Mayor Solem called the meeting to order and led in the salute to the flag. Invocation was given by Rev. B. J. Paroulek of the First Presbyterian Church. The Minutes of the adjourned meeting of November 16, 1970, were approved as submitted. The Minutes of the regular meeting of November 16, 1970, were submitted, and the City Clerk requested that a correction be made on page 7, adding the motion re: appointment of M. Wells as Director of Public Works, after the 4th paragraph from the bottom, as follows: "Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to approve the recommendation." Minutes were then approved as corrected. The Mayor presented a Certificate of Appreciation to John Doiron, a Boy Scout, for his efforts and thought- ulness in preparing a study on the City Bikeways. he City Clerk announced that bids were opened in his ffice at 10:00 a.m. on Thursday, December 3, 1970, for restriping of various City streets. Present at bid opening were: City Treasurer Watkins, Director of.Parks and Recreation Dangleis, Civil Engineering Assistant Carmichael, and City Clerk Klarr. The City Clerk presented the affidavit of proof of publication of the Notice Inviting Bids, published on November 18 and 25, 1970, in the Azusa Herald & Pomotropic. Irecommendation was received from the Director of Public orks that the contract be awarded to Pavement Markers, o., Inc., low bidder. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried by roll call to accept the recom- mendation of the Director of Public Works to award the bid to Pavement Markers Co., Inc., low bidder ($4,212.06), and return any bid securities to the unsuccessful bidder, after contract has been signed. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, DECEMBER 7, 1970 Page 2 The hour of 7:30 p.m. being the time set for the public hearing on an appeal from denial of a zone change from C-2 to R -3b, by Planning Commission Resolution ;#881, on property at 791 So. Azusa Avenue, excluding 200 feet frontage easterly thereof (Case Z-160 - M. I. Siskin)gthe Mayor declared the hearing open. The City Clerk presented the affidavit of proof of publication of the Notice of this Public Hearing on 1/25/70 in the Azusa Herald & Pomotropic, and the f1davit of posting of Notice of this Hearing on 11/24/70. memo was received from the Planning Commission which stated that the applicant proposes to develop this area with three-story apartment building and a garage structure; this, however, would require a Variance since 2Z stories is maximum permitted in any residential zone. Further, the Planning Commission felt that, due to the commercial development already in this area, the subject property will. ultimately be one of the major commercial centers within the City; also that this parcel is one of the few remaining parcels of greater than 5 acres, within the City's boundaries or planning area, with frontage on a maior highway. The memo further stated that a develop- ment, as proposed, would provide a buffer between the single-family residential use to the west and the com- mercial use to the east. However, it would serve as a buffer to only this one portion, since commercial use abuts single-family residential to the north, and com- mercial zoning abuts single-family residential to the south; and since this would be surrounded by commercial on three sides, a spot zoning effect would result. te City Clerk presented s letter from the applicant, rshall I. Siskin, who requested that this hearing be stponed until 12/21/70. Moved by Councilman Decker, seconded by Councilman Rubio and unanimously carried to continue the hearing to 12/21/70 at 7:30 p.m. The 30 -day extension granted on 11/2/70, for submission of plans by an engineer to the Building Inspector, having expired, the Substandard Structure Abatement Program on property located at 723 No. Azusa Avenue, owned by Anthony M. and Julia S. Ortuno, was again brought to Council. The City Clerk read a letter from Richard J. House, Contractor, to Mr. Ortuno, dated 11/23/70, which gave confirmation of their recent agreement to provide the plans and specifications necessary to rectify th- sub- standard conditions as cited by the City to the build- ings at 723 No. Azusa Avenue. It further stated that the plan is to provide preliminary designs and specif- ications that will correct the deficiencies, submit these to the City, and then, after obtaining preliminary approval, complete the working set of plans. tr bert Schwab, attorney, 190 No. Canyon Drive,addressed Council. He stated that he had just cently been engaged to represent Mr. Ortuno and, to his knowledge at this time, he felt that these proceed- ings were not providing equal protection under the law, and would deprive a person of property without due process, and therefore requested that this matter be held over for 30 days in order to give him time to research the facts of the case and to confer with the City Attorney in order to come to an agreement. