BACKGROUND:
The City has an Exclusive Franchise Agreement (Agreement) with Athens Services (Franchised Hauler)
for refuse collection and recycling services. Under the Agreement, each year refuse rates charged to
residents and businesses are adjusted to reflect changes in collection and disposal costs and the volume of
refuse collected in Azusa. Unfortunately, residential disposal volumes last year increased significantly
(21%) due to COVID related activities, which in turn was the primary cause of the proposed 16.55%
increase in residential barrel service rates. On the other hand, business volumes decreased due to less
activity during the COVID shutdowns, and the proposed action would decrease commercial rates by 2% to
9%, depending on the level of service. Pursuant to Proposition 218, all refuse and organics rate adjustments
must be approved at a public hearing with a notice to the public 45 days in advance of the hearing. The
Public Hearing Notice was mailed on June 2nd, 2021 and advertised in the local newspaper on July 8, 2021.
RECOMMENDATION:
Staff recommends the City Council take the following actions:
1) Open the Public Hearing, receive public testimony, and close the Public Hearing;
2)Adopt Resolution No. 2021-C33 approving the annual refuse collection and organic waste
recycling rate adjustment for Athens Services effective retroactive to July 1, 2021.
ANALYSIS:
Refuse from residential and commercial properties in the City is collected by Athens Services and taken to
Athens’ Material Recovery Facility (MRF) where most recyclable materials are separated and recycled.
The residual non-recyclable waste is then transported by Athens to Mid-Valley Landfill in the City of
Rialto. The green organic materials are delivered directly to Recycled Wood Products in the City of
Pomona for composting and mulching.
Refuse rates are comprised of four components: (1) processing/disposal fees; (2) service fees; (3) franchise
fees; and (4) AB 939 fees. Residential rates include a fifth component: customer service charges (since the
City bills residential customers directly). Each year refuse rates are adjusted to reflect changes in the cost
of doing business, as measured by fluctuations in the Consumer Price Index (CPI), published by the U.S.

Department of Labor, Bureau of Labor Statistics, for the Los Angeles/Riverside/Orange County and to
account for increases in disposal costs. The CPI from January 2020 to January 2021 is 0.87%.
Pursuant to the City’s franchise agreement with Athens, disposal costs are passed through to the ratepayers
automatically. The cost of disposal at the Mid-Valley Landfill where the City’s waste is disposed of is
anticipated to increase from $33.46 to $33.86 per ton. There was also a significant increase in green waste
processing and diversion services fee beginning November 2019 from $48.41 to $49.86 per ton due to the
implementation of AB 1594 (Green Waste Diversion Bill). Per AB 1594, green materials used as
Alternative Daily Cover (ADC) will no longer be considered as diversion as of January 1, 2020.
Jurisdictions must have plans/programs to divert green materials from landfill or risk not being able to meet
its AB 939 diversion goal.
Since processing and disposal fees are calculated based on the amount of waste disposed using the true-up
method, the increase in residential rates is due to the 21% increase in disposal tonnage in 2020 as a result
of COVID-19. Due to the Stay Home order, more people have been staying home and cleaning out their
spaces. Commercial rates, on the other hand, decreased by 2 to 9% depending on service level due to
business closures. The disposal trend is not unique to Azusa but all throughout the country.
The proposed FY 2021/2022 rates are summarized below in Table 1.

In October 2014, Governor Brown signed AB 1826 (Mandatory Commercial Organics Recycling),
requiring all commercial customers (businesses and multi-family dwellings with 5 units or more) to recycle
their organic waste on and after April 1, 2016, depending on the amount they generate each week. Organic
waste includes food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-
soiled paper waste that is mixed in with food waste. Effective January 1, 2020, all commercial customers
that generate 2 or more cubic yards of solid waste per week will be required to arrange for organic waste
recycling services if CalRecycle determines that statewide disposal of organic waste in 2020 has not been
reduced by 50% of 2014 levels.

In order to comply with AB 1826, the City Council authorized Athens Services to charge a monthly rate in
implementing a commercial organic recycling program for businesses that are required to implement an
organic recycling program and are adjusted by CPI percentage change.
The proposed FY 2021/2022 rates are summarized below in Table 2.

Because the City anticipates future rate adjustment in the cost of providing trash services that Athens
Services will charge pursuant to the Franchise Agreement, the City proposed on July 20, 2020 to annually
pass through to trash service customers automatic adjustments calculated based upon the rate adjustment
methodology per Franchise Agreement. As approved, beginning July 1, 2020, and each July 1 thereafter
for a five-year period, through and including adjustments effective on or after July 1, 2024, the trash rates
may be adjusted annually, without a further public hearing subject to a maximum of 5% annually. Trash
service customers will be notified 30 days before the effective date of an automatic rate adjustment. When
refuse and organic recycling rate adjustment exceed 5% in any single year, another public hearing will be
held to consider that proposed rate adjustment. In no event may an automatic adjustment exceed the City’s
cost of providing trash services. Since the rates are over 5%, a Public Hearing is required for rates effective
July 1, 2021.
FISCAL IMPACT:
The fiscal impact of the proposed rate adjustment will vary by customer class: single family residential
rates will increase 16.55 % or $4.71 per month; multi-family bin rates will increase 5.5 % or $24.81 per
month; and commercial rates will decrease -2.9 % to -9.15% depending on the service level.

