JOHNSON, DIRECTOR OF ADMINISTRATIVE SERVICES DATE: DECEMBER 13, 2021 SUBJECT: HUMAN RESOURCES ACTION ITEMS BACKGROUND: The recommended actions approves Personnel Action Requests reviewed and recommended by the Personnel Board and also approved a Side Letter of Agreement with the Azusa Police Officers Association relating to premium pay for K-9 handling. RECOMMENDATIONS: Staff recommends the City Council take the following actions: 1)Approve the following Personnel Action Requests in accordance with the City of Azusa Civil Service Rules and applicable Memorandum of Understanding(s). 2) Approve a Side Letter of Agreement with the Azusa Police Officers Association relating to premium pay for K-9 handling. NEW SIDE LETTER FOR POA MOU – The current Azusa Police Officers Association MOU provides 5% special assignment pay for K-9 Officers. Current case law requires K-9 Officers to also be compensated for care and maintenance of a K-9 dog. The proposed side letter states the POA MOU, Section 6.10 Special Assignment – K-9 Officers to include three and half (3.5) hours per week paid at premium rate equal to time and one half (1.5) of the K-9 Officer’s base hourly rate for the care and maintenance of the dog. The side letter has been approved by the POA. FISCAL IMPACT: All proposed changes were approved with the FY 2021/22 Adopted Budget and/or are able to be absorbed with anticipated salary savings. Side Letter of Agreement Azusa Police Officers Association Page 1 of 3 Date Adopted: 12/13/2021 Range: 4186 CITY OF AZUSA ASSISTANT WATER UTILITY ENGINEER DEFINITION Under general supervision, performs a variety of field and office sub-professional civil engineering work in the research, design and construction of water capital infrastructure, improvements, maintenance, and construction projects; prepares a diverse range of engineering plans, technical specifications, calculations, studies, reports and special conditions for new developments; conducts site visits to monitor construction project progress; and performs related duties as required. CLASS CHARACTERISTICS Incumbents of this class perform sub-professional routine and complex engineering assignments and are responsible for independent engineering analysis and recommendations. Incumbents assist in carrying out assigned water system capital improvement designs, construction, and maintenance projects, and designs for new and upgraded water services for new developments and customers. Incumbents work under the direction of a Senior Water System Engineer, Water System Engineer, and Associate Water Utility Engineer, to perform moderately difficult sub-professional engineering work. ESSENTIAL FUNCTIONS The duties listed below are intended only as illustrations of the various types of work that may be performed. The omission of specific statements of duties does not exclude them from the position if the work is similar, related or a logical assignment to this class. Designs and prepares plans, specifications, and cost estimates for water projects, including new developments, and capital improvement projects; reviews and updates engineering standard drawings, specifications, design criteria and technical reports; prepares project related documents; researches project design requirements and obtains necessary permits; performs complex calculations and makes estimates of time and material costs. Performs inspections of construction projects to verify conformance with plans and specifications. Investigates field conditions affecting property owners, contractors, and maintenance operations and makes recommendations; assists in technical studies and prepares reports and recommendation related to water utility civil engineering projects, such as new developments, capital improvements, and other specialized studies. Participates in the plan check, review, and processing of plans for proposed residential, commercial, and industrial developments by checking site plans and tentative and final subdivision maps for compliance with appropriate regulations and ensures that they meet all City-imposed requirements; prepares conditions of approval and will serve letters. Assists developers, contractors, consultants, customers, and other City departments and staff at the Attachment 1 Page 2 of 3 public counter, and communicates and corresponds in writing by email and telephone; responds to records requests; calculates fees and issues water work orders. Example combinations include a bachelor’s of science degree or equivalent, with major work in civil engineering or closely related field, and two years of progressively responsible professional experience in civil engineering or a closely related field. Possession of an Engineer-In Training Certificate issued in the State of California is desired. CLASS CHARACTERISTICS Incumbents of this class perform journey level routine and complex professional civil engineering assignments and are responsible for independent engineering analysis and recommendations. Incumbents are responsible for carrying out assigned water system capital improvement designs, construction, and maintenance projects, and designs for new and upgraded water services for new developments and customers. Incumbents may supervise the work of assigned professionals, consultants, and technical staff, including lower level staff performing inspections of water facilities. Performs contract administration of projects including the technical review and approval of project plans, designs, and construction; assists in evaluating project proposals and recommending award of contracts. Performs inspections of construction projects; makes field inspections of existing structures to determine adequacy and estimate stabilizing requirements; meets with contractors to resolve items of non-compliance. Performs a variety of technical studies, calculations, and analysis related to civil and water engineering; organizes data and information; investigates complaints; prepares reports, including Attachment 2 2 Utility Board staff reports; and provides recommendations related to civil engineering projects, such as capital improvement projects, and other specialized studies. Reviews and approves proposed residential, commercial, and industrial developments by checking site plans and tentative and final subdivision maps for compliance with appropriate regulations; prepares conditions of approval. SIDE LETTER OF AGREEMENT BETWEEN CITY OF AZUSA AND THE POLICE OFFICERS ASSOCIATION This Side Letter of Agreement (“Agreement”) between the City of Azusa (“City”) and the Police Officers Association (“Association”) (collectively “Parties”) is entered into with respect to the following: WHEREAS, the Parties have a Memorandum of Understanding (“MOU”) that commenced on August 1, 2020 and is set to expire on July 31, 2024; WHEREAS, the MOU currently provides 5% special assignment pay for the K-9 Officer; WHEREAS, the Association and the City agrees the MOU is lacking language regarding K-9 compensation for care and maintenance of the dog in accordance with current case law; LET IT BE RESOLVED, that MOU section 6.10 Special Assignment – K-9 Officer to include: Employees who are regularly assigned responsibility or canine handling and care shall receive three and a half (3.5) hours per week paid at the premium rate equal to time and one half (1.5) of the employee’s base hourly rate. This is considered compensation for hours worked under the FLSA for the time spent at his/her residence in caring for the dog during regular days off and during vacation, holiday, sick leave, etc. Those unit members assigned to canine duty agree that the above additional hours provided each week are reasonably necessary to provide for the care and maintenance of the assigned canine and that these additional “hours worked” are intended to compensate unit members assigned to canine duty for all off duty hours spent caring for and maintaining their assigned canine, in compliance with the FLSA and interpretive cases and rulings. The assigned K9 handler shall receive this “Canine Premium Pay” regardless of their leave status. Employees assigned as canine handlers will be compensated for travel time to and from, as well as actual time spent, attending canine training with the Department’s approved trainer at the premium rate equal to time and one half (1.5) of the employee’s base ho urly rate if the training falls on the canine handler’s normal days off.