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, DECEMBER 7, 1970 The Council noted that it had given an extension to Mr. Ortuno, with the understanding that he would submit plans that would meet the abatement request. It was understood that such plans had been submitted. Mr. Schwab informed Council that the plans had been withdrawn pending investigation of the action. The City Attorney reviewed the history of the case for Council and was of the opinion that Council need not grant the further xtension requested. d Tyck, 703 No. Azusa Avenue, addressed Council, express- ing the feeling that action with regard to upgrading the central business district has taker: so many years that it would not be unreasonable to grant Mr. Ortuno's attorney the additional 30 -days extension he requested. The City Attorney outlined for Council the following three possible procedures: (1) Council may order use of the premises discontinued until corrective action is taken. (2) Refer to the District Attorney for appropriate pro- ceedings for violations of the City Ordinance. (3) City to undertake the work of repair or rehabilita- tion, or to demolish the building, the cost of the work to be assessed against the property owner and placed on his regular tax bill for 1971-72. After discussion, it was Moved by Councilman Snyder, seconded by Councilman Clark to efer this matter to the District Attorney to determine ppropriate proceedings for violations of the City Ordinance. ot.ion carried by the following vote of Council: AYES: Councilmen: Rubio, Snyder, Clark, Solem NOES: Councilmen: Decker ABSENT: Councilmen: None The 30 -day extension granted on 11/2/70, with the under- standing that any fi—ther extensions not b^ granted unless something specific is presented, having expired, the Sub- standard Structure Abatement Program on property located at ;'33 No. Azusa Avenue, owned by Marsh, Fairfield, Suman, Inc., was again brought to Council. The City Clerk presented a memo from the City Adminis- trator, with copies of letters to Mr. Suman from two Structural Engineers. According to the memo, Mr. Suman and his daughter met with Mr. A. R. Buchan. Distrtct Engineer, Div. of Building and Safety of the Los Angeles County Engineer's Department, and the City Administrator, and various methods of rehabilitating the structure and/ or demolition of parts or all of it were discussed: however, Mr. Suman did not make any comment or present any plan s to his decision whether he wished to bring the build - ng up to code or to have it demolished. He left copies f letters from two structural engineers, as well as eports from the L. A. County Building Department, regard- ing this structure. Mr. A. L. Suman, 332 Sturtevant Drive, Sierra Madre, addressed Council and stated that the City has no plan for construction, that the whole procedure is one of destruction. He further felt that he could reiterate the same two points made by Mr. Schwab, attorney for Mr. Cr:;uno. He stated that he had no intention of upgrading t,ie structure under the coercion of Council. Motion carried by the following vote of Council: AYES: Councilmen: Rubio, Snyder, Clark, Solem NOES: Councilmen: Decker ABSENT: Councilmen: None ou.ncilman Decker said he voted"No" because, while something hould be done, he did not feel that this was the most advantageous alternative of the three procedures. The decision of Council re: authorizing a motion for reference for water litigation (Upper San Gabriel Valley Municipal Water District vs. City of Azusa, et al.), having been tabled from the adjourned meeting of 11/16/70, was placed before Council for consideration. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried to lift from the table. Moved by Councilman Decker, seconded by Councilman Snyder to follow the recommendation of the City Attorney to auth- orize Mr. Edward F. Taylor, Special Water Counsel, to file the proposed motion to refer this litigation to the State Water Resources Control Board for investigation and report upon all physical facts. The City Clerk presented a petition, containing 240 signatures without addresses, submitted by Patrick Clark, which requested enactment of an Ordinance making it illegal in Azusa for bottled beverages to be sold with - tut a deposit placedon the bottle. he Council discussed the advisability of having a Com- mittee to study ecology and environmental problems. Patrick Clark. 