RESOLUTION NO. 2021-C33
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA,
CALIFORNIA, APPROVING THE TWENTY-FIFTH AMENDMENT
TO THE EXCLUSIVE FRANCHISE AGREEMENT WITH ARAKELIAN
ENTERPRISES TO AMEND THE REFUSE RATES AND THE
MONTHLY ORGANIC RECYCLING FEES EFFECTIVE RETROCATIVE
TO JULY 1, 2021 THROUGH JUNE 30, 2022
WHEREAS, on October 2, 2000, the City Council of the City of Azusa, approved
an Exclusive Franchise Agreement with Arakelian Enterprises, Incorporated (Contractor), for
refuse collection and recycling services ("Original Agreement"); and
WHEREAS, Section 5 of the Original Agreement requires that the refuse rates be
modified annually to account for the cost of living changes, disposal costs, and other
adjustments due to extraordinary increases in operating costs ("Adjustments") on July 1 of each
year; and
WHEREAS, refuse rate adjustments have been calculated pursuant to the terms and
conditions of the Original Agreement;
WHEREAS, Assembly Bill 1826 (Chesbro, 2014) was signed into law and requires
businesses to recycle their organic waste on and after April 1, 2016, depending on the amount they
generate each week;
WHEREAS, AB 1826 defines “organic waste” as food waste, green waste, landscape and
pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food
waste; and
WHEREAS, the City is required by state law to implement an organic waste recycling
program for businesses that are required by AB 1826 to implement organic waste recycling;
WHEREAS, in order to implement the Organics Recycling Program in the City, Athens
Services, the City’s franchised trash hauler, is offering organic recycling services to businesses
that are required to implement an organic recycling program under AB 1826, and may charge
businesses that utilize such services for the cost of those services;
WHEREAS, without the adoption of rates, Athens is unable to charge for and provide this
service as it’s not currently included in the Original Agreement between Athens and the City;
WHEREAS, per AB 1826, effective January 1, 2020, all commercial customers that
generate 2 or more cubic yards of solid waste per week will be required to arrange for organic
waste recycling services if CalRecycle determines that statewide disposal of organic waste in 2020
has not been reduced by 50% of 2014 levels;
WHEREAS, the Monthly Organic Waste Recycling Rates attached herewith will be
adopted and applicable only to businesses required to comply with AB 1826 effective January 1,
2020;
WHEREAS, the City is proposing automatic rate adjustment beginning July 1, 2021, and
each July 1 thereafter for a five-year period, through and including adjustments effective on or
after July 1, 2024, the trash rates may be adjusted annually, without a further public hearing, by an

amount not to exceed the total of a CPI increase for inflation plus any increase in Tipping Fees,
subject to a maximum of 5% annually. If a rate adjustment should exceed this amount in any
single year, another public hearing will be held to consider that proposed rate adjustment.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Azusa,
California, does find and declare that:
SECTION 1: Adoption of 25th Amendment. The attached 25th Amendment to the
Exclusive Franchise Agreement Between the City of Azusa and Arakelian
Enterprises, Inc. for Refuse Collection, Recycling and Disposal Services
(Exhibit A) is hereby approved. The rate schedule adopted as part of the
Twenty-fifth Amendment shall supersede any rate schedule previously
adopted.
SECTION 2: Adoption of the Monthly Organic Waste Recycling Rates. The Monthly Organic
Waste Recycling Rate Schedule (Exhibit B) is approved and applicable to
businesses required under AB 1826 threshold.
SECTION 3: Effective Date. This Resolution shall become effective upon its adoption.
SECTION 4: Adoption of Automatic Rate Adjustment. If approved, beginning July 1,
2021, and each July 1 thereafter for a five-year period, through and
including adjustments effective on or after July 1, 2024, the trash rates may
be adjusted annually, without a further public hearing, by an amount not to
exceed the total of a CPI increase for inflation plus any increase in Tipping
Fees, subject to a maximum of 5% annually. If a rate adjustment should
exceed this amount in any single year, another public hearing will be held to

