All those attending in-person are required to follow posted guidelines. Those wishing to participate during Public Comment may do so in-person at the Azusa Auditorium, or may submit written public comments by emailing PublicComment@azusaca.gov. Emailed public comments are due by 5:30 p.m. and shall be limited to no more than 250 words. Written public comments will be provided to the City Council and will be part of the record but will not be read aloud. NOTICE TO THE PUBLIC FOR CLOSED SESSION Prior to going into closed session the City Council will convene in the Auditorium serving as Council Chambers to take public comment on the closed session items only. General public comment will be provided for during the regular portion of the meeting beginning at 7:30 P.M. 7:30 P.M. - REGULAR MEETING OF THE CITY COUNCIL, THE SUCCESSOR AGENCY, THE PUBLIC FINANCING AUTHORITY. NOTICE TO THE PUBLIC FOR REGULAR MEETING. In compliance with Government Code Section 54957.5, copies of staff reports or other written documentation relating to each item of business referred to on the Agenda are on file in the Office of the City Clerk - 213 E. Foothill Blvd.; copies for public view are at the Azusa City Library - 729 N. Dalton Ave., Azusa Police Department Lobby - 725 N. Alameda Ave., and the City of Azusa Web Page www.azusaca.gov. Persons who wish to speak during the Public Participation portion of the Agenda or on a Public Hearing item, shall fill out a card requesting to speak and shall submit it to the City Clerk prior to 7:30 P.M.; cards submitted after this time will not be accepted. Closed Session Report by the City Attorney - None CEREMONIAL - None B. PUBLIC PARTICIPATION This time has been set aside for persons in the audience to make public comments on items listed on this Agenda only. Members of the audience will have the opportunity to address the City Council/Agency Board about public hearing items at the time the public hearing is held. Under the provisions of the Brown Act, the Council/Agency Board is prohibited from taking action on oral requests, but may refer the matter to staff or to a subsequent meeting. The Council/Agency Board will respond after public comment has been received. Each person or representative of a group shall be allowed to speak without interruption for up to five (5) continuous minutes, subject to compliance with applicable meeting rules. Questions to the speaker or responses to the speaker's questions or comments shall be handled after the speaker has completed his/her comments. Public Participation will be limited to sixty (60) minutes. C. REPORTS, UPDATES, AND ANNOUNCEMENTS FROM STAFF/COUNCIL 1. City Manager Communications. - Update on Azusa-RMC Joint Powers Authority. - Update on Athens Services Transition. 2/7/2022 - 3 - D. SCHEDULED ITEMS 1. PUBLIC HEARING – COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG-CV) CARES ACT FUNDS - A PUBLIC HEARING TO CONSIDER ADOPTING A RESOLUTION APPROVING THE USE OF THE REMAINING $45,693 IN CDBG-CV FUNDS FOR THE EXPRESS PURPOSE OF CONTINUING TO RESPOND TO, ADDRESS, AND MITIGATE THE IMPACTS OF THE COVID-19 PANDEMIC BY PARTICIPATING IN ROUND 3 OF THE LOS ANGELES COUNTY DEVELOPMENT AUTHORITY (LACDA) SMALL BUSINESS GRANT PROGRAM. RECOMMENDED ACTION: 1) Open the public hearing, receive testimony and presentation of the proposed eligible CDBG CARES Act project; and 2) Approval of a Resolution No. 2022-C08 approving the City’s participation in Round 3 of LACDA’s CDBG-CV Small Business Grant Program; and 3) Authorize the City Manager, or his designee, to execute all contracts, Agreements, and Amendments, in a form approved by the City Attorney, with the Los Angeles County Development Authority (LACDA) and if applicable, with each approved recipient/subrecipient of the CDBG-CV Small Business Grant Program. 2. CONSIDERATION AND ADOPTION OF CITY COUNCIL GOVERNANCE PROTOCOLS AND PROCEDURES. RECOMMENDED ACTION: 1) Consider and adopt Resolution No. 2022-C09, establishing formalized protocols and procedures for the Azusa City Council’s conduct of public business. E. CONSENT CALENDAR – CITY COUNCIL The Consent Calendar adopting the printed recommended actions will be enacted with one vote. If Councilmembers or Staff wish to address any item on the Consent Calendar individually, it will be considered under SPECIAL CALL ITEMS. 1. MINUTES OF THE SPECIAL MEETING OCTOBER 13, 2021. RECOMMENDED ACTION: Approve minutes as written. 2. RESOLUTION AUTHORIZING PAYMENTS OF WARRANTS BY THE CITY DATED JANUARY 12, 2022 THROUGH FEBRUARY 2, 2022. RECOMMENDED ACTION: Adopt Resolution No. 2022-C10 allowing certain claims and demands and specifying the funds out of which the same are to be paid. 2/7/2022 - 4 - 3. ADOPTION OF 2022 LEGISLATIVE PLATFORM AND STATE AND FEDERAL LEGISLATIVE PRIORITIES. RECOMMENDED ACTION: Adopt the proposed 2022 City’s Legislative Platform; and Approve the proposed 2022 State and Federal Legislative Priorities. 4. CONSIDERATION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, RATIFYING THE PROCLAMATION OF A STATE OF EMERGENCY BY GOVERNOR NEWSOM (MARCH 4, 2020), AND AUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF AZUSA PURSUANT TO ASSEMBLY BILL 361. RECOMMENDED ACTION: Adopt Resolution No. 2022-C11, ratifying the proclamation of a State of Emergency by Governor Newsom (March 4, 2020), and authorizing remote teleconference meetings of the Legislative Bodies of the City of Azusa pursuant to Assembly Bill 361. 5. APPROVAL OF FIRST AMENDMENT TO ON-CALL ENGINEERING PROFESSIONAL AGREEMENT BETWEEN THE CITY OF AZUSA AND WILLDAN ENGINEERING, KOA CORPORATION AND TKE ENGINEERING INC. RECOMMENDED ACTION: Approve the First Amendment to Professional Services Agreements between the City of Azusa and Willdan Engineering, KOA Corporation, and TKE Engineering Inc.; and Authorize the City Manager to execute the contract amendment, in a form acceptable to the City Attorney, on behalf of the City. 6. APPROVE THE FIRST AMENDMENT TO THE GRANT AGREEMENT WITH LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY FOR THE TRANSIT ORIENTED DEVELOPMENT PLANNING GRANT PROGRAM ROUND 5 TO REDUCE PROJECT COSTS. RECOMMENDED ACTION: Approve a First Amendment to the Grant Agreement for the City of Azusa TIF Feasibility Study for the Azusa TOD Specific Plan Study Area; and Authorize the City Manager to execute the amendment, in a form acceptable to the City Attorney on behalf of the City. 7. REQUEST TO APPROVE SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH BAKERSMAN PRODUCTIONS FOR VIDEO PRODUCTION SERIVCES. RECOMMENDED ACTION: Approve Second Amendment to the Professional Service Agreement with Bakers Man Productions for Video Production Services, not to exceed amount of $12,000; and Authorize the City Manager to execute the agreement, in a form acceptable to the City Attorney. 2/7/2022 - 5 - F.
