JOHNSON, DIRECTOR OF ADMINISTRATIVE SERVICES DATE: JANUARY 18, 2022 SUBJECT: PUBLIC HEARING - ADOPTION OF UPDATED CITYWIDE SCHEDULE OF FEES AND CHARGES BACKGROUND: On January 19, 2016, the City Council adopted several resolutions approving certain adjustments to the City’s Schedule of Fees and Charges. In addition, the City Council authorized Staff to adjust the schedule of fees and charges annually based on the change in the Consumer Price Index (CPI) or 2%, whichever was greater, but not to exceed 5%. The Los Angeles Area CPI change from September 2020 through September 2021 was 4.6%. Consequently, Staff has adjusted the majority of fees by 4.6% consistent with previous instructions established by the City Council. These changes are ministerial in nature and no further action is required by the Council in order to complete these fee updates. As part of the fee update, Staff would like to make other modifications to the schedule of fees and charges that fall outside of the parameters of the previous direction provided by the City Council. The proposed action requests the City Council to adopt the fee modifications outlined in Attachment 4 which includes three tables: 1) New fees proposed; 2) Fees proposed to be modified by an amount other than the previously directed CPI adjustment; and 3) Fee proposed to be eliminated. RECOMMENDATIONS: Staff recommends that the City Council take the following actions: 1)Receive, review, and file the updated Citywide Fee and Charges Schedule; and 2)Open the Public Hearing, receive public testimony, and close the Public Hearing; and 3)Adopt Resolution No. 2022-C01, regarding various municipal activities and services, to be effective on January 18, 2022; and 4)Adopt Resolution No. 2022-C02, regarding development project services fees, to be effective 60 days from January 18, 2022 (March 19, 2022). Revised APPROVED CITY COUNCIL 1/18/2022 Adoption of Citywide Fees and Charges January 18, 2022 Page 2 ANALYSIS: California Government Code 66000 allows public agencies to impose fees to recover the costs of providing various public services. In an effort to keep current with the cost of providing services, the City Council authorized Staff to implement the recommendations and fee adjustments from the latest fee study adopted January 19, 2016. The City Council also directed Staff to annually adjust the City’s Schedule of Fees and Charges by the change in the Consumer Price Index - Los Angeles Area (CPI) with a minimum increase of 2% and a maximum increase of 5% for most fee categories. The minimum increase of 2% is intended to mirror the City’s labor cost inflation. The City’s labor costs typically increase annually, even when there is a small change in the CPI. Inflation at the Los Angeles area grew during the last quarter in calendar year 2021 mainly due to supply chain issues and the reopening of the economy. During the government mandated shut-down, companies cut investment spending, restocking was put off, and the economy was at a prolonged downturn. As the economy reopens and more restrictions are lifted, consumers are buying a lot more and companies are finding it difficult to keep up with rapidly rising product demand as they rebuild supply chains that were badly impacted by the pandemic. Challenges such as a shortage of shipping containers and transportation logistic issues means shipping and distribution of goods has become more difficult and more expensive. Additionally, there were an enormous amount of government spending and congressional approved stimulus including the Cares Act (Coronavirus Relief Fund) and the American Rescue Plan that created even higher demands. When an economy is growing and there is high demand, businesses find it easier to raise prices without losing customers. The stated scenario in essence translated into higher consumer prices and driving up inflation. For the current review period, the CPI change from September 2020 through September 2021 was 4.6%. Consequently, Staff has adjusted the majority of fees by 4.6%. There are several fees that fall outside the parameter of the previous direction provided by the City Council. Specifically, six (6) new fees are being proposed (Attachment 4, Table 1) to reflect new programs and/or to enhance the City’s ability to provide services. The new fees include: 1)Emergency Sewage Spill Response Sect. 26.1 (Engineering Div) Actual Staff Time ($504 Minimum) - An Emergency Sewage Spill can occur when any of the following takes place: overflowing of a septic tank, tree roots invading and blocking underground sewer lines, misaligned sewage pipes that cause buildup over time, or blockages within the interior sewer systems caused by improper materials flushed into the sewer system. In extreme cases the sewage spill can overflow from the City's sewer mainlines into public right-of-way where clean-up efforts are to be provided to clean, and dispose of all raw hazardous sewage material. Emergency Sewage Spills can vary in the size of the contaminated area, and volume discharged. Therefore, the fee proposed is actual staff time spent to recuperate the time spent by the Public Works Department. 2)Sewer Area Study Sect. 49 S-8.3 (Engineering Division) $656 or Actual Staff Time - The purpose of a Sewer Area Study is to determine the amount of sewage flow generated by new developments. It ensures that the City's exiting sewer infrastructure has capacity to convey the sewer flows from new developments. The proposed increase will recuperate Adoption of Citywide Fees and Charges January 18, 2022 Page 3 Engineering Division's actual time spent to review and approve the Sewer Area Study. Moreover, the proposed fee will be closer to the fee other adjacent agencies (Glendora, Irwindale, Baldwin Park) charge for the same service. 