1125 No. Alameda Avenue, author of the petition, appeared before Council and was asked if he would consider serving on such a Committee, to which he answered affirmatively. Moved by Councilman Rubio, seconded by Councilman Decker and unanimously carried that the appointment of an Ecology Committee be placed as an Agenda item for the 12/21/70 meeting. Councilman Snyder stated that he felt that Mr. Clark and the young people who had signed the petititon are to be commended for taking an active interest in the better- ment: of this community. The City Clerk presented a Resolution from the Modesto City Council urging action with regard to non -returnable containers. ovE!d by Councilman Snyder, seconded by Councilman Clark nd unanimously carried to refer this matter to the roposed Ecology Committee. The City Clerk presented a petition, containing 23 signatures, submitted by Mr. and Mrs. R. Woodcock, re- questing City action with regard to juvenile problems on So. Virginia Avenue. A letter was also received from Mr. and Mrs. Woodcock, which stated that they have had to call the Azusa Police Department numerous times because of the 4 or 5 boys from different neighborhoods who congregate at two of the houses on the 400 block of So. Virginia Avenue and harass the neighborhood by: (1) riding a Mr.Ed.Taylor auth.to file motion to refer litig.to State Water Res.Con. Ray Woodcock, 444 So. The owners of both of the above buildings have been sent the first notice which allows them 14 days within which to comply. No action has been taken on either building, and neither owner has contacted the Building Inspector egarding them, as of 11/18/70. The following alternates were submitted for improving both the pressure and the quantity of water served to this area: Alternate 4!1. The best.way to provide both fire on-stnd domestic few to the subject properties is to con- s truct ruct a new main with a minimum diameter of 6" in San abriel Canyon Road and connect it to the existing water system in the intersection of Sierra Madre and Azusa Avenues. The water system at this point is on Water Zone No. 3, which is a higher pressure zone and is capable of supplying a static pressure of 90 p.s.i. The estimated cost of this alternate would be $25,000. Alternate #2. Another approach which would increase the static pressure on the existing 114" water main is to connect the line in San Gabriel Canyon Raod to an ex- isting 4" main on Old "an Gabriel Road. The 4" main Is presently on the higher Zone No. 3. Making this connection would involve securing an easement over private property at the existing Bait Shop, the con- struction of approximately 75 lineal feet of 2" gal- vanized water line, and securing the permission of the owners of the Foothill Dairy. This last requirement is necessary because of an existing agreement between the City and the Dairy, entered into at the time the City acquired the 4" line. This alternate will only improve the domestic pressure by 50% b+it wit- not affect the present fire flow deficiencies. The r•^Ft of this alternate is estimated tc be approximately $200 or repair and material for City crews to make the or.r.ection. It was recommended by the Director of Public Works that Council adopt Alternate No. 2 and authorize the Public Works Department to make the connection to Water Zone No Implementation of Alternate No. 1 could be budgeted in the future, possibly after the time that these properties are annexed to the City. The Director of Public Works submitted a report re: updating the City's Bikeway System, accordin^ to the recommendations contained in Scout Doiron's study. On an inspection of the Bikeway System, it was learned that all of the signs are faded and look rather shabby. Also, the System should be re -dedicated as the "Harry Wharton Memorial Bikeway", and the new signs could carry that legend in recognition of the efforts of the ate Mr. Wharton who was Vice -President of the Azusa hamber of Commerce at the time the System was established. t is estimated there are 75 signs to be placed or re - laced. The existing signs were purchased from Huffman Manufacturing Co, in Azusa through arrangements by the Charrber of Commerce, and the Director of Public Works would follow thissame procedure. It was the recommendation of the Director of Public Works that Council adopt the extensions of the bike route and authorize the re -naming to "Harry Wharton Memorial Bikeway". Dir.
