HomeMy WebLinkAboutE-10 Staff Report - 483-495 S CitrusCONSENT ITEM E-10 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL VIA: SERGIO GONZALEZ, CITY MANAGER FROM: ROBERT DELGADILLO, P.E., DIRECTOR OF PUBLIC WORKS/CITY ENGINEER DATE: FEBRUARY 22, 2022 SUBJECT: RESOLUTION AUTHORIZING THE ANNEXATION TO THE COUNTY OF LOS ANGELES CONSOLIDATED SEWER MAINTENANCE DISTRICT (LACSMD) THE PROPERTIES LOCATED AT 483-495 S CITRUS AVE FOR SEWER MAINTENANCE PURPOSE ONLY. BACKGROUND: The property located at 483-495 S Citrus Ave is a commercial property composed of seven individual retail spaces. All sewage from the retail spaces is collected in a private sewer system that connects to a public sewer main on Citrus Ave. The property manager stated that due to the shallow slope of the existing private sewer, they have experienced sewage backups and clogging problems over the past several years. The property owner has been advised by his civil engineer that one way to mitigate the clogging problems is to rebuild the private sewer with a steeper slope. Furthermore, the property owner was advised that the slope of the private sewer can be improved by shortening its length. Consequently, the property manager reached out to the Engineering Division to seek permission to rebuild the existing private sewer and connect to an adjacent sewer main on Gladstone Street. The proposed design would shorten the length of the private sewer and improve its slope; however, the sewer main on Gladstone Street is owned and maintained by Los Angeles County Sanitation District (LACSD). The LACSD requires permission from the City of Azusa prior to allowing the property owner to connect to their facility. RECOMMENDATION: Staff recommends the City Council take the following actions: 1) Approve Resolution No. 2022-C13 granting consent and jurisdiction to the County of Los Angeles for the inclusion of the properties located at 483-495 S Citrus Ave for sewer maintenance purposes only. ANALYSIS: APPROVED CITY COUNCIL 2/22/2022 Authorization to Annex Property to LA County CSMD February 22, 2022 Page 2 The location of the subject property is unique because the properties immediately to the north and to the west are not within the City limits, they are within the unincorporated areas of Los Angeles County. The agency in charge of the maintenance of all sewer mains within Los Angeles County is the Los Angeles County Sanitation District (LACSD). The subject property is currently served by an 8-inch sewer main on Citrus Ave. This sewer main is owned and maintained by the City of Azusa. The LACSD owns and maintains an 8-inch sewer main on Gladstone Street. The property owner would like to construct a new sewer lateral and connect to the sewer main on Gladstone Street. The City of Azusa collects sewer fees for this property. However, the annexation of the subject property to the LACSD will not have a perceivable impact on the revenues generated by the sewer charges. In addition, the unique location of the subject property makes this annexation a single occurrence with a minimal chance for other properties owners to duplicate. The LACSD has indicated that the City of Azusa must adopt the attached resolution before the County of Los Angeles can proceed with the proposed annexation for the purpose of sewer maintenance purposes only. FISCAL IMPACT: There will be no fiscal impact to the General Funds and property tax. Annexation of the subject property to the LACSD will not result in an exchange of property tax revenue pursuant to Section 99 of the Revenue and Taxation Code. Sergio Gonzalez Director of Public Works/City Engineer City Manager Attachment: 1) Proposed Resolution No. 2022-C13 RESOLUTION NO. 2022-C13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES FOR THE INCLUSION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF AZUSA INTO THE CONSOLIDATED SEWER MAINTENANCE DISTRICT FOR SEWER MAINTENANCE PURPOSES ONLY. WHEREAS, Lanco Development Properties, LLC a California Limited Liability Company is the owner of real property within the City of Azusa and described in Exhibit “A,” attached hereto, and incorporated herein by this reference, hereinafter referred to as the “PROPERTY”; and WHEREAS, the “PROPERTY” requires an outlet to dispose of sewage generated within its boundaries; and WHEREAS, the Los Angeles County Consolidated Sewer Maintenance District administers, operates and maintain a sewage system for the conveyance of sewage generated within its territorial boundaries; and WHEREAS, the Los Angeles County Consolidated Sewer Maintenance District's sewage system is of a size and capacity to serve the needs of its own as well as the sewage generated within the boundaries of the “PROPERTY”; and WHEREAS, it appears in the public interest and convenience that the “PROPERTY" be included within the County of Los Angeles consolidated Sewer Maintenance District for sewer maintenance purposes only. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Azusa as follows: Section 1. That the public interest and convenience require the inclusion of the “PROPERTY” within the Consolidated Sewer Maintenance District formed for the purpose of maintaining public sanitary sewers pursuant to Chapter 4, Part 3, Division 5 of the Health and Safety Code, as amended, or Chapter 26, Part 3, Division 7 of the Streets and Highways code, as amended, of the State of California. Section 2. That pursuant to the authority vested in it by Section 4895 of said Health and Safety Code, or Section 5837 of said Streets and Highway Code, the City Council, being the legislative body of the City Azusa hereby consents to the inclusion of the “PROPERTY” within the consolidated Sewer Maintenance District for sewer maintenance purposes only and to the exercise of exclusive jurisdiction by the Board of Supervisors of said County of Los Angeles over all proceedings necessary thereto for the purpose of consummating the same. Attachment 1 Section 3. The City Clerk shall certify to the adoption of this resolution and shall deliver three certified copies thereof to the clerk of the Board of Supervisors of the County of Los Angeles.
