The City Council of the City of Azusa met in adjourned
regular session at the above time and place.
Mayor Jens J. Solem called the meeting to order. Call to Order
Present at Roll Call: Councilmen: Snyder, Clark Roll Call

Absent: Councilmen: Rubio, Decker
Also Present: City Administrator Sandwick, City
Attorney Wakefield, City Clerk Klarr
Mr. Edward Taylor, Special Counsel for Water Litigation,. Spec.Water
addressed Council in response to its request of the Counsel,E.
October 19, 1970 meeting. He discussed his recom- Taylor, ad-

Municipal Water District and City of Alhambra et al. for reference
The motion would be to refer certain engineering
matters to the State Water Resources Board. Their
report would become a reference for the Court.
During the discussion, Mr. Taylor pointed out that
a settlement of the litigation on the present basis
for water usage accepted by the USGVMWD would, in
effect, be a cut back to 1963 production level among
the three cities of the SGVMWD. The three cities
(Alhambra, Azusa, Monterey Park) have no way of insur-
ing the delivery of supplemental water and, therefore,
cannot stipulate to the water production allowance
that the other cities had agreed to. Because of this,
the smaller district must use whatever means possible
to increase the amount of water allowed for production.
In order to achieve this, he felt it necessary to

file the motion for reference with regard to certain
engineering information concerning basin capacity and
water production. He indicated that the other cities
were interested in seeking such a reference. The
purpose of the reference is to have a second report
by an objective body, instead of relying solely upon
the engineering report by one firm, which had done
the engineering for the Upper District. The motion
must be filed by December 31, 1970.
Councilman Decker entered the meeting at 6:51 p.m.

Mr. Ira Calvert, member of the SGVMW District, ex-
pressed his feelings that, while the motion for a
reference may be legally correct, from a practical
view point he felt it would be expensive and a long
delay. He further stated that the engineering firm
which has already done this work was correct, and that
the State would simply be duplicating its work. Mr.
Taylor responded with the feeling that many people
do not like to reply upon only one source of information,
particularly when this source has been employed by one
party in the litigation. He felt the State survey
would be considered as more impartial. He also
stated that the motion should be made, and if the
cities felt the estimated cost was too much, they
could request the Judge to withdraw the motion.
Councilman Rubio entered the meeting at 7:18 p.m.

Further discussion was held with regard to supplemental
water, the contract with the State for such water, the
problem with the physical delivery of the water, and the
question of funding such a delivery, and a bond issue.
After further discussion, it was
'Moved by Councilman Decker, seconded by Councilman Rubio
to follow the recommendation to authorize the motion for
reference. The motion 'failed by the following vote of
Council:

ABSENT: Councilmen: None
Moved by Councilman Clark, seconded by Councilman Snyder
and unanimously carried that this motion be tabled to
the December 7, 1970 Council meeting.
