HomeMy WebLinkAboutE-7 Staff Report - Stantec PSA Amendment 1CONSENT ITEM E-7 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: MATT MARQUEZ, ECONOMIC AND COMMUNITY DEVELOPMENT DIRECTOR DATE: OCTOBER 4, 2021 SUBJECT: REQUEST TO AMEND PROFESSIONAL SERVICES AGREEMENT (1ST AMENDMENT PSA) WITH STANTEC TO PROVIDE PLANNING AND ENVIRONMENTAL CONSULTANT SERVICES FOR THE GREAT PARK AND RESIDENTIAL PROJECTS LOCATED AT 807 THE PROMENADE BACKGROUND: Development of the Rosedale Master Planned Community is essentially complete. A total of 1,227 of the 1,250 authorized homes have been completed, sold, and occupied, leaving 23 unbuilt units remaining within the City’s approved authorization pursuant to the Monrovia Nursery Specific Plan (MNSP). All public parks, land dedications and required infrastructure improvements within the community have been completed and accepted by the City, except for the Great Park - which was planned for construction in an area located on the north side of East Promenade between Azusa Veterans Way and Rosedale Avenue. Completion of the Great Park was delayed due to Azusa Unified School District’s (AUSD) litigation and uncertainty about the obligation and timing of construction of the K-8 school, which has now been resolved. On November 18, 2019, the City Council authorized the sale of bonds from CFD 2005-1 Improvement Area 2, and $7.25 million of which is allocated to reimburse the District for facilities, and $7.0 million of which is allocated for development of the Great Park by Rosedale Land Partners (RLP). Below is a timeline of the project: June 2, 2020 - Preliminary Plan Review (PPR) was submitted by Rosedale Land Partners (RLP) for the following: •180 three-story garden style multi-family residences; and •Great Park on 6.23 acres of vacant land July 14, 2020 – Staff responds to Preliminary Plan Review (PPR and the proposed proposal would require Specific Plan Amendment and Special Election. APPROVED CITY COUNCIL 10/6/2021 PSA Amendment No. 1 Stantec – The Great Park and Residential Project – Rosedale October 4, 2021 Page 2 of 4 August 12, 2020 – Rosedale Land Partners (RLP) withdrew Preliminary Plan Review (PPR and a second Preliminary Plan Review (PPR) application was submitted, and it proposed the following: • Development of the Great Park on 9.1 acres previously designated in the MNSP for a K-8 school, and 23 single family homes on 5.5 acres previously designated for the Joint Use Community Park. • In lieu of dedicating two (2) acres to the City, RLP would dedicate the former 9.1-acre school site to the City, and construct additional recreational amenities as depicted on their site plan, or with such amenities as mutually agreed upon by the City and RLP. • RLP proposes to enter into a MOU with the City to memorialize the amenities to be developed within the Great Park and to identify the necessary and appropriate city approvals for development of the Great Park and the 23 single family homes. October 15, 2020 – Staff provides comments on Preliminary Plan Review (PPR) PPR Application. November 10, 2020 – Rosedale Land Partners (RLP) submits application for Minor Modification to Monrovia Nursery Specific Plan (MNSP). November 11, 2021 – Rosedale Land Partners (RLP) resubmits residential layout with Type 7 alley- loaded detached single family homes and enhanced pedestrian connection between Promenade and The Great Park along Rosedale Avenue. December 10, 2020 – City Staff issues a Notice of Incomplete Application February 17, 2021 - Rosedale Land Partners (RLP) submits all required items requested per Notice of Incomplete application March 2, 2021 - Rosedale Land Partners (RLP) submits formal Design Review and Tentative Tract Map application for 23 alley-loaded single family homes. March 18, 2021 – Stantec provide an update on the Minor Modification submittal. April 5, 2021 – Allen Matkins Attorney submits letter asserting that Rosedale Land Partners (RLP) application are deemed complete in accordance with State Permit Streamlining Act May 24, 2021 – Staff provides Development Review Committee (DRC) comments on the Residential and Park Design Review and TTM applications June 3, 2021 - Rosedale Land Partners (RLP) response letter to Development Review Committee (DRC) comments submitted to City Staff. June 23, 2021 – Rosedale Land Partners (RLP) submits Residential Alternative #2 to City Staff. July 17, 2021 – City Staff provides comment on Residential Alternative #2 to Rosedale Land Partners (RLP). July 20, 2021 – Rosedale Land Partners (RLP) submits response letter to Residential Alternatives #2 PSA Amendment No. 1 Stantec – The Great Park and Residential Project – Rosedale October 4, 2021 Page 3 of 4 and decides not to continue design process. They request to continue with the Study Session with the both alternatives as submitted. Below is a timeline of the park amenities outreach: February 4, 2021 – February 17, 2021 – Community Wide Park Amenities Survey. A