Mayor Solem called the meeting to order and led in the salute to the flag. Invocation was given by Mr. Donald Frazier of Christ -lar. Scientist ClurCh. Minutes were approved as corrected. The hour of 7:30 p.m. being the time set for the contin- ued public hearing on substandard structure Case No. 71-5 70.t N. Azusa Avenue - Heesy Corp. (cont, from the 7/6/71 meeting), the Mayor declared the hearing open. The City Clerk presented a letter from Nicholas Heesy, of the Heesy Corporation, requesting that the hear.in- be continued because he is presently having the structure studied by an engineer and architect. He would Like to have their reports before meeting with the Council. Moved by Councilman Snyder, seconded by Councilman, Rubio and unanimously carried to continue the hearing to 8;`16%71. The hour of 7:30 p.m. being -the time set for the public hearing on the sub -standard structure Case No.' 71-7 (731 & 735 N. Azusa Ave. - Marsh, Fairchild & :uman, Inc.), the Mayor declared the hearing open. The City Clerk did not have'a copy of the affidavit of proof of publication present at the meeting. The City Attorney stated that it was not necessary for the affidavit to be present if the publication has been made. (The affidavit was later found, and inserted into the proper file). Publication for the hearing was made on July 7, 1971, in the Azusa Herald & Pomotropi.c, Tom Hildebrand, City Building Inspector, appeared before Council and was sworn in by the City Clerk for all testimony he was to give,. (cont.to 8/2/71) 'mortar construction in deteriorated condition and in his opinion the structure is unsafe in the event of earthquakes. He was not able to gain access to the building for inspection on the inside. However, the buildings appeared to be vacant. He had contacted the owner to determine whether the buildings were occupied, and the owner was unable or unwilling to tell him whether they were or not. The City Council asked that a report be made on the status of utility services and business licenses with regard to the subject location before a decision could be reached on this matter. Abated) Tom Hildebrand the City Building Iinspector..addressed Council and stated that the building, was a two story frame structure badly dilapidated, presently unoccupied, with no utility services. He stated he had inspected both the interior and exterior and found the building to be very dilapidated, and a major fire, health and safety hazard, that the yard and lot area are non -complying, that the premises are unsanitary,. -and that termite infes- tation is evident. Mr. Frank Noriega owner of the property addressed Council and confirmed that the structure is un -occupied and stated that, while 1�e has no plans for use of the building, he cannot affoid to rehabilitate it or demolish it. There being no one else present wishing to testify or no further communications, it was Moved by douncilman Decker, seconded b-, Councilman Rubio and unanimously carried to close the hearing. Councilman Decker offered the Resolution entitled: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DETvPVT*TTNG AND DECLARING THAT A CERTAIN STRUCTURE IS AN UNSAFE BUILDING AND A PUBLIC NUISANCE AND THAT THE SAME SHOULD BE ABATED. The hour of 7:30 p.m, also being the t'me set for the Pub.Hrg. on public hearing on recommended zone change from C -c to reeomm, zone C-3 on property located at the N.E. corner of Azusa Ave. change frm. C-2- & Gladstone St., known as the Edgewood Shopping Center C-3 on propty. (P.C. Resolution •#915 - Gordon R. Howard), the Mayor known as the c.eclared the hearing open. Edgewood Shop- ping Center The City Clerk presented the affidavit of proof of publication of the Notice of this Hearing, published on July 7, 1971, in the Azusa Herald & Pomotropic, and the affidavit of posting on July 9, 1971. A, memo was submitted from the Planning Commission Indicating that this particular shopping center is the only large shopping center in the City that is not zoned C-3, and that there are businesses which are interested In locating in the shopping center, which could only locate in a C-3 zone. The Planning Commission had recom- mended the approval of the zone change-. AZUSA AUDITORIUM AZUSA, CALIFORNIA MONDAY, JULY 19, 1971 Page 3 The City Clerk presented a petition with 26 signatures, whereby residents in the adjoining neighborhood requested that this shopping center fill in the openings in its wall separating the center from the re^idential area, and build the wall 2 ft. taller. The City Attorney noted that a zone change cannot be made conditional. R. C. Mendelson, 161 E. Gladstone St., manager of the Edgewood Shopping Center addressed Council. He stated that the center would be willing to close the openings in the block wall, particularly as an aid to the Police Department. He pointed out that presently under the C-2 zoning the center must petitio Council for permission on many small things, which it would not have to do with the requested C-3 zoning. No one else in the audience wishing to be heard and no further communications having been received, it was Moved by Councilman Clark, second ed by Councilman Snyderand unanimously carried that the hearing be closed. Moved by Councilman Decker, seconded by Councilman Snyder and unanimously carried to approve the zone change from C-2 to C-3 and to instruct the City Attorney to prepare the necessary Ordinance. The Mayor stated that Mr. Donald Watson, Mayor of the City of Duarte was present to make an award to the City. Mayor Watson addressed the Council and