program to which he hoped the Council would agree, and therefore asked for a 90 -day extension of the abatement order. He pointed out that he cannot bring the building up to Code and maintain the rent on the stores at a price range com- mensurate with the market. He indicated a possible program which he would propose at a later date, where- by the City would purchase the property at this site. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried by roll call to grant a 30 -day extension, with the understanding that any further extensions not be granted unless something specific is presented. The Mayor asked that the City Clerk notify both Services of Council action. The City Clerk presented a claim against the City by Claim vs.City Luis Angel Baez for alleged wrongful arrest and personal by L.A.Baez damages on 7/20/70. re: wrongful arrest & pers. County Zoning Case ##5653-(1). fr.R-3 to C-4 The subject property is bounded by a single-family residential subdivision on the north and a drive-in dairy on the south; the entire frontage along the east side of Citrus Avenue, from subject property to Arrow Highway, is presently zoned C-4 and this request, if granted, would be an extension of this zoning for another 120 feet along Citrus Avenue. The City Attorney further stated that Mr. Taylor would meet with the City Administrator and the City Attorney on 11/12/70. In response to the concern expressed by Council at its Re: trains 10/19/70 meeting, the City Attorney had studied the blocking matter of trains blocking traffic on City streets due to traffic switching maneuvers. He pointed out that the Azusa Mun- icipal Code makes it illegal to block a street for more than a 20 -minute limit, and the League of California, Cities suggests a 10 -minute limit, and after consultation with the City Administrator, he, himself, suggests a 5 - minute limit. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, NOVEMBER 2, 1970 Page 8 A communication was submitted by the Personnel Board, stating that the eligibility list for Director of Pub- lic Works is being forwarded to Council without certif- ication by the Board, due to the interviewing board lacking one member (from another city) who was unable to attend and there was not time to obtain a replace- ment. It was the understanding on the part of the Personnel Board members that in lieu of the written test, the interviewing board would consist_of the Board members plus three registered engineers from private industry and municipalities, which conditions were not fully met and, therefore, the Board feels the list is invalid for certification. It was the opinion of the City Attorney that the oral examination was held and that, unless there was an error in the manner in which the examination was conducted, the absence of an expected member of the orals board was not sufficient reason to prevent certification of the list. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to refer this matter back to the Personnel Board for clarification, with an explanatory letter from the City Attorney. A memo was received from the Acting City Engineer, stating that the County of Los Angeles has initiated proceedings for sanitary sewers in Enid Avenue and in other streets in the county area adjacent to the City (County Sewer Improvement No. 2511, Enid Avenue Assess- ment District). A portion of the City, entirely owned by the Azusa Unified School District (Valleydale School), is included within said Assessment District, and the school district has indicated to the County Engineer that it is interested in being included in the Assess- ment District. In order that the County may adopt a Resolution of Intention, it is necessary that the City grant juris- diction to the County over the proceedings for the improvement. It was the recommendation of the Acting City Engineer that Council adopt a Resolution granting such consent and jurisdiction to the County. This year, the County Road Department informed the Acting City -Engineer that the County would no longer be able to provide this striping service because of lack of personnel and political pressure exerted by private 'striping contractors. The estimated cost for the.year would be $4,131.46. Moved by Councilman Decker, seconded by Councilman Clark and unanimously carried to approve the specifications and authorize the City Clerk to advertise for bids. A request was received from the Acting City Engineer for Appvl. employ. authorization for the Public Works Department to employ of Maint.Man I, a Maintenance Man I on a temporary basis for approx- temp., for imately one month, due to the overload on the existing approx. 1 mo. City Building Maintenance personnel caused by the re- construction of the City Hall east wing. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried to approve the request. The City Administrator presented a commendation to Commendation Council from Policewoman -Detective M. P. "Pinky" to Cncl. from Hunter for the unlimited support they gave to a "Pinky" Hunter Statewide Training Institute of Women Peace Officers' for support re: Association. Statewide Train. The Police Chief submitted the resignation of Robert Resig. R.W.Termath W. Termath from the Police Reserve Corps, effective as Pol. The City Administrator submitted a request to attend Auth.attend.@ City Annexations Subcommittee Meeting of the Interim City Annex.Sub- Assembly Committee on Local Government, to be held on com.mtg. @ San 12/2/70 at the San Diego County Administration Center. Clark and unanimously carried to grant the request & Councilmen and approve the attendance at said meeting of the City Administrator, Associate Planning Director, City Clerk, and any available Councilmen. A request was presented for approval by the Police Appv. reinst. 'Chief for authorization to expend $320 per this fiscal in P.D. budget year for shooting bonuses. He pointed out to Council of $320 for that this had been a regular item in previous budgets shooting but inadvertently had been omitted from this year's bonuses budget. He stated that there was sufficient money within his budget to cover this amount. Moved by Councilman Clark, seconded by Councilman Decker and unanimously carried by roll call to approve the request. Ed tyck, 18671 Milton Drive, Glendora, addressed Ed Tyck re: Council with regard to the condominium development P.C.Res. 877 on -the north end of town and the Planning Commission's grtg.Var. (V-256, recommendation for required parking spaces. The City Clerk read in full a Resolution authorizing payment of warrants by the City. Councilman Clark offered for adoption the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