SECTION 5: Authorization. That the Mayor shall sign and the City Clerk shall

This twenty-fifth Amendment to the Exclusive Franchise Agreement is
entered into this 19th day of July 202 1 by and between the City of Azusa, a
municipal corporation ("City") and Arakelian Enterprises, Inc., a California
Corporation ("Contractor").
Effective retroactive to July 1st, 2021, the attached rate schedule shall replace
Exhibit A of the Existing Exclusive Franchise Agreement approved on October 2, 2000.
MONTHLY ORGANIC WASTE RECYCLING RATES
T he Monthly Organic Waste Recycling Rate Schedule (Exhibit B) for businesses
required under AB 1826 threshold to arrange for organic waste recycling services .

all glass, plastics, metal and paper products are removed and recycled. Other portions of the trash rate include City fees, such as 10% franchise
fee, AB 939 or Recycling fee, billing fee, and fee to make up for non-payments. These fees are used by the City to administer the trash hauling
contract, comply with the California Integrated Waste Management Act of 1989, and cover customer service and billing costs.
At the time of the public hearing, the City Council will hear and consider all protests and objections concerning the proposed trash rate
adjustments. Upon conclusion of the hearing, the City Council will consider, and may adopt, the proposed trash rate adjustments. If written
protests against the proposed rate adjustments and fee schedule are not presented by a majority of owners of the identified parcels upon which
the rates and fee schedule are proposed to be imposed, the City Council will be authorized to impose the rates and fee schedule.
Comments or protests to the proposed trash rate adjustments must be delivered in writing to the City Clerk, City of Azusa, 213 East Foothill
Boulevard, Azusa, CA 91702, prior to the public hearing on June 19, 2017. Written protests may also be submitted at the public hearing so long

Mandatory Organic Waste Recycling Program for Commercial Customers
In October 2014, Governor Brown signed AB 1826, requiring businesses to recycle their organic waste on and after April 1, 2016, depending
on the amount they generate each week. Organic waste includes food waste, green waste, landscape and pruning waste, nonhazardous wood
waste, and food-soiled paper waste that is mixed in with food waste. Effective January 1, 2020, all commercial customers (businesses and
multi-family dwellings with 5 units or more) that generate 2 cubic yards or more of commercial solid waste per week shall arrange for organic
waste recycling services.
In order to implement the Organics Recycling Program in the City, Athens Services, the City’s franchised trash hauler, is offering organic
recycling services to businesses that are required to implement an organic recycling program under AB 1826, and may charge businesses that
utilize such services for the cost of those services. The City Council will be considering adoption of Athens Services proposed monthly organic
waste recycling program rate schedule effective retroactive to July 1, 2021, as set forth below for commercial customers in Table 2.
At the time of the public hearing, the City Council will hear and consider all protests and objections concerning the proposed trash and organic
waste recycling rate schedule, including all written protests submitted against the proposed rate adjustments. Upon conclusion of the hearing,
the City Council will consider, and may adopt, the proposed trash and organic waste recycling rates, if written protests against the proposed
rates and fee schedule are not presented by a majority of owners of the identified parcels upon which the rates and fee schedule are proposed

El Consejo Municipal considerará la adopción del programa propuesto de tablas de tarifas mensuales de reciclaje de desechos orgánicos de
Athens Services retroactivas al 1 de julio de 2021, según lo establecido para los clientes comerciales en la Tabla 2.
En el momento de la audiencia pública, el Consejo Municipal escuchará y considerará todas las protestas y objeciones relativas a la tabla de
tarifas de reciclaje de basura y desechos orgánicos propuestos, incluyendo a todas las protestas escritas presentadas contra los ajustes de
tarifas propuestos. Al concluir la audiencia, el Consejo Municipal considerará, y podría adoptar, las tarifas de reciclaje de basura y desechos
orgánicos propuestas, si las protestas contra las tarifas y la tabla de tarifas propuesta no son presentadas por una mayoría de propietarios de
las parcelas identificadas en las que se propone que se impongan las tarifas y la tabla de tarifas. Si se adoptan, las tarifas entrarán en vigor el
1 de julio de 2021. Como se indica con más detalle a continuación, las tarifas también pueden ajustarse automáticamente anualmente a partir
del 1 de julio de 2021, durante un período de cinco años a través de e incluyendo ajustes efectivos el 1 de julio de 2024.