3)Potholing-Per Location Sect. 50 S-8.4 (Engineering Division) $168 - Potholing refers to identifying utilities lines that are underground to gather information that can include the following: material, depth, and horizontal and vertical. Typically, potholes range from 6" to 12" in diameter, and 4' to 6' deep. Usually, the inspection for these holes to ensure the road has been restored to Azusa's City Standard R12-1 takes one hour. As a result, the proposed increase will recuperate Engineering Division's actual time spent to review and approve the street restoration. 4)Door tag fee Sect. 2 - Sect. S106 f (Utilities Dept) $25 - Fee to cover the expense of manually delivering 24-hour disconnection notice. 5)Plan Check Fee a) Residential and ADU Per Dwelling Unit Sect. 45 S-131M (Utilities Dept) $250 - Recovers cost of Engineer time spent. 6)Plan Check Fee b) Commercial and Industrial Sect. 45 S-131M (Utilities Dept) $250 - Recovers cost of Engineer time spent. There are twenty-two (22) proposed fees that will increase more than the 4.6% CPI (Attachment 4, Table 2): 1)Soil Review Sect. S-15 S-056C (Engineering Division) from $335 to $656 - The Soil Report takes approximately 3-4 hours of review, and sometimes requires multiple review cycles. As a result, the proposed increase will recuperate Engineering Division's actual time spent to review and approve the Soil Report. Moreover, the proposed fee will be closer to the fee other adjacent agencies (Glendora, Irwindale, Baldwin Park) charge for the same service. 2)a) Water Meter Fee 3/4" Sect. 10 S-131D (Utilities Dept) from $200 to $250 - To recover the actual cost of meter which has gone up in price. The supplier increased the price of the meter, and this is a pass-through cost. 3)b) Water Meter Fee 1" Sect. 10 S-131D (Utilities Dept) from $250 to $300 - To recover the actual cost of meter which has gone up in price. The supplier increased the price of the meter, and this is a pass-through cost. 4)c) Water Meter Fee 1.5" Sect. 10 S-131D (Utilities Dept) from $1,000 to $1,250 - To recover the actual cost of meter which has gone up in price. Special services are defined as services provided to a patient that are unique and individual to a specific patient's needs, and are performed on a limited basis. C.Charges for special services provided to patients that are new services, but will become an industry standard, must be reviewed and a rate commensurate with the service developed prior to ambulance operators charging such rate to the general public. Such rates shall not be charged to patients until approved by the Board of Supervisors. D.This section does not apply to a contract between an ambulance operator and the County where different rates or payment mechanisms are specified. Section 7.16.340 Modification of Rates. The maximum rates chargeable to the general public as set forth in Sections 7.16.280 and 7.16.310 of this chapter shall be adjusted effective July 1, 1992, and on July 1st of each year thereafter, to reflect changes in the value of the dollar. For each of the one year periods respectively beginning July 1, 1992 and July 1, 1993 such adjustments shall be made by multiplying the ba·se amounts by the percentage change in the transportation portion of the Consumer Price Index for All Urban Consumers, Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12-month period ending with the last day of the prior month of February. Beginning July 1, 1994, and on each July 1 thereafter, such adjustments shall be determined by multiplying the base amounts by the average of the percentage changes of the transportation portion and of the medical portion of the Consumer Price Index for All Urban Consumers, Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12-month period ending with the last day of the prior month of February. Beginning July 1, 2017, and on every July 1 thereafter, such adjustments shall be determined by multiplying seventy-five (75) percent of the base amounts by the percentage change of the minimum wage change in Los Angeles County as defined in County Code Section 8.100 .040 -Minimum Wage and by multiplying twenty-five (25) percent of the base amounts by the percentage change of the Medical Care line item of the Consumer Price Index for all Urban Customers, Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12- month period ending with the last day of the prior month of February, except for the following changes: Registered Nurse/Respiratory Therapist per hour after the first three (3) hours adjustment shall be determined by multiplying the current charge by the percentage change of the minimum wage change in Los Angeles County as defined in County Code Section 8.100 .040 -Minimum Wage: mileage adjustment shall be determined by multiplying the current charge for the percentage change of the transportation line item of the Consumer Price Index for All Urban Customers, Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12-month period ending with the last day of the prior month of February: and Oxygen, Disposable Medical Supplies, and a Ventilator adjustment shall be determined by multiplying the current charges by the percentage change of the Medical Care line item of the Consumer Price Index for all of the Customers, Western Region, as compiled and reported by the Bureau of Labor Statistics for the 12 month period ending with the last day of the prior month of February.