stated that representatives of the City of Azusa and the City of Duarte had engaged in a friendly game of golf recently, and that --the Azusa representatives had won this game by 1 stroke. Therefore, he is presenting a trophy specially constructed to Commemorate this event, to the City of Azusa. The plaque was not ready for the presentation, but will be forwarded to the City to be affixed to the trophy, and will read: "July 10, 1971 - the Sandbaggers of Azusa defeated the Duffers of Duarte". Mayor Watson expressed his feelings that more events of this nature should be held by the two Citim to enhance their friendly relationship. The trophy was received by Mayor Solem and Councilmen Decker and Snyder, who had been involved in the tournament, on behalf of the City. The hour of 7:30 p.m. also being the time set for the public hearing on an appeal from denial of a Variance by Planning Commission Resolution No. 912, to allow a sign area of 610 sq. ft., instead of permitted 150 sq— ft-in Freeway Zone, on property located at 103 S. Azusa Avenue (Case V-268 - Melvin Hensley), the Mayor declared the hearing open. The City Clerk presented the affidavit of proof of pub- 1.i2ation of the Notice of this Hearing, published on July 7, 1971 in the Azusa Herald & Pomotropic, and also the affidavit of posting on July 9, 1971. The Planning Commission submitted a memo whereby it stated that the requested sign area was in excess of 401 of the permitted sign area and that this was un- reasonable. Melvin E. Hensley, 103 S. A/,, -R Avenue, owner of the property, stated that he is now asking for a reduced amount of sign area and needs only acs additiona1,140 sq. ft. He showed a slide photo of the type of sign he would like to have. He pointed out that his store is exposed on three sides where normally a store was exposed on only one side; and that he needs the identification to establish his trade at this location. He pointed out that the City could adopt a policy whereby the addresses of Police Officers can be made confidential because of the nature of their services and the possible danger that they could face from such information being made public. He recommended that he meet with the Personnel Board in preparing a suitable policy regarding availability of names and addresses of the City Employees, and other similar information, to the public. Moved by Councilman Rubio, seconded by Councilman Snyder and unanimously carried to refer the matter back to the City Administrator, City Attorney and the Personnel Board. A memo was submitted to Council from the Personnel Board re: the recertification of the Police Sergeant eligibility list No. XII by moving everyone up one position. Eligibility List A memo was received from the Personnel Board recommending Res. #5875 a revision of the Personnel Rules & Regulations Section amend. Section 91 re: Holidays. The recommendation would exempt Police 91 of R&R re: & Fire Personnel from receiving Holiday pay during their Holidays normal work time on Sundays. The City Clerk pointed out that when the Council had adopted the Resolution which brought the Personnel Rules & Regulations into agreement with the State listing of Holidays, the Resolution had inadvertently made a change in policy which had not been the intention of the Council Ito do. This change allowed the interpretation whereby persons whose job requires shift work, i.e., the Police & Fire Personnel, '.o be eligible to receive compensation of one and one ha'.f times for their normal working time on Sundays. He recommended, along with the Personnel Board, that a Resolution be adopted rectifying this error. A Resolution was presented which would rectify this error, effective as of February 1, 1971. Councilman Decker offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 91 OF THE PERSONNEL RULES & REGULATIONS, RELATING TO HOLIDAYS. The Director of Public Works submitted for adoption Res. #5881 re: a Resolution providing binder with respect to compliance Land Acquisition with the Land Acquisition Requirements of the Uniform Requirements Relocation Assistance and Real Property Acquisi*'on Policies Act of 1970. This is necessary for funds for reservoir from H.U.D. Councilman Decker offered the Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA REALATIVE TO BINDER WITH RESPECT TO COMPLIANCE WITH THE LAND ACQUISITION REQUIREMENTS OF THE UNIFORM RELOACTION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES OF 1970. The City Administrator informed Council that the contract S.T.E.P. Mozer, Consulting Engineer, from the firm Report on City's of Cornell, Howland, Hayes & Merryfield presented a Electrical report, with the use of slides, to the City Council Distribution concerning the City's Electrical Distribution System. System His statements were included in the formal written report Snyder further informed Council which had been submitted. Generally the report showed The Mayor submitted to the City's electrical distribution system in very good the regular condition, having been planned well and maintained in meeting of the USGVWA, a very good manner. The report did not show need for Restaurant, the construction of a new substation at this time, but Rosemead, California, did indicate the need for conversion.of the rAmaining 1971, 4 KV transmission lines to 12 KV, over a period of no dinner at 6:30 p.m. more than 5 years. Some undergrounding was recommended a"Lso. After the presentation he answered questions from the Council. The Council thanked him for his presentation and a well it appeared presented report.