total de un aumento del CPI por la inflación más cualquier aumento de las Cuotas de Rellenos Sanitarios, sujeto a un máximo anual del 5%. Si
un ajuste de las tarifas debiera exceder esta cantidad en un solo año, se celebrará otra audiencia pública para considerar ese ajuste de tarifas

to July 1, 2021. As noted in more detail below, the rates
may also be automatically adjusted annually beginning July
1, 2021 and each July 1 thereafter, for a five-year period
through and including adjustments effective July 1, 2024.
Because the City anticipates future rate adjustments in
the cost of providing trash services that Athens Services
will charge pursuant to the franchise agreement, the City
is also proposing to annually pass through to trash service
customers automatic adjustments based upon two factors:
(i) for inflation, based upon the annual percentage increase
in the Consumer Price Index, all Urban Consumers, for
Los Angeles/Riverside/Orange County, as determined by
the United States Department of Labor Statistics, or its
successor (“CPI”) and (ii) increases in solid waste disposal/
recycling rates to comply with statutory solid waste diversion
mandates (“Tipping Fees”). These adjustments will impact
the trash rates. If approved, beginning July 1, 2021, and each
July 1 thereafter for a five-year period, through and including
adjustments effective on or after July 1, 2024, the trash rates
may be adjusted annually, without a further public hearing,
by an amount not to exceed the total of a CPI increase for
inflation plus any increase in Tipping Fees, subject to a
maximum of 5% annually. If a rate adjustment should exceed
this amount in any single year, another public hearing will
be held to consider that proposed rate adjustment. In no
event may an automatic adjustment exceed the City’s cost of
providing trash services.
Any record owner of a parcel upon which the trash rates
are proposed may submit a written protest to the proposed
rate adjustments. To oppose the proposed rate adjustments,
you must submit a written protest, even if you plan to attend
the public hearing. Your written protest to the proposed
trash and organic waste recycling rates must be received
(not postmarked) by the City Clerk, City of Azusa, 213 East
Foothill Boulevard, Azusa, CA 91702, prior to the close of the
public hearing on July 19, 2021. Written protests may also be
submitted at the public hearing so long as they are received
prior to the conclusion of the public hearing. Oral, telephonic
and e-mail protests will not be accepted. You must sign the
protest and include: 1) your name, 2) your street address,
and 3) your trash service account number. Please identify
on the front of the envelope that the enclosed letter is for
the “2021 Trash Rate Adjustment Public Hearing”. Only one
written protest will be counted per identified parcel.

Las bases y razones de los cambios propuestos de las tarifas
de recolección de desechos se exponen en un informe
disponible en la Oficina de la Secretaría de la Ciudad en 213
E. Foothill Boulevard en Azusa que puede ser revisado por
cualquier persona interesada. La solicitud para el ajuste de
tarifas propuesto se basa en el acuerdo de franquicia de basura
existente de la Ciudad con Athens Services, el transportista de
basura franquiciado de la Ciudad. Los ingresos de este ajuste
de tarifas se utilizarán para pagar a Athens Services por los
servicios de recolección de basura, reciclaje y eliminación.
Los servicios de reciclaje incluyen el procesamiento de todos
los desechos recogidos en Azusa a través de una instalación
de recuperación de materiales donde se eliminan y reciclan
todos los productos de vidrio, plástico, metal y papel. Otras
porciones de la tarifa de recolección de desechos incluyen
las tarifas de la Ciudad, como la tarifa de franquicia del
10%, AB 939 o la tarifa de reciclaje y la tarifa de facturación/

incluyen desechos de alimentos, desechos verdes, desechos
paisajísticos y de poda, desechos de madera no peligrosos, y
desechos de papel ensuciados con alimentos que se mezclan
con los desechos alimentarios. A partir del 1 de enero de
2019, todos los clientes comerciales (empresas y viviendas
multifamiliares con 5 unidades o más) que generen 4 yardas
cúbicas o más de desechos sólidos comerciales por semana
harán arreglos de servicios de reciclaje de desechos orgánicos
Con el fin de implementar el Programa de Reciclaje Orgánico
en la Ciudad, Athens Services, el transportista de basura
franquiciado de la Ciudad, está ofreciendo servicios de reciclaje orgánico a las empresas que se les requiere implementar un programa de
reciclaje orgánico bajo la ley AB 1826, y puede cobrarle a las empresas que utilicen dichos servicios por el costo de esos servicios.

SE DA AVISO POR LA PRESENTE que de conformidad con el Artículo XIIID de la Constitución de California, el Consejo Municipal de la Ciudad
de Azusa llevará a cabo una AUDIENCIA PÚBLICA para considerar los ajustes de las tarifas de los servicios de recolección y reciclaje de basura
efectivos para las facturas emitidas el o después del 1 de julio de 2021. Este aviso se envía por correo al propietario del registro de cada parcela
identificada sujeta a las tarifas de basura. Dicha AUDIENCIA PÚBLICA se llevará a cabo en la reunión ordinaria del Consejo Municipal de la
Ciudad de Azusa el LUNES, 19 DE JULIO DE 2021, a las 7:30 P.M., o tan pronto como sea posible a partir de entonces, en el Auditorio Cívico,
213 E. Foothill Blvd., Azusa. El Consejo Municipal considerará la aprobación de una tabla de tarifas de recolección y reciclaje de desechos la
cual es vigente retroactivamente al 1 de julio, 2021, según lo establecido en la Tabla 1, para servicios residenciales y comerciales típicos. Lea