total of 599 [597 (English) and 2 (Spanish)] residents responded to the survey and some of the results are as follows: • Benches (75%) • Botanical Garden (63%) • Covered Picnic Areas (68%) • Drinking Fountain/Bottle Filling (68%) • Open Space (79%) • Restrooms (73%) • Walking Paths (90%) April 10 and 12, 2021 - The city conducted two online public outreach meetings to gather information from the public and survey community members on amenities proposed for the Great Park. Of the amenities presented, walking paths, open spaces, benches, restrooms, drinking fountains/ bottle filing stations, covered picnic areas, and botanical gardens were the highest ranked for further consideration to be included in the Great Park location. August 11, 2021 – The Planning Commisison held a Study Sessions focusing on the residential project as it relates to The Great Park, Rosedale Community and City of Azusa. They looked at two alternatives for the residential project, that have different Building Typologies and Access. Alternative #1 – Applicant’s Preferred Alternative which includes detached single-family alley- loaded building typologies with access from Azusa Veterans Way. Alternative #2 – City’s Preferred Alternative with Amendments which includes attached townhomes with access from The Promenade and additional recommended amendments by City Staff. The Planning Commission gave direction to further development Alternative #2 and provide a traffic memo on both alternatives. RECOMMENDATION: Staff recommends that the City Council take the following actions: 1) Approve the Professional Services Agreement Amendment No. 1 that will increase the monies and project scope with Stantec to provide planning and environmental consultant services for The Great Park and Residential Project; and 2) Authorize the City Manager to prepare and execute the agreements, in a form acceptable to the City Attorney, on behalf of the City. PSA Amendment No. 1 Stantec – The Great Park and Residential Project – Rosedale October 4, 2021 Page 4 of 4 ANALYSIS: Due to the direction given by the Planning Commission, the contract scope is changing to include additional reviews and technical traffic studies. FISCAL IMPACT: The original overall contract amount of $96,043.20 which includes a 10% contingency ($87,312.00 contract amount and $8,731 contingency). The new overall contract amount of $146,625.00 which includes a 10% contingency ($45,984 new contract increase and new $13,329 contingency). The new contract amount shall not exceed $146,625.00. The Project applicant will execute an Amendment to Reimbursement Agreement with the City requiring it reimburse the City for all costs associated with the project including but not limited to planning and environmental consultant services, attorney fees, publications and mailings. This Agreement is made and entered into this 10th day of October, 2021 by and between the City of Azusa, a municipal corporation organized under the laws of the State of California with its principal place of business at 213 East Foothill Boulevard, Azusa, California 91702 (“City”) and Stantec Consulting Inc., a California Incorporated Company with its principal place of business at 290 Conejo Ridge Avenue, Thousand Oaks, CA 91361 (“Consultant”). City and Consultant are sometimes individually referred to herein as “Party” and collectively as “Parties.” 2.RECITALS. 2.1 Agreement. The Parties entered into that certain Agreement for the The Great Park and Residential Project on January 19, 2021. 3.AMENDMENT. Section 3.1.2 is hereby amended to read as follows: 3.2.2 Scope of Services and Term. “3.2.2 Schedule of Services. Consultant shall perform the Services expeditiously, within the term of this Agreement, and in accordance with the Schedule of Services set forth in Exhibit “A”, “B”, and “C” attached hereto and incorporated herein by reference. Consultant represents that it has the professional and technical personnel required to perform the Services in conformance with such conditions. In order to facilitate Consultant’s conformance with the Schedule, City shall respond to Consultant’s submittals in a timely manner. Upon request of City, Consultant shall provide a more detailed schedule of anticipated performance to meet the Schedule of Services. 3.3 Fees and Payment “3.3.1 Compensation. Consultant shall receive compensation, including authorized reimbursements, for all Services rendered under this Agreement at the rates set forth in Exhibit “A” attached hereto and incorporated herein by reference. The total compensation shall not exceed ($146,625.00) without written approval of the City Manager. Extra Work may be authorized, as described below, and if authorized, will be compensated at the rates and manner set forth in this Agreement. 4.REMAINING PROVISIONS OF AGREEMENT. Except as otherwise specifically set forth in this First Amendment, the remaning provisions of the Agreement shall remain in full force and effect.
